AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 2105 PRENDERGAST LANE
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Mr. and Mrs. Frank Panzarino have filed an
application for variation with respect to property commonly known as
2105 Prendergast Lane in the Village of Mount Prospect, Illinois
(the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 33 in St. Cecelia Subdivision, being a
Resubdivision of Lot 2 and parts of Lots 3
and 6 in Meier Brothers Subdivision, being a
Subdivision of parts of Sections 10 and 15,
Township 41 North, Range 11 East of the
Third Principal Meridian, in Cook County,
Illinois.
WHEREAS, Petitioner, seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a single family residence to
be built on the Subject Property having a floor area ratio of .39
with a driveway to be constructed to a width of 23 feet within a
zoning district otherwise requiring a floor area ratio of .35
pursuant to Section 14.1103 of Article XI and a driveway limited to
18 feet in width as provided by Section 14.116.C of Article I,
Chapter 14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-67-V-85) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 24th day of October,
1985, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 8th day of October, 1985; and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of Trustees
of the Village of Mount Prospect to allow the requested variation,
and the President and Board of Trustees of the Village have given
furt~' Consideration to the variation reqUest and have determined
that the same satisfies the standards set forth in Section 14.605 of
Article VI of Chapter 14 of the Village Code, and this Board further
finds that it would be in the best interest of the Village to grant
the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 14.1103 of Article XI,
and Sectin 14.116.C of Article I of Chapter 14 of the Village Code
of Mount Prospect, Illinois, to allow the construction of a single
family residence having a floor area ratio of .39 and to allow a
driveway to be installed on the Subject Property having a width of
23 feet tapered to a width of 18 feet at the front property line.
SECTION THREE: Except for the variation granted herein,
all other applicable village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
SECTION FOUR: This Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
