AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 309 NORTH WILLIAM
IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS
STREET
WHEREAS, Steven Gauger has filed an application for variations
with respect to property commonly known as 309 North William Street
in the Village of Mount Prospect, Illinois (the "Subject Property");
and
WHEREAS, the Subject Property is described ~s follows:
Lot One (1) in Block One (1) in Bluett's Subdivision of part of the North
Half (1/2) of the Southeast Qu~trter (1/4) of Section 34, Township 42 North,
Range 11, East of the Third Principal Meridian, according to Plat
thereof registered in the Office of the l%sgistrar of Titles of Cook County,
as Document Number 1464233.
WHEREAS, Petitioner seeks the following variations from
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow recognition of a five (5') foot side yard along
the South property line of the Subject Property rather than the ten
(10') foot side yard setback required by Section 14.1102 so as to
allow the continuing encroachment of the dwelling structure to be
located five (5') from the South property line, and to further allow
the construction of a six (6') fence to encroach into the required
front yard area along the North property line of a corner lot as set
forth in Section 21.701.A; and
WHEREAS, a public hearing was held on the variation requests
(designated as Case No. ZBA-44-V-84) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 26th day of October,
1984, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 8th day of October, 1984; and
WHEREAS, the Zoning Board of Appeals has acted to approve
Petitioner's request for a seven (7') encroachment of an attached
garage addition a distance of seven (7') feet into the required
front yard area of the Subject Property on the North side thereof,
pursuant to authority of the Zoning Board of Appeals to approve such
variation, and the Zoning Board of Appeals has submitted its
findings and recommendations to the President and Board of Trustees
of the Village of Mount Prospect to allow the additional requested
variations, and the President and Board of Trustees of said Village
have given further consideration to the variation requests and have
determined that the same satisfy the standards set forth in Section
14.605 of Article VI of Chapter 14 of the Village Code, and this
Board further finds that it would be in the best interest of the
Village to grant the request for variations.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
FOLLOWS:

SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variations requested with respect to Sections 14.1102 of Article XI
and 14.701.A of Article VII of Chapter 14 of the Village Code of
ount Prospect, ll±lnols~ to a±±ow the con~lnue~ existence o~ the
dwelling structure to encroach a distance of five (5') foot into the
ten (10') foot side yard area and to further allow the construction
of a six (6') foot fence within the corner lot front yard area on
the North side of the Subject Property in accordance with the Site Plan
attached hereto.
SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
