HomeMy WebLinkAboutOrd 5246 04/16/2002ORDINANCE NO. 5246 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY COMMONLY KNOWN AS 1018 PROSPECT PLAZA Passed and approved by the President and Board of Trustees the 16TM day of April, 2002 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 17TM day of April, 2002 VVVL ORDINANCE NO. 5246 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY COMMONLY KNOWN AS 1018 MOUNT PROSPECT PLAZA WHEREAS, Lynda Ernst/Luv My Pet (hereinafter referred to as Petitioner) has filed a petition for a Conditional Use with respect to property located at 1018 Mount Prospect Plaza, (hereinafter referred to as the Subject Property) and legally described as follows: Part of Lot 1, Plaza Subdivision, City of MP, Cook County, IL described as: Beginning at the NWC of the West Gate Rd & E. Central Rd; thence N89°37'28"W, 813.32'; thence N56°54'28"W, 419.41'; thence N33°05'32"E, 35'; thence N56°54'28"W, 120'; S33°05'32"W, 35'; thence N56°54'28"W, 38.52'; thence along the arc of a curve to the right having a radius of 2,072.46' & a long cord subtended bearing of N53°26'08"W, 252.15'; thence N20°57'12"E, 615.3'; thence S89°37'28"E, 698.3'; thence N0°l'21"E, 123.99'; thence N89°39'43"E, 416.97'; thence along the arc of a curve to the right having a radius of 40' & a long cord subtended bearing of S78°43'34"E, 16.11 ', thence S67°05'57"E, 135.16'; thence S89°26'43"E, 24.37'; thence S0°0'0"W, 1,111.59' to the point of beginning. Contained within said bounds 1,404,186.72 sq. ft. or 32.24 acres. Property Index Number: 03-35-301-036-000 and WHEREAS, the Petitioner seeks a Conditional Use permit to operate an itinerant veterinary clinic twice monthly; and WHEREAS, a Public Hearing was held on the request for a Conditional Use permit being the subject of PZ Case No. 07-02, before the Planning and Zoning Commission of the Village of Mount Prospect on the 28th day of March, 2002, pursuant to proper legal notice having been published in the Mount Prospect Journal & Topics on the 13th day of March, 2002; and WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to the President and Board of Trustees in support of the request being the subject of PZ 07-02; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use permit would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BYTHE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use, as provided in Section 14.203.F of the Village Code, to allowthe operation of an itinerant veterinary clinic twice monthly, as shown on the Site Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A." Z 07-02 Page 2/2 SECTION THREE: That this Conditional Use permit shall be subject to and conditioned upon the following restrictions: 1. The scope of services will be limited to administering vaccinations and taking samples (blood, etc.) for routine tests only; 2. Animals shall not be boarded on-site; 3. Veterinary services shall be provided no more than two (2) days (Sundays) per month, up to two hours; 4. All activity shall be conducted inside the store; 5. Treatment tables and cashier tables will be situated to maintain a minimum 36" wide passage in all aisles, as required by the Americans With Disabilities Act. SECTION FOUR: That any violation of the aforesaid restrictions shall make the Conditional Use permit subject to immediate expiration and revocation. SECTION FIVE: That the Village Clerk is hereby authorized and directed to record a certified copy of this Ordinance with the Recorder of Deeds of Cook County. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
