AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WITH RESPECT TO ZONING CERTAIN PROPERTY IN
THER-3 APARTMENT RESIDENCE DISTRICT
WHEREAS, Courtyard Development Corporation of 3233 N. Arlington
Heights Road, Arlington Heights, Illinois (the "Petitioner") has
petitioned to rezone certain property hereinafter described from the
R-X Single Family Residence District to the R-3 Apartment Residence
District in order to allow Petitioner to build a 32 unit multiple
family residential development pursuant to special use-Planned Unit
Development procedures; and
WHEREAS, the Subject Property is legally described as follows:
That part of the North Half of the Northwest
Quarter of the Southeast Quarter of Section 14,
Township 41 North, Range 11 East of the Third
Principal Meridian lying Southerly and Easterly
of Linneman Road and Northerly and Westerly of
the following described line: Beginning at the
interesection of the North line of "Kenroy's
Huntington Subdivision", being a subdivision in
the East half of said Section 14~ recorded on
October 28, 1970 as Document 21302332 with the
Easterly line of Linneman Road as heretofore
dedicated, said point also being on the South
line of the North Half of the Northwest Quarter
of the Southeast Quarter of said Section 14;
thence Easterly along said North line of Kenroy's
Huntington Subdivision also being the South line
of said North Half of the Northwest Quarter of
the Southeast Quarter of Section 14 a distance of
723.16 feet; thence Northerly at an angle of 90
degrees 00 minutes 00 seconds to the left of the
prolongation of the last described line for a
distance of 107.12 feet; thence Northwesterly at
an angle of 23 degrees 00 minutes 00 seconds to
the left of the prolongation of the last
described line to the Southerly line of Linneman
Road as heretofore dedicated, said point being
the termination of said line all in Cook County,
Illinois.
WHEREAS, a public hearing was held on said rezoning request
(designated as Case No. ZBA-7-Z-86) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 13th day of March,
1986, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 25th day of February, 1986; and
WHEREAS, the Zoning Board of Appeals has submitted its finding
and recommendation to the President and Board of Trustees of the
Village of Mount Prospect that the requested rezoning be denied; and
WHEREAS, the President and Board of Trustees have considered
further the finding and recommendation of the Zoning Board of
Appeals and Petitioner's request and have determined that the best
interest of the Village of Mount Prospect would be obtained by the
adoption of the necessary Ordinance to accomplish said rezoning upon
certain conditions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
FOLLOWS:
AS
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The Zoning Ordinance (Chapter 14 entitled "Zoning"
of the Village Code of Mount Prospect, Illinois, as amended) is
hereby further amended to rezone and reclassify from the R-X Single
Family Residence District to the R-3 Apartment Residence District
the Subject Property as described above.
SECTION THREE: Said rezoning shall be conditioned upon
development of the Subject Property in accordance with special use-
Planned Unit Development procedures and in accordance with Site
Plans and exhibits as submitted by the Petitioner.
SECTION FOUR: Said rezoning of the Subject Property shall be
conditioned upon compliance with those conditions enumerated above.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
