AN ORDINANCE AMENDING THE ZONING ORDINANCE OF
THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WITH
RESPECT TO ZONING CERTAIN PROPERTY IN T~tE
B-3 BUSINESS, RETAIL AND SERVICE DISTRICT
WHEREAS, James R. Woodcock of 103 East Olive, Prospect Heights,
Illinois, has Petitioned to rezone certain Property hereinafter
described from the R-1 Single Family Residence District to the B-3
Business, Retail and Service District for the purpose of permitting
the establishment and operation of a florist and garden center, said
property being located at 600 East Rand Road in the Village and
legally described as follows:
The North 209 feet of the South 242 feet except
the North 100 feet thereof measured along the
East line of the South 242 feet of that part of
the Southeast 1/4 of the Northeast 1/4 of Section
34, Township 42 North, Range 11, East of the
Third Principal Meridian, lying Easterly of the
Center Line of Rand Road except the East 75 feet
of the South 77 feet of premises in question
fronting 125.77 feet on the Easterly side of Rand
Road, in Cook County, Illinois,
Together With
The South 33 feet measured along the East line of
that part of the Southeast 1/4 of the Northeast
1/4 of Section 34, Township 42 North, Range 11
East of the Third Principal Meridian, lying
Easterly of the Center'Line of the Center Line of
Rand Road (except the East 75 feet thereof) in
Cook County, Illinois.
WHEREAS, a public hearing was held on said rezoning application
(designated as Case No. ZBA-19-Z-85) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 25th day of April,
1985, pursuant to proper publication of due notice in the Mount
Prospect Herald on the 9th day of April, 1985; and
WHEREAS, the Zoning Board of Appeals has forwarded its finding
anf recommendation to the Board of Trustees of the Village that the
requested rezoning be approved, subject to implementation by the
Petitioner, of a driveway relocation as approved by the Community
Development Department, and the President and Board of Trustees have
considered further the finding and recommendation of the Zoning
Board of Appeals and Petitioner's request, and have determined that
the best interest of the Village of Mount Prospect would be obtained
by the adoption of the necessary ordinance to accomplish said
rezTning.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees of
the Village of Mount Prospect.
SECTION TWO: The Zoning Ordinance (Chapter 14 enfitle~ "Zoning"
of the Village Code of Mount Prospect, Illinois, as amended) is
hereby further amended to rezone and reclassify from the R-1 Single
Family Residence District to the B-3, Business, Retail and Service
District, the following described property:
The North 209 feet of the South 242 feet except
the North 100 feet thereof measured along the
East line of the South 242 feet of that part of
the Southeast 1/4 of the Northeast 1/4 of Section
34, Township 42 North, Range 11, East of the
Third Principal Meridian, lying Easterly of the
Center Line of Rand Road except the East 75 feet
of the South 77 feet of premises in question
fronting 125.77 feet on the Easterly side of Rand
Road, in Cook County, Illinois,

The South 33 feet measured along the East line of
that part of the Southeast 1/4 of the Northeast
1/4 of Section 34, Township 42 North, Range 11
East of the Third Principal Meridian, lying
Easterly of the Center Line of the Center Line of
Rand Road (except the East 75 feet thereof) in
Cook County, Illinois.
SECTION THREE: Said rezoning of the Subject Property shall be
conditioned upon accomplishment of the a driveway relocation to the
West of its present location on the Subject Property in accordance
with a revised site plan as approved by the Community Development
Department, and on the operation and maintenance of the Subject
Property as s florist and garden center.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
