AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1120 SOUTH TAMARACK DRIVE
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Mr. and Mrs. Frederic A.
application for variation with respect to

the Subject Pzoperty is described as follows:
Lot 539 in E%k Ridge villa Unit No. 7, being
a subdivSsion of part of Uot 5, in the :
Division of the Louis F. Busse Farm, being a
Subdivision of part of the Northeast quarter
of Section 15, Township 41 North, Range 11,
East of the Third Principal Meridian, in
Cook County, Illinois.
WHEREAS, Petitioner, seeks a variation from the following
provisions of Chapter 21 of the Village Code of Mount Prospect,
Illinois, and of Chapter 14 of said Code to allow the maintenance of
an above ground swimming pool and deck to be located even with the
rear lot line and within eight feet (8') of the lot line on th~
South side of the Subject Property, in variance to Sections 21.1002A
requiring a fifteen foot (15') rear yard setback and a ten foot
(10') side yard setback in Chapter 21 of said ~illage Code, and from
the similar setback requirements contained in Section 14.1202B and C
of Chapter 14 of said Village Code: and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-32-V-85) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 27th day of June,
1985, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the llth day of June, 1985; and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of Trustees
of the Village Of Mount Prospect to allow the requested variation.
and the President and Board of Trustees of said Village have given
further consideration to the variation request and have determined
that the same satisfies the standards set forth in Section 14.605 of
Article VI of Chapter 14 of the Village Code. and this Board further
finds that it would be in the best interest of the Village to grant
the request for variation.
NOW THEREFORE,
TRUSTEES OF THE VILLAGE
FOLLOWS:
BE IT ORDAINED BY THE PRESIDENT ~D BOARD OF
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property the
variation requestqd with respect to Sections 21.1002A of .Chapter 21
and 14.1202B and C of Chapter 14 of the Village Code of Mount
rospect, Illinois, to allow the continued maintenance of a swimming
pool and deck to be located up to the rear lot line and to within
eight feet (8') of the side lot line on the South side of the
Subject Property.
SECTION THREE: Except for the variation granted herein,
all other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
SECTION FOUR: This Ordinance Shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
