PREVAILING WAGE IMPACTS
The Illinois Prevailing Wage Act is a state statue that requires the Village to pay a prevailing wage for
work paid with public funds. A prevailing wage is generally considered to be the hourly wage, usual
benefits, and overtime paid to skilled workers, laborers, and mechanics within a specific geographic
area. In Illinois, most municipalities pay the prevailing wage established for the county in which the
community is sited. The Illinois Prevailing Wage Act, like similar laws in other states, is modeled after
the federal Davis -Bacon Act.
When originally passed in the 1940s, this Illinois law was narrowly construed and deemed to apply
only to work on state - financed construction projects. Over the years, the scope and application of this
law has widened significantly. Presently, it is generally accepted that the law applies to both
construction and maintenance work on "fixed works" paid for by any unit or political subdivision of
Illinois government. However, one common and long -held assumption was that the law did not apply
to tree work, grounds maintenance work, or janitorial work.
Recently, staff learned that the Illinois Department of Labor (IDOL) intends to expand their
enforcement of the Act to include tree and grounds maintenance work. This action has the potential
to adversely affect the Village's forestry and grounds maintenance programs.
Appropriate staff will be on hand to present the matter in further detail and facilitate discussion.
V. MASSAGE PARLOR REGULATIONS
Over the past several years the Village has experienced several massage business operations that
did not retain a legitimate business model and were shuttered due to criminal activities. The effort to
terminate the business licenses for such businesses has required an extraordinary effort on the part
of law enforcement personnel. The Village currently has an ordinance regulating massage
establishments; however, based on the experiences that have occurred and the effort to terminate
business licenses from establishments with criminal activity staff has found that the ordinance should
be modified to provide better regulatory parameters. Unfortunately, the state of Illinois has preempted
the Village from strict regulation of massage therapist due to the state licensing regulation. The state
does not allow the Village from an outright prohibition of such operations within the community.
Therefore, these modifications to the ordinance establishes a minimal level of local regulation which
would hopefully discourage future criminal activity in such business operations.
Staff originally drafted a revised (attached) ordinance which was discussed at the February 8, 2011
Committee the Whole meeting. The Village Board directed staff to make several modifications to the
ordinance and those modifications were incorporated into the draft presented for discussion at this
Committee of the Whole meeting.
Appropriate staff and the Village Attorney will be present to facilitate the discussion. Staff is
requesting consensus from the Village Board to consider the draft ordinance at an upcoming Village
Board meeting.
VI. BLACKOUT INTERSECTIONS FOR CHARITABLE SOLICITATIONS
In February of 2010 the Village Code was modified to limit the number of street solicitation "Tag Day"
permits issued to qualifying organizations. Since that time additional safety concerns have been
identified.
During Winter Months: Limited Visibility and Hazardous Road Conditions
Street Intersections: High Volume, Speed Limits, and Split Jurisdiction
The purpose of this discussion is to review these safety concerns for the participants and motorists.
Appropriate staff will be available to present recommendations, answer questions and facilitate
discussion.
VII. DEREGULATION OF TAXI LICENSING
Discussion on Amendments to Chapter 11, Article XI of the Village Code entitled: Public Passenger
Vehicles; including a recommendation by the Police Chief to rescind certain taxi cab licensing and
chauffeur license requirements currently required by Village Code. The current individual taxi cab
and chauffeur licensing requirements required by existing Village Code require significant supervisory
personnel time to administer and manage. Further, said licensing requirements involve hard costs
that can be eliminated moving forward without jeopardizing public safety. The police department has
identified requirements contained in portions of Article XI that it feels can be effectively eliminated to
better reflect current police department operating realities and the state of the public passenger
vehicle industry locally.
