ORDINANCE NO. 3519
AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY LOCATED AT THE NORTHEAST CORNER OF NORDIC AND
CARBOY ROADS IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS
WHEREAS, Ulrich G. Marks has filed his application with
respect to property located at the Northeast Corner of Nordic and
Carboy Roads (the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 5 in EL~hurst Algonquin Industrial Park No.
2 in the Southeast 1/4 of Section 27, Township 41
North, Range 11 East of the Third Principal
Meridian in Cook C6unty, Illinois.
WHEREAS, Petitioner, seeks the following variations from
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow a reduction in the required 4-acre lot size as
provided in Section 14.2203.A of Article XXII of said Chapter 14 to
a lot size of approximately 1 acre, and to allow a reduction in the
number of required parking spaces from 71 as provided in Section
14.2205.A of Article XXII of said Chapter 14 to provide for 32
parking spaces; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-12-V-85) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 4th day of April,
1985, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the llth day of March, 1985; and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of Trustees
of the Village of Mount Prospect to allow the requested variation,
and the President and Board of Trustees of said Village have given
further consideration to the variation request and have determined
that the same satisfies the standards set forth in Secti6n 14.605
Article VI of Chapter 14 of the Village Code, provided that a
landscaping plan covering development of the Subject Property be
approved by the Community Development Department, and this Board
further finds that it would be in the best interest of the Village
to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, aS
FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Sections 14.2203.A and
14.2205.A, of Article XXII of Chapter 14 of the Village Code of
Mount Prospect, Illinois, to allow a reduction in required lot size
for development of the Subject Property to one acre and to further
allow a reduction in required on-site parking spaces from 71 to 32
provided that a landscape plan for the Subject Property be approved
by the Community Development Department of the Village.
SECTION THREE: Except for the variation granted herein,
all other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the SuDject
Property.
SECTION FOUR: This Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided Dy law.
