COW Minutes 05/22/2012p.oat­w,.. � COMMITTEE OF THE WHOLE MINUTES May 22, 2012 CALL TO ORDER — ROLL CALL The meeting was called to order at 7:10 p.m. in the Village Board Room of the Village Hall, 50 South Emerson Street, by Mayor Irvana Wilks. Trustees present included Paul Hoefert, John Korn, John Matuszak and Steven Polit. Staff present included Village Manager Michael Janonis, Assistant Village Manager David Strahl, Public Works Director Sean Dorsey, Deputy Public Works Director Jason Leib, Village Engineer Jeff Wulbecker and Finance Director David Erb. II. APPROVAL OF COMMITTEE OF THE WHOLE MINUTES FOR FEBRUARY 14, 2012 Motion made by Trustee Polit seconded by Trustee Korn. Minutes were approved. APPROVAL OF COMMITTEE OF THE WHOLE MINUTES FOR MARCH 27, 2012 Motion made by Trustee Polit seconded by Trustee Korn. Minutes were approved. III. CITIZENS TO BE HEARD Barbara Laz, First Vice President for the Mount Prospect Lions Club spoke. She stated that she is the festival chairman for this year and would request that the fees and permits be waived for the Fourth of July Festival that will take place from July 3 through July 8. Motion made by Trustee Matuszak second by Trustee Hoefert to waive the permits and fees for the Fourth of July festival. Trustee John Korn abstained IV. 2011 COMPREHENSIVE STORMWATER STUDY FINAL REPORT Public Works Director Sean Dorsey provided a recap of the previous presentation regarding the record rainfall that occurred in three hours. He stated this event has been classified as a 400 year event based on the probability of a 0.25% chance of occurring on an annual basis. He stated the storm sewers are typically designed for a 10 year storm event throughout the Chicago area. He stated the Village hired consultant Burns McDonnell to assist the Public Works crews in inspections of impacted homes and to formulate recommendations for consideration. He stated staff and the engineering consultant followed up with reviews of 898 homes (7% of the total single - family homes in the community), with 510 on site interviews and 148 phone interviews. 240 homeowners declined to participate in the study. He stated of these homes reviewed there were 399 sanitary backups, 177 instances of basement seepage, 142 sump pump failures, 96 reports of street or yard flooding at the same address, 101 reports of street flooding only and 107 reports of yard flooding only. He said the report recommends approximately $23.9 million in improvements. Of those improvements the public sector related improvements to a 25 year flood level amount to approximate $14.4 million. The report also recommends $9.475 million in private sector improvements. He stated a conservative estimate of $200 million could also be expended toward creating a system to have more capabilities to handle a storm of the size that impacted the community in July 2011. He stated the private sector improvements include overhead sewers which offer better protection than the 25 year level improvements from an economic standpoint. He also stated there are some pending MWRD regulations which could impact the amount of water discharge into the main system. If MWRD wants to reduce the flow per gallon, per person, per day, they need to keep clean water out of the system. Committee of the Whole Page 1 of 4 5/22/12 Finance Director Dave Erb stated there are some funding options available. He stated with a total project cost of $23.9 million, storm related improvements at approximately $17.225 million would be needed for additional funding, possibly through utility billing. He stated there is the possibility to utilize some existing debt, as it is cleared off for past flood improvement projects; however, that capacity does not become meaningful until approximately 2019. He stated there is not currently sufficient capacity in the flood control fund to absorb all of the projected expense. He stated if this increase was added to the property tax it would result in a 4% across - the -board increase. He also stated there are other capital needs that are also pending including street resurfacing, EAB, AMR, and the Randhurst redevelopment agreement. Public Works Director Sean Dorsey stated that he is looking for Village Board support for the public sector improvements along with consideration of how the private sector improvements would be undertaken. He stated that the Village participation and assistance with the private sector improvements would require a source of funding which staff is not in a position to recommend at this time. He also wanted to point out that the private sector improvements would most directly benefit the persons that reported flooding directly. General comments from the Village Board members included the following items: • It was noted that there will be a need for the Village to define its responsibility for the private sector improvements using public tax dollars. • There was also a concern regarding residents who have already put in overhead sewers at their expense in contrast to residents who waited and may get public tax dollars for overhead sewers in the future. • It was also stated there is some concern regarding governmental responsibility for private sector improvements. • It was also noted that if there were any kind of public assistance to be considered the homeowner would be required to provide some type of contribution. Public Works Director Sean Dorsey provided an overview of how the Basin 14 overhead sewer test project funding was handled recently. He stated the project focused on the public sector cost reductions by addressing private sector solutions through cost benefit review of the two options and it was determined that funding assistance for overhead sewers are more cost efficient than extensive sewer work. Resident Kasmir Zysawsk, of 2114 Lawrence Lane spoke. He stated that the problem that he has in his neighborhood is the water