HomeMy WebLinkAboutOrd 5247 04/16/2002ORDINANCE NO. 5247 AN ORDINANCE AMENDING ORDINANCE NO. 5153 GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 620 EAST NORTHWEST HIGHWAY Passed and approved by the President and Board of Trustees the 16TM day of April, 2002 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 17TM day of April, 2002 vw[ ORDINANCE NO. ¢2_AZ AN ORDINANCE AMENDING ORDINANCE NO. 5153 GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 620 EAST NORTHWEST HIGHWAy WHEREAS, Charles Randolph (hereinafter referred to as Petitioner) has filed a petition to amend the Conditional Use permit being the subject of Ordinance No. 5153, approved November 8, 2000 for the operation of an automobile repair business in the B-5 Central Commercial zoning district; and legally described as follows: Lots 53 through 58, (except 3 feet and 1 ~ inches take evenly off the Easterly side of said Lot 58) in Morningside Gardens, a subdivision of part of the Northeast ¼ of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County Illinois; Property Index Number: 08-12-222-026 and WHEREAS, Petitioner seeks an amendment to the Conditional Use permit being the subject of Ordinance No. 5153 to allow the sale of automobiles, which shall not exceed an inventory of four automobiles at any time; WHEREAS, a Public Hearing was held on the requests being the subject of PZ 08-02 before the Planning and Zoning Commission of the Village of Mount Prospect on the 28th day of March, 2002, pursuant to proper legal notice having been published in the Mount Prosnect Journal & Topic.~ on the 13th day of March 2002; and WHEREAS, the Planning and Zoning Commission has submitted its findings on the proposed amendment to the Conditional Use permit to the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect would be attained by granting the requests in PZ 08-02. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: W Automotive Page 2/2 SEC~ The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount prospect. SEC~ That Ordinance No. 5153 granting a Conditional Use permit, passed and approved on November 8, 2000, is hereby amended by granting a Conditional Use permit to include the limited sale of automobiles, which inventory shall not exceed four automobiles at any time, at the subject property as shown on the attached Site Plan hereby made a part hereof as "Exhibit A". ~C~: This amendment being the subject of this Ordinance is subject to the following conditions: 1. Implementation of the landscape plan as required by Ordinance 5153 no later than May 1, 2002 or the Petitioner shall establish an escrow account equal to the amount of the required work to ensure the work is done; 2. No more than four vehicles shall be sold at one time; No signage related to auto sales will be permitted other than an indication on/in the windshield of the vehicle being sold; All conditions of approval listed in Ordinance No. 5153 continue to be applicable. ~;C~LOJ~LE~;ZL~: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
