AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 305 SOUTH EDWARD STREET
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Jack Muscia has filed an application for variation
with respect to property commonly known as the 305 South Edward
Street in the Village of Mount Prospect, Illinois (the "Subject
Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 22, in Block 23 in Busse's Eastern
Addition to Mount Prospect, in the East Half
of Section 12, Township 41 North, Range 11,
East of the Third Principal Meridian, in
Cook County, Illinois.
WHEREAS, Petitioner, seeks a variation from the provisions
of Section 14.1101.A.1 of Chapter 14 of the Village Code of Mount
Prospect, Illinois, to allow construction of a single family
residence on the Subject Property containing 50 feet of width and
8,000 square feet of area rather than the required 65 feet of width
and 8,125 square feet of area; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-68-V-85) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 21st day of
November, 1985, pursuant to due and proper notice thereof published
in the Mount Prospect Herald on the 5th day of November, 1985; and
WHEREAS, the Zoning Board of Appeals has submitted its
finding and recommendation in favor of granting the Subject
variation to the President and Board of Trustees of the Village of
Mount Prospect, and the President and Board of Trustees of the
Village have given further consideration to the variation request
and have determined that the same satisfies the standards set forth
in Section 14.605 of Article VI of Chapter 14 of the Village Code,
and this Board further finds that it would be in the best interest
of the Village to grant the request for variation provided the
Petitioner maintains the proper setbacks between adjoining
properties and preserv~ as many of the mature trees on the Subject
Property as is possible during construction.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the
Village of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 14.1101.A.1 of Article
XI of Chapter 14 of the Village Code of Mount'Prospect, Illinois, to
allow construction of a single family residence on property having a
frontage of 50' in width and a lot area of 8,000 square feet,
provided further, that proper setbacks are maintained from adjoining
properties and that the Petitioner retains as many of the mature
trees presently located on the Subject Property as can be retained
in constructing the subject residence.
SECTION THREE: Except for the variation granted herein,
all other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
SECTION FOUR: This Ordinance shall be in full force and
effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
