SUBJECT: RESERVATION OF PRIVATE ACTIVITY BOND VOLUME CAP
PURPOSE:
To present for Village Board consideration an ordinance that would reserve the
Village's 2012 private activity bond volume cap.
BACKGROUND:
The Internal Revenue Code allows state and local governments to issue tax -
exempt debt for the benefit of certain qualified private development projects.
These projects include the acquisition or construction of industrial facilities and
apartments for low and moderate - income families. The amount of such private
activity debt issued in 2012 cannot exceed the equivalent of $95.00 per resident.
The Village's private activity bond volume cap is currently $5,145,865 (based on
a population of 54,167 as captured by the U.S. Census Bureau).
DISCUSSION:
According to state statute, any volume cap not reserved or committed by a
municipality by April 30 is automatically transferred to the State of Illinois. If a
community does not have any specific projects that would qualify for the tax
exempt financing, it can cede, or transfer, the volume cap to another community.
It has become common for municipalities to transfer their unused volume cap to
other municipalities in exchange for a fee if a demand exists. This has not been
the case though for several years. When a fee is provided in exchange for the
volume cap, the ultimate beneficiary of the tax - exempt financing is responsible
for payment. The amount of the fee paid depends upon the economy and the
current interest rate environment. The Village has in the past received between
1 -2% for the sale of its volume cap.
The Village has a total of $5,145,865 of private activity bond volume cap it must
reserve by April 30 or it will be transferred to the State of Illinois. The Village

can choose to hold onto the volume cap after it is reserved until a project is
identified. The cap may also be carried over for up to three years depending on
the type of project being considered. There are currently no local projects at this
time placing a request on the Village's volume cap.
RECOMMENDATION:
It is recommended the Village Board adopt the attached ordinance reserving the
Village's private activity bond volume cap for 2012.

AN ORDINANCE RESERVING VOLUME CAP IN CONNECTION WITH
PRIVATE ACTIVITY BOND ISSUES, AND RELATED MATTERS.
WHEREAS, the Village of Mount Prospect, Cook County, Illinois (the "Municipality "), is
a municipality and a home rile unit of government under Section 6 of Article VII of the 1970
Constitution of the State of Illinois; and
WHEREAS, Section 146 of the Internal Revenue Code of 1986, as amended (the "Code"),
provides that the Municipality has volume cap equal to $95.00 per resident of the Municipality in
each calendar year, which volume cap may be reserved and allocated to certain tax - exempt
private activity bonds; and
WHEREAS, the Illinois Private Activity Bond Allocation Act, 30 Illinois Compiled
,Statutes 1998, 345/1 et seq., as supplemented and amended (the "Act "), provides that a home
rile unit of government may transfer its allocation of volume cap to any other home rile unit of
government, the State of Illinois or any agency thereof or any non -home rile unit of government;
and
WHEREAS, it is now deemed necessary and desirable by the Municipality to reserve all of
its volume cap allocation for calendar year 2012 to be applied toward the issuance of private
activity bonds (the `Bonds "), as provided in this Ordinance, or to be transferred, as permitted by
this Ordinance;
NOW, THEREFORE, Be It Ordained by the President and the Board of Trustees of the
Village of Mount Prospect, Cook County, Illinois, as follows:
&('TZox 1. That, pursuant to Section 146 of the Code and the Act, the entire volume
cap of the Municipality for calendar year 2012 is hereby reserved by the Municipality, which
shall issue the Bonds using such volume cap, or shall use or transfer such volume cap, without
any further action required on the part of the Municipality, and the adoption of this Ordinance
shall be deemed to be an allocation of such volume cap to the issuance of the Bonds or such
other bonds; provided, that any such transfer shall be evidenced by a written instrument executed
by the Mayor or any other proper officer or employee of the Municipality.
&('TZox 2. That the Municipality shall maintain a written record of this Ordinance in
its records during the term that the Bonds or any other such bonds to which such volume cap is
allocated remain outstanding.
&( 3. That the President, the Village Clerk and all other proper officers, officials,
agents and employees of the Municipality are hereby authorized, empowered and directed to do
all such acts and things and to execute all such documents and certificates as may be necessary to
further the purposes and intent of this Ordinance.
&('Tiox 4. That the provisions of this Ordinance are hereby declared to be separable,
and if any section, phrase or provision of this Ordinance shall for any reason be declared to be
invalid, such declaration shall not affect the remainder of the sections, phrases and provisions of
this Ordinance.
&('Tiox 5. That all ordinances, resolutions or orders, or parts thereof, in conflict
herewith are, to the extent of such conflict, hereby superseded; and that this Ordinance shall be in
full force and effect upon its adoption and approval.

