AN ORDINANCE AMENDING THE ZONING ORDINANCE OF
THE VILLAGE OF MOUNT PROSPECT, ILLINOI~ WITH
RESPECT TO ZONING CERTAIN PROPERTY IN THE
B-3 BUSINESSr RETAIL AND SERVICE DISTRICT
WHEREAS, Northwest Partners Of 1190 South Elmhurst Road,
Mount Prospect, Illinois has petitioned to rezone certain property
hereinafter described from the B-1 Shopping Center District to the
B-3 Business, Retail and Service District in order to allow the
Petitioner to build a one-story building of 90,000 square feet for
use for professional or business offices on said property~ and
WHEREAS, the Subject Property is legally described as
follows:
North 760.96 feet as measured along the West
and East lines of the East 20 acres of the
Northeast quarter of the Southeast quarter
of Section 23, Township 41 North, Range 11
East of the Third Principal Meridian (except
the North 300 feet of the East 450 feet
thereof) also (except the East 50 feet of
the South 500.96 feet of said North 760.96
feet thereof used for Elmhurst Road) also
excepting that portion of Algonquin Road
used for public purposes, all in Cook
County, Illinois.
WHEREAS, a public hearing was held on said rezoning request
(designated as Case No. ZBA-65-Z-85) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 24th day of October,
1985, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 8th day of October, 1985~ and
WHEREAS, the Zoning Board of Appeals has submitted its
finding and recommendation to the President and Board of Trustees of
the Village of Mount Prospect that the requested rezoning be approved
subject to the provision that the Petitioners shall develop the
Property substantially in the same manner as presented in the Site
Plan~ that adequate landscaping approved by the Department of
Planning and Zoning be provided throughout the Development, that all
other requirements of the Development be met with respect to the
installatio'n of the street lights, sidewalks, sewers and other
public improvements~ and that access areas into the Development on
Elmhurst Road and on Algonquin Road be installed as set forth on the
Site Plan with the exception that the access area on Elmhurst Road
be altered so that only one lane, 15 feet in width, be permitted
for in/bound traffic with two lanes provided for traffic exiting the
Subject Property, and the President and Board of Trustees have
considered further the finding and recommendation of the Zoning
Board of Appeals and have.determined that the best interest of the
Village of Mount Prospect would, be obtained by the adoption of the
necessary Ordinance to accomplish said rezoning.
NOW THEREFORE~ BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE'OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
POLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION T~Ot The Zoning Ordinance (Chapter 14 entitled
'Zoning' of the Village Code of Mount Prospect, Illinois as amended)
is hereby further amended to rezone and reclassify from the B-1
Shopping Center District to the B-3 Business Retail and Service
District the Subject Property as described above.
SECTION THREE: Said rezoning of the Subject Property shall
be conditioned upon the development thereof for professional or
business office use in accordance with the Site Plan (a copy of
which is attached hereto and made a part of this Ordinance by
reference) and in accordance with an approved landscaping plan, and
in compliance with the requirements of the Development Code and with
the reduction in the number of access lanes on Elmhurst Road to one
lane having a width of 15 feet for in-bound traffic with two
additional lanes provided for outbound traffic from the Subject
Property.
SECTION FOUR: This Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
