AN ORDINANCE GRANTING VARIATIONS FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 308 BOBBY LANE IN
THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Peter and Susan Teresi have filed an application for
variation with respect to property commonly known as 308 Bobby Lane
in the Village of Mount Prospect, Illinois (the "Subject Property");
and
WHEREAS, the Subject Property is described as follows:
Lot 12 in Gettysburg Estates, being a subdivision
of party of the Southwest 1/4 of the Northwest 1/4
of Section 11, Township 41 North, Range 11, East
of the Third Principal Meridian, in Cook County,
Illinois
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a three car garage instead of
the two car garage permitted pursuant to Section 14.1101B.3 of
Article XI and being 690 square feet in size instead of the 600
square feet permitted pursuant to Section 14.102B.4 of Article I be
built on the Subject Property with a circular driveway pursuant to
Section 14.116.A of Article I and to be constructed to a width of 30
feet in lieu of the 18 feet in width as provided by Section 14.116.C
of Article I, Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA~14-V-86) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 24th day of April,
1986, pursuant to due and proper notice thereof published in the
Mount Prospect Herald, on the 31st day of March, 1986; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variations, and the
President and Board of Trustees of the Village have given further
consideration to the variation requests and have determined that the
same satisfy the standards set forth in Section 14.605 of Article VI
of Chapter 14 of the Village Code, and this Board further finds that
it would be in the best interest of the Village to Grant the request
for variations.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the variations
requested with respect to allowing the construction on the Subject
Property of a three car garage instead of the two car garage per-
mitted pursuant to Section 14.1101B.3 of Article XI and being 690
square feet in size instead of the 600 square feet permitted pursuant
to Section 14.102B.4 of Article I in addition to the construction of
a circular driveway pursuant to Section 14.116.A of Article I to be
constructed to a width of 30 feet in lieu of the 18 feet in width as
provided by Section 14.116.C of Article I, Chapter 14 with the south
driveway tapered to a width of 18 feet at the front property line
and with the north driveway tapered to a width of 12 feet at the
front property line and with the further conditions that said
driveways are not to be located within four (4) feet from either
side property line and that no sheds or other accessory buildings
are to be permitted on the Subject Property.
SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
regulations shall remain in full force and effect as to the Subject
Property.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, aPproval and publication in pamphlet
form in the manner provided by law.
