AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY
KNOWN AS THE SOUTHEAST CORNER OF LINNEMAN AND CHURCH
ROADS IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS .....
WHEREAS, Courtyard Development Corporation, of 3233 N. Arlington
Heights Road, Arlington Heights, Illinois (the "Petitioner"), has
filed a petition for a special use-Planned Unit Development in the
R-3 Apartment Residence District with respect to property commonly
known as the southeast corner of Linneman and Church Roads, in the
Village of Mount Prospect, Illinois; and
WHEREAS, Petitioner is the contract purchaser of the Subject
Property which is legally described as follows:
That part of the North Half of the Northwest Quarter
of the Southeast Quarter of Section 14, Township 41
North, Range 11 East of the Third Principal Meridian
lying Southerly and Easterly of Linneman Road and
Northerly and Westerly of the following described
line: Beginning at the interesection of the North
line of "Kenroy's Huntington Subdivision", being a
subdivision in the East half of said Section 14,
recorded on October 28, 1970 as Document 21302332 with
the Easterly line of Linneman Road as heretofore
dedicated, said point also being on the South line of
the North Half of the Northwest Quarter of the
Southeast Quarter of said Section 14; thence Easterly
along said North line of Kenroy's Huntington
Subdivision also being the South line of said North
Half of the Northwest Quarter of the Southeast Quarter
of Section 14 a distance of 723.16 feet; thence
Northerly at an angle of 90 degrees 00 minutes 00
seconds to the left of the prolongation of the last
described line for a distance of 107.12 feet; thence
Northwesterly at an angle of 23 degrees 00 minutes 00
seconds to the left of the prolongation of the last
described line to the Southerly line of Linneman Road
as heretofore dedicated, said point being the
termination of said line all in Cook County, Illinois.
WHEREAS, Petitioner seeks a special use for a Planned Unit
Development to allow development of the Subject Property with a 32
unit multiple family residential development in accordance with
Section 14.704 of Article VII of Chapter 14 of the Village Code of
Mount Prospect, Illinois and in accordance with the Site Plan and
exhibits submitted by Petitioner; and
WHEREAS, a public hearing was held on the proposed special use
request (designated as Case No. ZBA-8-SU-86) before the Zoning Board
of Appeals of the Village of Mount Prospect on the 13th day of
March, 1986, pursuant to due and proper notice thereof published in
the Mount Prospect Herald on the 25th day of February, 1986; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation in opposition of the proposed special use to the
President and Board of Trustees of the Village of Mount Prospect,
and the President and Board of Trustees have given further
consideration to said requests and have determined that the same
meets the standards set forth in Section 14.704 of Article VII
pertaining to special uses of said Chapter 14 of the Village Code
nd have further determined that the granting of the proposed
special use would be in the best interest of the public, provided
the same are accomplished pursuant to the conditions hereinafter set
forth.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees of
the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a special
use-Planned Unit Development; said special use to be in accordance
with the conditions hereinafter provided.
SECTION THREE: The subject special use shall be granted upon
the following conditions:

The development of the Subject Property shall be in
substantial conformity with the Site Plan and exhibits
submitted by Petitioner and shall be subject to the
approval of a Landscape Plan, Roadway and Utility Plan and
a Grading Plan by the Planning and Zoning Department.
Be
Compliance by the Petitioner with all requirements of the
Development Code and payment of all fees and furnishing of
all guarantees required for construction.
SECTION FOUR: With the exception of the special use granted
herein, the Subject Property shall comply with all other applicable
Village of Mount Prospect Ordinances and Regulations pertaining
thereto.
SECTION FI¥-E: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
