HomeMy WebLinkAboutOrd 3564 09/17/19852929V ORDINANCE NO. 3564 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 611 NORTH WILLE STREET IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. and Mrs. Harry J. Muhlhausen have filed an application for variation with respect to property commonly known as 611 North Wille Street in the Village of Mount Prospect, Illinois (the'~"Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 17 in Block 16 in th~ Randview Highlan'ds Subdivision of the Northwest quarter of the Northwest quarter and the Northeast quarter of the Northwest quarter of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois; WHEREAS, Petitionerl seeks a variation from the following · provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a new detached garage to be located two (2') feet from the side property line rather than the five (5') feet required by Section 14.102.B.2 of Article I of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-39-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of August, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 5th day of August, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of ~.~ount Prospect. SECTION ~O: The President and Board of Trustees of the village of ~4ount Pro'spect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B.2, of Article of Chapter 14 of the Village Code of ~ount Prospect, Illinois, to allow the construction of a new detached garage to fall within two (2') feet of the side property line of the Subject Property. SECTION THREE: Except for the variation granted herein, all other applicable village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
