AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 17 SOUTH WA-PELLA AVENUE
IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS
WHEREAS, John Breitsameter has filed an application for
v iation with respect to property commonly known as 17 South
W -Pella Avenue in the Village of Mount Prospect, Illinois (the
" ~bject Property"); and
WHEREAS, the SUbject Property is described as follows:
~t 290 in H, Roy Berry Company's Colonial Manor, being a subdivision of
~t of the Northeast Quarter (1/4) of Section 11 and part of the
iorthwest Quarter of (1/4) of Section 12, all in Township 41 North, Range 11
~st of the Third Principal Meridian.
WHEREAS, Petitioner seeks the following variation from
ovisions of Chapter 14 of the Village Code of Mount Prospect,
linois, to allow the replacement of his existing detached garage
s ructure with a new garage to be located three (3') feet within the
r quired five (5') fOot side yard area as set forth in Section
1 102.B.2 of Article I thus allowing a two (2') foot setback from
t e side property line; and

WHEREAS, a public hearing was held on the variation request
esignated as CaSe No. ZBA-46-V-84) before the Zoning Board of
.peals of the Village of Mount Prospect on the 26th day of October,!
86, pursuant to due and proper notice thereof published in the I
unt Prospect Herald on the 8th day of October, 1984; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
d recommendation to the President and Board of Trustees of the
llage of Mount Prospect to allow the requested variation, and the
esident and Board of Trustees of said Village have given further
.nsideration to the variation request and have determined that the
me satisfies the standards set forth in Section 14.605 of Article
of Chapter 14 of the Village Code, and this Board further finds
at it would be in the best interest of the Village to grant the
quest for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
USTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
LLOWS:
SECTION ONE: The recitals set forth hereinabove are
corporated herein as findings of fact by the President and Board
Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
Mount Prospect hereby grant to the Subject Property the variation
quested with respect to Sections 14.102.B.2, of Article I of
apter 14 of the Village Code of Mount Prospect, Illinois, .to allow
e installation of a new garage structure having a set back of onl
o (2') feet from the side lot line.
SECTION THREE: Except for the variation granted herein, all
her applicable Village of Mount Prospect Ordinances and
gulations shall remain in full force and effect as to the Subject
opertyinaccordance with the Site Planattachedhereto.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
