AN ORDINANCE GRANTING A VARIATION
PROPERTY COMMONLY KNOWN AS 316 NORTH
IN THE VILLAGE OF MOUNT PROSPECT,
FOR CERTAIN
PROSPECT MANOR
ILLINOIS
WHEREAS, Mr. and Mrs. Martin Lebda have filed an
application For variation with respect to property commonly known as
316 North Prospect Manor (the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:'
LOT 3 in Block 11 in Prospect Manor, being a
subdiuision of part of the South Three Quarters of the
West Half of the West Half of the Section 34, Township
&2 North, Range 11 East of the Third Principal
Meridian, in Cook County Illinois.
WHEREAS, Petitioner, seeks a uariation From the following
provisions of Chapter 1~ of the Village Code of Mount Prospect,
Illinois, to allow the construction of a new two (2) car garage upon
the site where the original garage was located, which site
encroaches three (3) Feet.within the fiue (5') foot side yard area
required by Section 14.102.B.2 of Article I of said Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-23-U-85) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 23rd day of May,
1985, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 3rd day of May, 1985; and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of Trustees
of the Village of Mount Prospect to allow the requested variation,
and the President and Board of Trustees of said Village haue given
further consideration to the uariation request and haue determined
that the same satisfies the standards set Forth in Section 1¢.605
Article UI of Chapter 14 of the Village Code, and this Board further
Finds that it would be in the best interest of the Village to grant
the request for variation.
NOW THEREFORE, BE

FOLLOWS:
IT ORDAINED BY THE PRESIDENT
MOUNT PROSPECT, COOK COUNTY,
AND BOAR[) OF
ILLINOIS, AS
SECTION ONE: The recitals set forth here~naboue are
incorporated herein as findings of fact by the President and Board
of Irustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property the
variation requested NSth respect to Section 1~.102.B.2, of ArtScle I
of Chapter 14 of the Village Code of Mount Prospect, Illinois, to
allow the construction of a new two (2) car garage to be located on
the site of an original garage a distance of no closer than two (2')
feet From the North lot line of the Subject Property.
SECTION THREE: Except for the variation granted herein,
all other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in Full Force and effect as to the Subject
Property.
SECTION FOUR: This Ordinance shall be
effect from and after its passage, approua] and
pamphlet form in the manner proeldWd by
force and
publication in
