AN ORDINANCE TO AMEND CHAPTER 12 ENTITLED
"FOOD CODE" OF THE
VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: Chapter 12 entitled "Food Code" of the
Village Code of Mount Prospect, Illinois (1981) as amended, is
hereby further amended as follows:
A. By amending Section 12.301 entitled "Definitions" and
12.303 entitled "License Fees" of Article III of said Chapter 12 to
read:
Section 12.301. Definitions~ FOr the purposes of this
Article the following words shall have the following
definitions:
Director: The Director of the Bureau of Code
Enforcement of the Village of Mount Prospect.
Establishment. Any location or premises at which the
business of food processing, food service, retail food
sales, or the sale of milk or cream is conducted.
Section 12.302 License Fees.
Food processing establishments, food service
establishments, retail food stores, and dealers
of milk or cream shall be designated as Class II
establishments and shall pay the annual fees as
set forth in Article XXXIV of Chapter 11 of this
Code.
Any establishment licensed under this Article
otherwise receiving health inspections from the
United States Food and Drug Administration, shall
be designated as a Class I business and shall pay
the annual fees as set forth in Article XXXIV of
Chapter 11 of this Code.
Any person selling food and/or beverages from a
vehicle shall be designated as a food service
vehicle and shall pay the annual fee as set forth
in Article XXXIV of Chapter 11 of this Code."
B. By amending Section 12.309 entitled "Emergency
Supervision" of Article III of said Chapter 12 to change the words
"Director of Health Services" in subsection A thereof to read
"Director of Code Enforcement" and by amending Section 12.312
entitled "Termination of Suspension" of Article III of said Chapter
12 to change the words "Director of Health Services" in subsection C
thereof to read "Director of Code Enforcement."
C. By amending Section 12.401 entitled "Fines" of Article
IV of said Chapter 12 to read:
"Section 12.401 Fines. Any person, firm or corporation
convicted of a violation of this Chapter shall be punished
by a fine of not less than Twenty-five Dollars ($25.00) nor
more than Five Hundred Dollars ($500.00) for each offense.
A separate offense shall be deemed to have been committed
for each day a violation occurs or continues."
SECTION TWO: This Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
