AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF VILLAGE OF MOUNT PROSPECT, ILLINOIS WITH
RESPECT TO ZONING CERTAIN PROPERTY IN THE
R-1 SINGLE FAMILY RESIDENCE DISTRICT
WHEREAS, McKone Builder's, Inc., of 422 Parkview Court,
Arlington Heights, Illinois has petitioned to rezone certain property
hereinafter.described from the R-X Single Family Residence District
to the R-1.Single Family Residence District in order to allow the
Petiti6ner to build 19 single family homes on said property; and
WHEREAS, the Subject Property is legally described as
follows:
That part of the Northwest 1/~ of Sectlon[ll,
Township 41, North, Range 11, East of the Third
Principal Meridian, bounded and described ah
follows: Beginning at the Southeast corner, of
the Southwest 1/4 of the Northwest 1/4 of said
Section 11, thence West along said South line of
the Southwest 1/4 of the Northwest 1/4 of said
Section 11,353.34 feet to the center line of
Weller Creek as now located; thence Northwesterly
along said center line on a straight line that
forms an angle of 108 degrees 55 minutes 10
seconds with said South line, measured from the
East to the Northwest, a distance of 516.49 feet;
thence continuing Northwesterly in a straight
line that forms an angle of 165 degrees 04
minutes with the last described course measured
from the Southeast to the Northwest, a distance'
of 195.96 feet to the Westerly extention of the
South line of Funks Mount Prospect Gardens, being
a resubdivision of part of Lots J and K in
Kirchoff's Subdivision in the Northwest 1/4 of
Section 11, Township 41, North, Range tl, East of
the Third Principal Meridian; thence East along
said ?[esterly extention and the South line of
said Funk's Mount Prospect Gardens, 542.71 feet
to the East line of the Southwest 1/4 of the
Northwest 1/4 of said Section 11; thence South
along the East line of said Southwest 1/4 of the
Northwest 1/4 of Section 11, 685.35 feet to the
point of beginning, in Cook County, ILlinois.
%~EREAS, a public hearing was held on said rezoning request
(designated as Case No. ZBA-16-Z-85) before the Zoning Board of
Appeals of the Village of ~.~ount Prospect on the 4th day of April,
1985, pursuant to due and proper notice thereof published in the
~.~ount Prospect Herald on the 18th day of [4arch, 1985; and
WHEREAS, the Zoning Board of Appeals has suomitted its
finding and recommendation to the President and Board of Trustees of
the Village of ~.~ount Prospect that the requested rezoning be approved
subject to the Petitioner being restricted from ouiiding any
residence structure over an existing Metropolitan Sanitary District
of Greater Chicago sewer main, and that such restriction be set
forth on the Plat of Subdivision of the Subject Property, and the
President and Board of Trustees have considered further the
inding and recommendation 6f the Zoning Board of Appeals and
Petitioner's request and have determined that the best interest of
Village of Hounn Prospect 'would be obtained by the adoption of~ the
necessary Ordinance to accomplish said rezoning.

NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, CoOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the president and Board of
Trustees of the Village of Mount Prospect.
SECTION T~O: The Z6ning Ordinance (Chapter 14 entitled
"Zoning" of the Vfl%age Code of Mount Prospect, Illinois as amended)
is heyeby further amended to rezone and reclassify from.the R-X Single
Famil~ResideDqe District to the R-1 Single Family Residence District
the Sub'jgct Property as described above..
· SECTION THREE: A Homeowner's Association ~hall be estab-
lished fo~ the -p~rpose of spreading peFpetual detention area main-
tenance costs equally among the property owners of the Gettysburg
Estate,Subdivision and shall be registered in the office of Registrar
of Titles.
SECTION FOUR: This Ordinance shall be inxfull force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
