Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 19th day of February , 1986 3354V ORDINANCE NO, 3611 AN ORDINANCE GRANTING A VARIATION AND SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS 15 NORTH ELMHURST AVENUE, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. and Mrs. J. Thomas Gillespie of 704 Wesley Avenue, Oak Park, Illinois, have filed a petition for a special use and variation with respect to property commonly known as 15 North Elmhurst Avenue, in the Village of Mount Prospect, Illinois and WHEREAS, Petitioners are contract purchasers of the Subject Property which is legally described as follows: The North 200 feet of the West 237 feet of Block 4 in Ernst BusSe's Addition to Mount Prospect, being a subdivision of the South 543 feet of the East half of the Southwest Quarter of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioners, seek a special use to allow an existing residenc% and commercial building and a proposed new commercial bu'ilding to be located on the same lot in accordance with Section 14.2001.C.3 of Article XX of Chapter 14 of the Village Code of Mount Prospect, Illinois, and a variation to reduce the required 20 foot rear yard provided in Section 14.2002.C of said Article XX, to allow for a rear yard of only 3 feet, in order to accommodate the location for the subject buildings and the required 23 parking spaces; and WHEREAS, a public hearing was held on the proposed special use and variation request (designated as Case No. ZBA-76-SU-85 and 77-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 9th day of January, 1986 and again on January 23, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 24th day of December, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its finding and recommendation in favor of the proposed special use and variation subject to certain conditions to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have given further consideration to said requests and have determined that the same meets the standards set forth in Section 14.605 of Article VI regarding variations and in Section 14.704 of Article VII pertaining to special use of said Chapter 14 of the Village Code and have further determined that the granting of the proposed special use and variation would be in the best interest of the public, provided the same are accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK cOuNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a special use to allow thereon the existence of a residence structure and two commercial structures, and do further grant to the Subject Property a variation to reduce the required rear yard along the East property line of thej Subject Property from 20 feet to 3 feet; said special use and variation to be in accordance with the conditions hereinafter provided. SECTION THREE: The subject special use and variation shall be granted upon the following conditions: The Subject Property and the residence and commercial structures located thereon shall remain in single ownership, with the residence used as the principal home of the office user of one of the commercial structures. The existing greenhouse structure shall be removed from the Subject Property and replaced with a commercial building containing no more than 3,300 square feet in area. There shall be no further increase in the building area with respect to any of the structures located upon the Subject Property. The commerical buildings on the Subject Property shall be used only for business office or professional office purposes; including petitioner's manufacturing representative business. Parking for the structures on the Subject Property shall be contained within the required yards as provided for b~y Village Ordinance, and no part of the commerci~l parking areas shall endroach upon the Northern part of the Subject Property being presently maintained as open yard area for residence purposes. E. There shall be located on the Subject Property 23 parking spaces to accommodate the commerci&l uses. F. The driveway for the Office building shall be a minimum of fifteen (15) feet from the South lot line. The property shall be limited to a wall sign for identification purposes only which shall be approved by the Department of Planning And Zoning. SECTION FOUR: With the exception of the special use and variation granted herein, the Subject Property shall comply with all other applicable village of Mount Prospect Ordinances and Regulations pertaining thereto. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