coming from Arlington Heights that has flooded his area three different times. Resident James Korsey, of 2110 Lawrence Lane spoke. He also is concerned about the water coming from the Arlington Heights area over a concrete overflow onto their Street. Randy Pagent of Burns and McDonnell spoke. He stated that this area was not included in the study but stated that the Hatlen Heights improvements should assist in addressing this area. Public Works Director Sean Dorsey stated that his staff would review the area in question to determine what is causing the problems. Thomas Barun, of 1440 Blackhawk spoke. He stated that he has overhead sewers and a well graded lot with sump pump discharge that has a collapsed pipe under the street and suggested the Village work with the Park District to keep water off the golf course. Pam Cippiano, of 2112 Lawrence spoke. She stated the flooding that is occurring in her area is due to the housing development that was built in Arlington Heights which promised that the water would not come out of Arlington Heights. He wanted to find out where the Village has flooding assistance before undertaking any expensive improvements himself. Gene Kinal, of 2104 Lawrance spoke. He wanted to make sure the Village was aware of the flooding situation that is being caused by Arlington Heights in his neighborhood. Village Engineer Jeff Wulbecker stated that he was familiar with the area and stated that once the pond fills in the development in question it overflows into the street and he has recently contacted Arlington Heights engineering department to determine if there is a problem with the structure. Al Pasternak, of 1906 Connie Lane spoke. He stated he recalls being assessed a flood assessment fee in approximately 1970 specific to his individual area. He requested that funding assistance be provided through taxpayers to resolve this problem. He also stated that he typically pays approximate $400 annually to clean out a sewer line due to Parkway tree root infestation and he has wanted the Parkway tree removed for years. Public works Director Sean Dorsey stated that the resident appears to have a sewer issue that needs to be repaired which once repaired would eliminate the annual $400 expense. He stated it has been Village policy in the past not to remove healthy parkway trees. Joe Bonomo, of 305 Hatlen spoke. He stated that the light pole at the corner of Michael and Hatlen is not working. He also voiced concerns regarding the Village staff handling removal of an elderly resident during the flooding event and the fact that Village personnel would not pump water out of resident's basements. He requested a public works truck come to the neighborhood to pump out the basements and he wants to know what the Village's plan of action is to help people when this occurs in the future. He stated that he has had sewage in his house twice in the past. He has done what was requested to eliminate water including changing the gutters, put in generators and sump pumps and he has done what he feels is necessary to protect his house and now he feels it is the Village's responsibility to take the next step. He would like to participate in the overhead sewer program if it were offered. Mike Konopka, of 23 N. Maple spoke. He requests that the Village makes sure that the system is maintained and the sewers perform as expected. He is interested in the overhead sewer option. Mike Handler, of 413 N. Wille spoke. He stated he flooded in 2008 and 2011 and has put in overhead sewers which have solved his sewer water issue. However, his sump pumps were overwhelmed during the last event and would request the Village consider small retention areas by removing some houses for the necessary retention areas. Keith Frost, of 1715 Bonita spoke. He would like to request that the Village makes it a priority to ensure that Hatten Heights area improvements are completed sooner than later since they had been delayed previously. Cathy Zelinski, of 620 Fairview spoke. She stated her problems are caused by water flowing into her backyard which is caused by a sewer backup. She has a double lot and has extensive water holding capabilities. She would request the Village take a look at her situation and recommend a solution. Fran Zalewski, of 310 S. Hatlen spoke. She is asking for assistance from the Village since she had over 3 feet of water in her home and does not want to relive that experience. Debbie Caccamo, of 717 N. Elmhurst spoke. She stated she flooded for the first time in 17 years previously and had installed overhead sewers afterward which have eliminated the problem. However, she would request Village reimbursement for the expense of the overhead sewers if public dollars are to be considered for reimbursement for other residents to put in overhead sewers. He stated the Finance Commission would be happy to review the cost options and look at possible funding opportunities in relation to timing of debt. Once this review is complete he would anticipate a presentation before the Village Board for their input. Public Works Director Sean Dorsey stated that the typical design for storm sewers is based on a 10 year flood event and moving to a 25 year flood event based on previous flood improvements has occurred in the past. Consensus the Village Board was to direct the Finance Committee to review revenue options for flood control funding and make a recommendation to the Village Board for consideration. This consideration should include a flood control management fee option if it makes financial sense. V. MANAGER'S REPORT Village Manager Michael Janonis stated the Memorial Day parade will start at 9:35 a.m. VI. ANY OTHER BUSINESS Trustee Polit stated that he wanted to highlight the fact that the State is still reviewing the possibility of removing local revenues to help with the State budget crises and the Village stands to lose approximately $110,000.
