REVISED GARAGE PLANS
Attached to this memorandum is a second round of revised plans that have been submitted by the above
petitioner. The plans now meet the allowable square footage for the garage (672 square feet) but do not meet the
setback requirements along the south property line (5' required, 2.2' proposed).
The petitioner is proposing to move the north wall in 4' and the west wall in 3' feet. The petitioner is proposing
to maintain the roofline over the 4' section that would be removed on the north side of the addition, thereby
creating an unenclosed covered area in that location. The modified addition would measure 8' x 18' ifapproved
by the Village Board.
Please forward this memorandum to the Village Board for their review and consideration at their meeting on June
18th. Staffwill be present at that meeting to further discuss this matter.

ORDINANCE NO.
AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
LOCATED AT 306 NORTH OWEN STREET
WHEREAS, Lawrence Pezen (hereinafter referred to as "Petitioner") has filed a
petition for Variations with respect to property located at 308 North Owen Street
(hereinafter referred to as the "Subject Property") and legally described as follows:
Lot 7 in Block 3 in Bluett's Subdivision of part of the N. ~ of the SE ¼ of Sec.
34, Township 42 North, Range 11 E. of the Third Principal Meridian,
in Cook County, Illinois
Property Index Number: 03-34-418-017-000
and
WHEREAS, the Petitioner seeks a Variation to construct a 672 square-foot garage,
as allowed by Village Code, with a 2.8 foot encroachment into the five-foot minimum
side yard setback allowed by the Mount Prospect Village Code; and
WHEREAS, a Public Hearing was held on the request for Variations being the subject
of PZ Case No. 11-02 before the Planning and Zoning Commission of the Village of
Mount Prospect on the 25th day of April, 2002, pursuant to proper legal notice having
been published in the Mount Prospect Journal & Topics on the 10n day of April, 2002;
and
WHEREAS, the Planning and Zoning Commission has submitted its findings and
negative recommendation to the President and Board of Trustees, with respect to
PZ Case No. 11-02; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have considered the request herein and the required majority vote have determined
that the same meets the standards of the Village and that the granting of the
proposed Variation would be in the best interest of the Village.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated as findings of
fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TVVO: The President and Board of Trustees of the Village of Mount
Prospect do hereby grant a Variation, as provided in Section 14.203.C.8 of the
Village Code, to allow the construction of a 672 square-foot garage with a 2.2 foot
side yard setback, as shown on the Site Plan, a copy of which is attached hereto and
hereby made a part hereof as Exhibit "A."
SECTION THREE: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner )rovided by law.
