HomeMy WebLinkAboutOrd 5245 04/16/2002ORDINANCE NO. 5245 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 805EAST PROSPECT AVENUE Passed and approved by the President and Board of Trustees the 16TM day of April, 2002 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 17TM day of April, 2002 vwl ~10~2 ORDINANCE NO. 5245 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 805 EAST PROSPECT AVENUE WHEREAS, Joni Beaudry and Eric Jakubowski (hereinafter referred to as "Petitioners") have filed a petition for a Conditional Use permit with respect to property located at 805 East Prospect Avenue (hereinafter referred to as the "Subject Property") and legally described as follows: Lot 22 in Surety's Bonnie Park, a subdivision of Lot 2 in Oehlerking's Division of part of Sec. 12, Township 41 NOrth, Range 11 Eats of the 3rd Principal Meridian, in the Village of Mount Prospect, according to the plat thereof registered in the office of Registrar of Titles of Cook County, IL on May 11, 1956 as Doc# 1669522, in Cook County, IL. Property Index Number: 08-12-422-013-000 and WHEREAS, the Petitioners seek a Conditional Use permit to construct a circular driveway; and WHEREAS, a Public Hearing was held on the request for a Conditional Use permit, being the subject of PZ Case No. 06-02, before the Planning and Zoning Commission of the ti1 Village of Mount Prospect on the 28 day of March, 2002, pursuant to pro, er legal notice having been published in the Mount Prospect Journal & Topics on the 13"' day of March, 2002; and WHEREAS, the Planning and Zoning Commission has submitted its findings and positive recommendation to the President and Board of Trustees in support of the request being the subject of PZ 06-02; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use permit would be in the best interest of the Village. 05 E. Prospect Avenue Page 212 NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use permit, as provided for in Section 14.203.F.7 of the Village Code, to allow the construction of a circular driveway, as shown on the Site Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A." SECTION THREE: The Village Clerk is hereby authorized and directed to record a certified copy of this Ordinance with the Recorder of Deeds of COok County. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
