AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 219 SOUTH ELMHURST
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS,
filed an

Timothy J. Murphy and Kathleen Meersmen-Murphy have
application for variation with respect to property
known as 219 South Elmhurst in the Village of Mount
Illinois (the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 97 in H. Roy Berry Co.'s Colonial Manor,
being a Subdivision of part of the Northeast 1/4
of Section 11 and part of the Northwest 1/4 of
Section 12, all in Township 41 North, Range 11,
East of the Third Principal Meridian in Cook
County, Illinois.
WHEREAS, Petitioners seek a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a single family detached
dwelling to be built on the Subject Property having a floor area
ratio of .38, within a zoning district otherwise requiring floor
area ratio of .35 pursuant to Section 14.1103 of Article XI,
Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-5-V-86) before the Zoning Board
Appeals of the Village of Mount Prospect on the 27th day of
February, 1986, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the lOth day of
February, 1986; and
of
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and
the President and Board of Trustees of the Village have given
further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.605 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best
interest of the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President
Board of Trustees of the Village of Mount Prospect.

SECTION TWO: The President and Board of Trustees of the
Village o'f 'Mount Prospect hereby grant to the Subject Property
the variations requested with respect to Section 14.1103 of
Article XI of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a single family detached
dwelling with a floor area ration of .38.
SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
