HomeMy WebLinkAboutOrd 3523 05/21/1985 589S ORDINANCE NO. 3523 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1007 CARDINAL LANE IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS ~HEREAS, Mr. and Mrs. Thomas Kremer and Jean C. Beagley have filed an application for variation with respect to property commonly known as 1007 Cardinal Lane (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 53 in Westgate Gardens Subdivision, being a Subdivision of the Northeast 1/4 of the Southwest 1/4 of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a building addition to a two-flat family residence with a floor area ratio of .41 to be built on the Subject Property rather than be restricted to the floor'area ratio of .35 otherwise required by Section 14.1303 of Article. XIII of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-18-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 25th day of April, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of April, 1985; and WHEREAS, the Zoning Board of Appeals has ~ubmitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. TRUSTEES FOLLOWS: NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1303, of Article XIII of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a building addition to a two-flat family residence on the Subject Property having a floor area ratio of .41 rather than a ratio of .35 otherwise required. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
