AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 698 EAST NORTHWEST HIGHWAY
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Richard D. Jacklow has filed an application for
variation with respect to p~ope~ty commonly known as 698 East
Northwest Highway, Mount Prospect, Illinois (the "Subject
P~ope~ty"); and
WHEREAS, the Subject Property is described as follows:
Lot 10 and 11 in Block 21 in the Resubdivision of Lot
7 in Block 21, Lots 12-19 both inclusive in Block 22;
Lots 12 and 13 in Block 23 in Busse's. Easte[n Addition
to Mount P~ospect in the East half of Section 12,
Township 41 No~th, Range 11 East of th~ Thi[d
P[incipal Meridian in Cook County, Illinois.
WHEREAS, Petitione:, seeks a variation from the provisions
of Chaptez 14 of the Village Code of Mount Pzospect, Illinois, to
allow an at~ium/g~eenhouse of app~oximate!y fifty (50') square feet
in a~ea, to be extended on to the south side of the proposed
building on the Subject P~operty as an amendment to p~evious special
use and variations given to the Petitione~ in ZBA 51-SU-84 and ZBA
52-V-84 approving Petitioner's site plan and authorizing the use of
the Subject P~operty as an automotive service business; and
w~IEREAS, a public hea~ing was held on the variation request
(designated as Case No. ZBA-28-V-85) before the Zoning Board of
Appeals of the Village of Mount P~ospect on the 6th day of June,
1985, pursuant to due and pIope~ notice thereof published in the
Mount Prospect Herald on the 20th day of May, 1985; and
WHEREAS, the Zoning Boa[d of Appeals has submitted its
findings and recommendation to the President and Board of T~ustees
of the Village of Mount Prospect to allow the requested variation,
and the P~esident and Board cf T[ustees of said Village have given
further consideration to the variation request and have determined
that the same satisfies the standards set forth in Section 14.605
A~ticle VI of Chapte[ 14 of the Village Code, and this Board further
finds that it would be in the best interest of the Village to grant
the ~equest fox variation.
NOW THEREFORE,
TRUSTEES OF THE VILLAGE
FOLLOWS:
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the P~esident and Board
of T~ustees of the Village of Mount Prospect.
SECTION TWO: The P~esident and BoaId of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property the
variation ~equested to allow the requested building extension for
construction of an at~ium/g[eenhouse containing approximately fifty
(50) square feet in area, and to approve the Petitioner's amended
site plan {a copy of which is attached hereto and made a part of
this Ordinance by reference) showing the location of the building on
the Subject P~operty with the attached atrium/g~eenhouse st=uctu~e.
SECTION THREE: Except for the variation granted herein,
all other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
SECTION FOUR: This Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
