Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 6th day of November , 1985 3041V ORDINANCE NO. 3573 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 928 GREENFIELD COURT IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. and Mrs. Theodore J. Witham have filed an application for variation with respect to property commonly known as 928 Greenfield Court in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 324 in Brickman Manor, First Addition, Unit No. 3, being a Subdivision of part of the Southwest quarter of Section 26, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the continuing existence of an assessory shed located in the rear yard of the Subject Property to stand at a height of thirteen feet eight inches (13'8") instead of the maximum height of ten feet (10') otherwise allowed by Section 14.102.B.3 of Article I of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-49-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of September, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of September, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, provided adequate landscaping be planted around the shed to screen it from neighboring properties, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B.3, of Article of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the continuing existence of an assessory shed to stand at a height of thirteen feet eight inches (13'8") provided that an cceptable landscaping and planting plan sufficient to screen the shed from neighboring properties has been approved by the Department of Planning and Zoning. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be effect from and after its passage, approval and pamphlet form in the manner provided by law. in full force and publication in PASSED and APPROVED this 5th day of November , 1985.
