AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY ~NOWN AS 1660 KENNETH DRIVE
IN THE VILLAGE OF MOUNT PROSPECTr ILLINOIS
WHEREAS, Romi Building Company has filed an application for
variation with respect to property commonly known as 1660 Kenneth
Drive in the Village of Mount Prospect, Illinois (the ~Subject
Property')~ and
WHEREAS, the Subject Property is described as follows=
The East 90 feet of the West 662.08 feet of the
North 10 acres of the South 15 acres of the West
half of the Northwest quarter of Section 23,
Township 41 North, Range 11 East of the Third
Principal Meridian (except that part thereof as
dedicated for Kenneth Drive as per Document No.
20950179 recorded September 9, 1969 in Cook
County, Illinois~ and the North 10 acres of the
South 15 acres of the West half of the Northwest
quarter of Section 23, Township 41 North, Range
11 East of the Third Principal Meridian (except
that part dedicated for Kenneth Drive and also
except the West 66'2.08 thereof) in Cook County,
Illinois} and Lot 2 in Laiche's Subdivision of
the North 10 acres of the South 15 acres of the
West half of the Northwest quarter of Section 23,
Township 41 North, Range 11, East of the Third
Principal Meridian (except that part dedicated
for Kenneth Drive and also except the West 662.08
feet thereof) in Cook County, Illinois.
WHEREAS, Petitioner, seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the completion of construction and maintenance of
an Industrial building previously erected pursuant to Cook County
regulations prior to annexation of the Subject Property to the
Village of Mount Prospectl said variations to reduce the number of
parking spaces from 270 as required by Section 14.2205.A of Article
XXII of said Chapter 14 to 60 parking spacesl to reduce the 30 foot
side yard and 5 foot parking aisle requirements of Section 14.2202.B
to a 15 foot side yard and a 0 foot setback for the parking aisle~
to reduce the 5 foot requirement for rear yard parking in Section
14.2205.F to allow a 0 foot rear yard for parking and to allow a
portion of the required front yard to be used for truck loading in
variation of the prohibition of Section 14.2202.AI all of said
Sections in Article XXII Chapter 14 of the Village Code of Mount
Prospect, Illinois~ and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-58-V-85) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 10th day of October,
1985, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 23rd day of September, 1985~ and
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of Trustees
of the Village of Mount Prospect to allow the requested variation
together with a companion recommendation regarding the rezoning of
the Subject Property, subject to compliance with the following
conditions:
hat two full access driveways shall always be
maintained on the Subject Property, and if access
presently utilized by a private drive to the rear of
the Property is subsequently removed, a second access
drive will be instructed and installed on the Subject
Property.
Barriers shall be installed at all exit doors of the
parking lot to preclude parking in front of these fire
exits.
The temporary, gravel driveway on the Bast side of the
Building on the Subject Property shall have a fire
lane area designated thereon as approved by the Mount
Prospect Fire Department.
Improvements upon the Subject Property shall be in
accordance with the Site Plan (a copy of which is
attached hereto and made a part of this Ordinance by
reference).
A Landscape Plan, approved by the Department of
Planning and Zoning, must be implemented, on the
Subject Property.
WHEREAS, the President and Board of Trustees of the Village
have given further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.605 of Article VI of Chapter 14 of the Village Code, and
this Board further finds that it would be 'in the best interest of
the Village to grant the request for variation, upon compliance with
the aforementioned conditions.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Sections 14.2205.A, 14.2202.B,
14.2205.F and 14.2202.A to allow a reduction in required parking
spaces, yard setbacks and parking areas to permit 60 parking spaces,
a 15 foot sideyard and zero foot setback for a parking aisle, a zero
foot rear yard parking, and to allow a portion of the required front
yard to be used for truckloading purposes, subject to compliance
with the above enumerated conditions submitted by the Zoning Board
of Appeals of this Village.
SECTION THREE= Except for the variation granted herein,
all other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
SECTION FOUR: This Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
