Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 19thday of June 1985 668V/4 ORDINANCE NO. 3541 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COI~MONLY KNOWN AS 1622 GREENWOOD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. and Mrs. William L. Maloney have filed an application for variation with respect to property commonly known as 1622 Greenwood (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: LOT 916 in Brickman Manor First Addition - Unit 8, being a s~bdivision in the East Half of the Quarter of Section 26 Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect. Illinois, to allow the continuation of an ex~sting circular drive-way in variance from the provisions of Section 14.116.A Title I of said Chapter 14, and to allow the construction of an in-ground swimming pool and pool deck to within six (6') feet from the rear property line and 1.6 feet from the side property line in variation to the ten (10') and fifteen (15') feet side and rear yard set-back requirements of Section 14.1102.B and C of Article XI of said Chapter 14 and in variance of similar location requirements set forth in that portion of Chapter 21 of the Village Code pertaining to private swimming pools; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-25-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 23rd day of May, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 3rd day of May, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, TRUSTEES OF THE VILLAGE FOLLOWS: BE IT ORDAINED BY THE PRESIDENT AND BOARD OF OF MOUNT PROSPECT, COOK COUNTY. ILLINOIS, AS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of ~ount Prospect hereby grant to the Subject Property the variation requested with respect to Sec'tions 14.116.A and 14.1102.B and C, of Articles I and XI of Chapter. 14 of the Village Code of Mount Prospect, Illinois, to allow the continuation of an existing circular drive-way and the location of the subject swimming pool and deck to a distance of not closer than four feet to the side lot line and not closer than six (6') feet to the rear lot line of the Subject Property, and to further vary the similar provisions of Chapter 21 of the Village Code pertaining to the location of private swimming pools; and SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effec%~as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form 'in the manner provided by law.