SUBJECT: ROADSIDE MEMORIAL DISPLAYS
Unfortunately, tragedy too often strikes families, friends and sometimes communities as
a whole when a motorist or pedestrian loses his or her life in a traffic related accident.
Roadside memorials honoring the deceased are a common part of the grieving process.
Additionally, displays of recognition for individuals who succumb to illness (especially
young people) have become more commonplace.
The Village Board discussed this subject at its March 27 Committee of the Whole
meeting and directed staff to draft an appropriate ordinance.
The purpose of this Ordinance is NOT to prohibit such memorials or displays. Rather it
establishes some reasonable and sensitive regulations regarding the location and time
limits on such recognition efforts. Penalties or fines are NOT contemplated as an
outcome of this Ordinance. Allowing the Village the ability to remove such displays after
a reasonable time frame is the bottom line focus of the regulation.
Staff recommends approval of this Ordinance.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 18 OF THE VILLAGE CODE
OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS,
REGARDING ROADSIDE MEMORIALS
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT
PROSPECT, COOK COUNTY, ILLINOIS, PURSUANT TO ITS HOME RULE POWERS:
SECTION 1: A new Section 18.1427, "Roadside Memorials ", shall be inserted in Article XIV,
Miscellaneous Laws, of Chapter 18, Traffic, of the Mount Prospect Village Code, the remaining sections
to be renumbered numerically, to be and read as follows:
Section 18.1427 Roadside Memorials
A. Definition
Commemorated Event — the accident or other event that resulted in the memorial.
Memorial — a memorial shall include objects that are intended to honor individuals, who have
died, or an event in which people have died.
B. Memorials on public rights of way within the Village are subject to the following requirements:
1. Location
a. Memorials shall be located within five hundred feet (500) of the commemorated event.
b. Memorials shall not be placed so as to interfere with the line of sight required for drivers
and pedestrians to safely navigate the right of way, as described in Section 9.308 of the
Village Code.
c. Memorials shall not be installed in a median of any public roadway.
d. Memorials shall not be located in, encroach upon, or be located in such a manner as to
constitute a hazard to the health or safety of persons on any public right of way.
2. Time A memorial shall remain for no more than ninety (90) days from the date of the
commemorated event, subject to removal by the Village after that period has expired.
3. Nuisance Any Memorial that is unsafe, insecure, or a menace to the public or has been
constructed or is being maintained in violation of the provisions of this Section is hereby
declared a nuisance, subject to removal by the Village.
SECTION 2: This Ordinance shall be in full force and effect from and after its passage, approval and
publication in pamphlet form in the manner provided by law.

A RESOLUTION DECLARING THE RESULTS OF A BINDING PUBLIC QUESTION TO DETERMINE
WHETHER THE VILLAGE SHOULD HAVE THE AUTHORITY TO ARRANGE FOR THE SUPPLY OF
ELECTRICITY FOR ITS RESIDENTIAL AND SMALL COMMERCIAL RETAIL CUSTOMERS WHO DO NOT
OPT OUT OF SUCH A PROGRAM,
WHICH QUESTION WAS ON THE MARCH 20. 2012 GENERAL PRIMARY ELECTION BALLOT
WHEREAS, the March 20, 2012 ballot for the General Primary Election (Presidential Primary Ballot) included
a referendum on a binding public question to determine whether the Village of Mount Prospect, Cook
County, Illinois, should have the authority to arrange for the supply of electricity for its residential and small
commercial retail customers who do not opt out of such a program pursuant to Section 3855/1 -92 of the
Illinois Power Agency Act, 20 ILCS 3855/1 -92 (the "Referendum "); and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect do hereby declare the
results of the Referendum for said Village.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE That pursuant to the Election Laws of the State of Illinois, the Referendum was on the
March 20, 2012 General Primary Election (Presidential Primary Ballot).
SECTION TWO That an official canvass was conducted on April 10, 2012 by the Cook County Clerk's
Canvassing Board for the Village of Mount Prospect declaring that 5,880 ballots were counted as follows:

No 2,432
SECTION THREE That the Referendum was approved by a majority vote of the electors voting, such that
the Village of Mount Prospect is authorized to arrange for the supply of electricity for its residential and small
commercial retail customers who do not opt out of such a program, pursuant to Section 3855/1 -92 of the
Illinois Power Agency Act, 20 ILCS 3855/1 -92.
SECTION FOUR: This Resolution shall be in full force and effect from and after its passage and approval in
the manner provided by law.

A RESOLUTION APPROVING A PLAT OF EASEMENT VACATION
AND PLAT OF EASEMENT DEDICATION FOR PROPERTY LOCATED AT
1601 SOUTH BUSSE ROAD, MOUNT PROSPECT, ILLINOIS
WHEREAS, TERRACO, INC. ( "Petitioner ") has requested approval of a Plat of Easement Vacation
and Plat of Easement Dedication for the property located at 1601 SOUTH BUSSE ROAD, Mount
Prospect, Illinois commonly known as Plaza United /Culver's ( "Property"); and
WHEREAS, the Petitioner is seeking to vacate existing water main easements and dedicate new
water main easements along the east property line; and
WHEREAS, the Plat of Easement Vacation, vacates the existing twenty (20') foot wide watermain
easement for parcel one (1) and the existing twenty (20') foot wide watermain easement for parcel
two (2) of the "Property' as legally described in the Plat of Easement Vacation attached as Exhibit
"A "; and
WHEREAS, the Plat of Easement Dedication, dedicates the new twenty (20') foot wide watermain
easement for Parcel One (1) and the new twenty (20') foot wide watermain easement for Parcel Two
(2) of the "Property" as legally described in the Plat of Easement Dedication attached as Exhibit "B."
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the vacation of the existing twenty (20') foot wide watermain easement of
Parcel One (1) and the vacation of the existing twenty (20') foot wide watermain easement of Parcel
Two (2) at 1601 South Busse Road and the Plat of Easement Vacation attached as Exhibit "A" and
Mortgagee's Consent to record Plaza United /Culver's Plat of Watermain Easement Vacation are
hereby approved for appropriate execution and recording. Such Plat, its legal description and
Mortgagee's consent are incorporated into and made part of this resolution.
SECTION TWO: That the dedication of the new twenty (20') foot wide watermain easement for
Parcel One (1) and the dedication of the new twenty (20') foot wide watermain easement for Parcel
Two (2) at 1601 South Busse Road and the Plat of Easement Dedication attached as Exhibit "B"
and Mortgagee's Consent to record Plaza United /Culver's Plat of Watermain Easement Dedication
are hereby approved for appropriate execution and recording. Such Plat, its legal description and
Mortgagee's consent are incorporated into and made part of this resolution.
SECTION THREE: That this Resolution shall be in full force and effect from and after its passage
and approval in the manner provided by law.
