7-85
A RESOLUTION AUTHORIZING EXECUTION OF AN
AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT
AN THE CITY OF DES PLAINES RELATIVE TO AN
EMERGENCY WATER SYSTEM INTERCONNECTIO~
WHEREAS, the Village of Mount Prospect and the City of
Des Plaines have determined that it is in their mutual
interest to design, bid, construct, and operate a permanent
emergency service water interconnection; and
WHEREAS, such an emergency interconnection would allow
both communities to provide added protection to their fire
suppression activities, strengthen their water reserve
capabilities and assure their residents of a continued
supply of potable water; and
WHEREAS, the Village of Mount Prospect and the City of
Des Plaines have authority under the 1970 State of Illinois
Constitution as Horne Rule Communities to provide such
interconnections; and
NOW, THEREFORE, BE IT RESOLVED BY THE ~~YOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: That the respective staff and departments of
the Village of Mount Prospect and the City of Des Plaines,
be and are hereby authorized to enter into a contractual
agreement, as per Exhibit nAn attached hereto, and to
proceed with the design, budding, construction and operation
of an emergency water system interconnection to be located
approximately at the intersection of Central Road and
Jon Lane, in Des Plaines, and at Stevenson Lane in
Mount Prospect, at an estimated cost of $57,000; final
cost estimates to be established pursuant to receiving
and approving actual bids.
SECTION TWO: That the Village of Mount Prospect shall bear
70% of the cost for said project and the City of Des Plaines
shall bear 30% of said costs not to exceed $20,000.
SECTION THREE: That this Resolution shall be in full force
and effect from and after its passage and approval in the
manner provided by law.

AGREEMENT
, This agreement, made this day of , 1985, by and between
the Village of Mount Prospect, hereinafter called the "Village," and the City of
Des Plaines, by its Mayor, John E. Seitz, hereto fully authorized to act by virtue
of a Resolution passed by the City Council of the City of Des Plaines, on the
4th day of February, 1985, hereinafter called the "City," witnesseth:
1. Mütual Interests. The Çity and Village have detennined that it is in their
best mutual interests to design, construct, bid and operate a permanent emergency
service water interconnection to benefit both communities.
2. Design. The Department of Public Works of the Village shall design the water
interconnection to benefit flows to l::oth conmunities at no expense to the City anà
in accordance with standqrd engineering practice:
-Specify location within existing R.O.W.
~imum flows allowable - 2,000 gprn.
-Specify meter type
-Both staffs to approve design
3. BiddÍ1E. The Department of Public Works of the Village shall advertise and bid
the construction and materials according to applicable State and local Statutes.
Bid award shall be made by the Village, upon a joint recorrmendation of the Village
EngLt'leer and the City Engineer, to lowest responsible bidder meeting the agreed
specifications.
4. Construction. E:r1gineers from l::oth COmtIimities shall have the right to inspect
all phases of construction and test materials supplied. The Village shall act as
contract administrator.
5 . Payrænt. Up:m the acceptance of the work by l::oth comnuni ties and subni ttal of
the final invoice by the contractor, the Village shall submit a final invoice to
the City ColTptroller for the City's proportionate share and the City shall pay said
arrount within 30 days to the Village.
6. ProPJrtionate Share. The Village shall bear 70% of the improvement costs and
the City shall bear 30% of said costs not to exceed $20,000. Inspection costs
incurred by the respective carnmuni ties shall be l::orne by that corrmuni ty . Design
and contract administration costs will be l::orne by the Village. Both cornmmities
shall waive any connection or permit fees' associated with this project.
7. Liability. The contractor, will be required to provide standard and custarrary
liability and Workers' CoIn¡?ensation Insurance. Both communities will undertake
their awn defenses at their own expense sh:mld any litigation arise from this
matter.
