Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 7th day of May , 1986 280V ORDINANCE NO. 3640 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 606 SOUTH BUSSE ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. and Mrs. Chris Hilgeman have filed an application for variation with respect to property commonly known as the 606 South Busse Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 18, of Hatlen Heights Estates, Unit No. 1, a Subdivision of part of Lots 3, 4, 5 and 6 taken as a tract in Owner's Division, being a Subdivision of the Southeast Quarter (except the West half of the Southwest Quarter thereof) of Section 10, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the provisions of Section 14.102.B of Article I and 14.1001.B.3 of Article X of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a carport within the front yard area of single family residence premises whereon there is presently located a residence structure and a garage; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-73-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 19th day of December, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 2nd day of December, 1985; and WHEREAS, the Zoning Board of Appeals has determined to allow the subject carport to be located within the required front yard area and has further submitted its finding and recommendation to the President and Board of Trustees of the Village of Mount Prospect, in favor of granting the subject variations to allow said carport to be erected on property wherein there is also an existing garage, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of' the Village to grant the request for variation, provided the subject carport construction complies with Village building requirements, including requirements pertaining to adequate foundation and structural supports. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B of Article I nd Section 14.1001.B.3 of Article X of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a carport on single family residence property containing a separate garage, provided further, that said carport shall be constructed in full compliance with Village building requirements, including requirements pertaining to foundation and structural supports. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
