AN ORDINANCE TO TERMINATE VARIATIONS PREVIOUSLY
GRANTED FOR PROPERTY AT 701 EAST PROSPECT AVENUE
IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS
WHEREAS, on November 5, 1980 this Board adopted Village
Ordinance NO. 3065 to grant certain variations to property known as
701 East Prospect Avenue in the Village of Mount Prospect, Illinois;
WHEREAS, among the variations granted by Village Ordinance No.
3065 was a variation to permit the elimination of required loading
spaces and the reduction of required off-street parking spaces on
the Subject Property to 48; and
WHEREAS, said variations were granted pursuant to a public
hearing at which Petitioner Raymond G. Hoven, the owner of the
Subject Property submitted testimony and evidence indicating that
his business use of the Subject Property located in the I-1 Light
Industrial District under the provisions of the Zoning Ordinance of
the Village would be such that the elimination of required on-site
loading spaces and reduction of parking spaces would not adversely
affect the supply of parking within the immediate area or
substantially increase congestion in the public Streets; and
WHEREAS, following the granting of said variations the
Petitioner's business has increased in scop~ and number of employees
so that adequate parking is no longer available on the Subject
Property; and
WHEREAS, employee parking has spilled over onto the public
streets serving adjacent residential areas of the Village and such
parking has created congestion of public streets and has adversely
affected the supply of parking within the. immediate area, and has
had an adverse effect on the residential character of adjoining
properties; and
WHEREAS, the Zoning Board of Appeals of this Vi±iage conaucted a
public hearing, upon the publication of due notice thereo~ and the
President and Board of Trustees of this Village has received further
public comment regarding the congested parking situation and has
determined that the circumstances upon which the above stated
variations were given in 1980 are no longer in effect and that the
Petitioner's business activities have expanded to such an extent
that employee parking can no longer be adequately provided ~or or
contained within the Subject Property; and
WHEREAS, it is the determination of the President and Board o~
Trustees of this Village that the variations no longer meet the
standards set forth in Section 14.605 of Article ~/~ of the Zoning
Ordinance of the Village of Mount Prospect and therefore such
variations should be terminated.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
FOLLOWS:
SECTION ONE: The recitals set forth hereinaOove are incorporatea
herein as findings of fact by the President and Board of Trustees
the Village of Mount Prospect.
SECTION TWO: The following variations ~ereto~ore granted to the
property commonly known as 701 East Prospect Avenue in the Village
f Mount Prospect, Illinois pursuant to Village Ordinance No. 3065,
are hereby terminated, to wit:
A variation from Section 14.2205.A.1 of Article XX~i of the
Zoning Ordinance to reduce the total number of required
off-street parking spaces to 48.

A variation from Section 14.2205.B.l.b of Article XXII of
the Zoning Ordinance to permit the elimination of required
loading spaces.
SECTION THREE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
