HomeMy WebLinkAboutOrd 3566 09/17/19852929V/7 ORDINANCE NO. 3566 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 500 WEST CARBOY ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Floyd W. Redeen has filed an application for variation with respect to property commonly known as 500 West Carboy Road in the Village of Mount ProsPect, Illinois' ("Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 6 in ElmhurstLAigonquin Industrial Park No. 2, in the Southeast quarter of Section 27, Township 41 North, Range 11, East of the Third Principal Meridian 3in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow construction of an Industrial Building on property containing one acre in size rather than four acres in size as provided by Section 14.2203.A of Article XXII and to further allow a reduction in parking spaces to 18 rather ~than 51 spaces as required by Section 14.2205.A of Article XXII of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-43-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of August, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 5th day of August, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation for industrial development on the Subject Property containing only one acre in size, but to deny the requested variation for reduced parking spaces; and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation provided that the reduction in parking spaces be limited to provide that there shall be at least 19 such parking spaces on the Subject Property, and provided further that there shall be no further expansion of the building on the Subject Property or of the use thereof without further compliance with the variation procedures and action by the President and Board of Trustees of this Village. NOW THEREFORE, BE IT ORDAINED BY TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, FOLLOWS: THE PRESIDENT AND BOARD OF COOK COUNTY, ILLINOIS, AS SECTION O~E: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the subject Property the variation requested with respect to Sections 14.2203.A and 14.2205.A of Article XXII of Chapter 14 to allow the development of the Subject Property containing one acre for industrial purposes and to provide that only 19 parking spaces shall be required within the Subject Property, upon condition that no further expansion of the use of the Subject Property or of the Industrial Building thereon shal~ be undertaken without first complying with the variation provisions of Chapter 14 and obtaining approval by the President and Board of Trustees of this Village. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
