AN ORDINANCE GRANTING A SPECIAL USE FOR THE PROPERTY
COMMONLY KNOWN AS PICADILLY CIRCLE, CENTER PARCEL IN
THE VILLAGE OF MOUNT pROSPECT, ILLINOIS
WHEREAS, Frediani Developers, Inc. of Mount Prospect, Illinois
(the "Petitioner"), has filed a petition for a special use-Planned
Unit Development in the R-3 Apartment Residence District with
respect to property commonly known as Picadilly Circle, Center
Parcel, in the Village of Mount Prospect, Illinois; and
WHEREAS, Petitioner is the owner of the Subject Property which
is legally described as follows:

WHEREAS, Petitioner seeks a special use for a Planned Unit
Development to allow development of the Subject Property with a 38
unit two-story townhome residential development in accordance with
Section 14.704 of Article VII of Chapter 14 of the Village Code'of
Mount Prospect, Illinois and in accordance with the Site Plan,
Landscaping Plan, Architectural Elevations, Floor Plans and other
exhibits submitted by Petitioner; and
WHEREAS, a public hearing was held on the proposed special use
request (designated as Case No. ZBA-16-SU-86) before the Zoning Board
of Appeals of Mount Prospect on the 17th day of April, 1986, pursuant
to due and proper notice thereof published in the Mount Prospect
Herald on the 31st day of March, 1986; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations in favor of the proposed special use to the
President and Board of Trustees of the Village of Mount Prospect,
and the President and Board of Trustees have considered said requests
and have determined that the same meet the standards set forth in
Section 14.704 of Article VII pertaining to special uses of said
Chapter 14 of the Village Code and have further determined that the
granting of the proposed special use would be in the best interest
of the public, provided the same are accomplished pursuant to the
conditions hereinafter set forth.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
FOLLOWS:

SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees of
the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a special
use-Planned Unit Development; said special use to be in accordance
with the conditions hereinafter provided.
SECTION THREE: The subject special use shall be granted upon
the following conditions:

The development of the Subject Property shall be in sub-
stantial conformity with the Site Plan, Landscape Plan,
Architectural Elevations, Floor Plans and other exhibits
submitted by Petitioner and shall be subject to a minimum
dwelling unit size of 1550 square feet per unit and to the
provision by the Petitioner during the course~of construc-
tion of three fully improved parking spaces on Picadilly
Lane adjacent to the pool.

Compliance by the Petitioner with all requirements of the
Development Code and payment of all fees and furnishing of
all guarantees required for construction.

Modification of the 1972 amended Consent Decree governing
the Subject Property to permit the development of the
Subject Property in conformity with the terms of the
special use hereby granted.
SECTION FOUR: with the exception of the special use granted
herein, the Subject Property shall comply with all other applicable
Village of Mount Prospect Ordinances and Regulations pertaining
thereto.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
