The Planning and Zoning Commission reviewed the proposed plat, found that the plat and proposed easements
met Village codes and voted 7-0 to recommend approval of the Kessel Resubdivision, Case No. PC-19-01, 211
West Kensington Road.

Analysis
The petitioner is seeking to consolidate six lots creating one lot of record. The subject property is located at 211
West Kensington, west of Elmhurst Road. This plat is part of Mr. Kessel's building permit application. The
petitioner is rebuilding part of his home after a recent.fire. The consolidation is required to meet Zoning Code
requirements, which do not allow structure to be built over tot lines.
The proposed plat of resubdivision seeks to create one lot of record. The plat and new lot comply with
Development Code requirements and the petitioner is not seeking relief from the Development Code or the
Zoning Ordinance.
Recommendation
The proposed plat of subdivision is complete and has been prepared in accordance with the Development Code
requirements. Therefore, staff recommends approval of the Kessel Plat of Resubdivision, for the property
located at 211 West Kensington, Mount Prospect Case No. PC-19-01.

Chairperson Arlene Juracek called the meeting to order at 7:33 p.m. Minutes of the February 28 meeting were
approved, with one minor correction. At 7:35, Ms. Juracek introduced Case No. PC-19-01, a request for Plat
Consolidation. She explained that this case would be Village Board final.
Suzanne Mas6, Long Range Planner, introduced the staff memorandum for the ca~e. The petitioner is seeking to
consolidate six lots creating one lot of record. The subject property is located at 211 West Kensington, west of
Elmhurst Road. This plat is part of Mr. Kessel's building permit application. The petitioner is rebuilding part of his
home after a recent fire. The consolidation is required to meet Zoning Code requirements, which do not allow a
structure to be built over lot lines.
Ms. Mas6 said the proposed plat of resubdivision seeks to create one lot of record. The plat and new tot comply with
Development Code requirements and the petitioner is not seeking relief from the Development Code or the Zoning
Ordinance.
Ms. Juracek asked for clarification on the number of lots and which lots were being consolidated. Mr. Kessel reported
to staffthat his property is currently 5 lots and one half of lnt 3, as shown on the plat.
Ms. Mas6 reported that the proposed plat of subdivision is complete and has been prepared in accordance with the
Development Code requirementS. Therefore, staff recommends approval of the Kessel Plat of Resubdivision, for the
property located at 211 West Kensington, Mount Prospect Case No. PC-19-01.
Ms. Juracek closed the public hearing at 7:40.
Richard Rogers moved to approve the requested Plat Consolidation for Case No. PC-19-01, 211 W. Kensington. Keith
Youngquist seconded the motion.

AN ORDINANCE APPROVING A FINAL PLAT OF CONSOLIDATION
211 WEST KENSINGTON ROAD
WHEREAS, the Petitioner, Dennis Kessel, has requested approval of a Final Plat of
Consolidation for the purpose of consolidating six lots of record at 211 West Kensington Road
into one single lot of record; and
WHEREAS, the Planning and Zoning Commission has recommended approval of the
consolidation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the consolidation of six lots into a single lot of record is hereby
granted for the property at 211 West Kensington Road and the Final Plat of Consolidation
attached to this as Exhibit "A" is hereby approved for appropriate execution and recording. Such
Plat and its legal description are incorporated into, and made a part of, this Ordinance.
SECTION TWO: That the Village Clerk is hereby authorized and directed to record a
certified copy of this Ordinance with the Recorder of Deeds of Cook County.
SECTION THREE: This Ordinance shall be in full force and effect from and after its adoption,

approved, with one minor correction. At 7:41, after the Commission heard Case No. PC-19-01, Ms. Juracek
introduced Case No, PZ-01-02, a request to subdivide two lots to create three lots of record. She explained that this
case would be Village Board final.
Suzanne Mas6, Long Range Planner, introduced the staff memorandum for the case. The petitioner is seeking to
resubdivide two lots and create three lots of record. The subject property is located at the southwest comer of Euclid

The petitioner, Drago Zgrabljic of 12320 Lakeview, Huntley, Illinois came forward. He explained that is request is
similar to a subdivision done'previously at the southeast comer of Euclid and Burning Bush, directly across the street
from these properties. He plans to build one single family home on the new property. They are providing sewer and
water for these properties for the vacant lot and one existing home. There will only be one new home on lot 3; the
newly created lot.

Cindy Young, 1903 Ivy Lane came forward. She is an adjacent resident. Ms. Young stated her concerns regarding the
properties not selling on the opposite side of Burning Bush and the maintenance of the vacant lot. She is also
concerned about future development subdividing the remaining lots on Euclid, which are also as deep as the subject
properties, which would require an access road. Ms. Young is concerned about the effect of this development on her
neighborhood and the increased population and traffic. She requested that the Commission considered how the new
development would change the character of the neighborhood.
Lillian Hoffman; 1100 Burning Bush, came forward and expressed her concerns regarding the size of the home. The
previous project on east side of Burning Bush included larger homes that she felt did not fit in with the neighborhood.
She also expressed concerns about flooding on the lot at 1104 Burning Bush which abuts the new lot 3.
Mr. Cotton staff if the subject properties were in a flood plain. Ms. Mas6 stated they were not.
Ms. Joan Puzzo, 1907 Ivy Lane, asked the size of the new lot. Ms. Juracek explained that the new lot being created
was I00 x 200, a 20,000 square foot lot, and remarked that is still larger than some neighboring lots, and there will
only be one new home on the lot.
Mr, Rogers clarified that the size of the new lot is about ½ of an acre while the lots on Ivy Lane and others nearby are
approximately ¼ of an acre.
Mr. Zgrabljic returned to explain that the new home will be approximately 3,200 square feet and will meet all the bulk
regulations and zoning requirements. He will only own lot 3; lots 1 and 2 have separate ownership.
Mike Leone, 1903 Ivy Lane came forward and expressed his concerns with the size of the new home and how it may
block sunlight from the adjacent yards.
Ms. Juracek clarified that the commission is only making a recommendation on the lot created by the plat and that no
building or construction is being considered. She further explained that if the proposed building did not meet the
zoning requirements, the petitioner would then return to the Planning and Zoning with a separate request which would
then be the proper forum to address these concerns.
Ms. Juraeek closed the public hearing at 8:13.
Merrill Cotten moved to approve the request to subdivide two lots to create three lots of record for Case No. PZ-0 t-02.
Joseph Donnelly seconded the motion.

The Planning and Zoning Commission transmits their recommendation to approve Case PZ-06-02, a request for a
circular driveway, as described in detail in the attached staff report. The Planning and Zoning Commission heard
the request at their March 28, 2002 meeting.
The subject property is an existing home located in a single-family residential neighborhood on a collector street.
Recently, the petitioners constructed a large addition and an attached garage. They would like to construct a
circular driveway in order to provide a safe means of entering on to Prospect Avenue and to provide guest parking
in front of their house (there are parking restrictions on both sides of Prospect Avenue in front of their property).
The Planning and Zoning Commission discussed the petitioners' request and noted that the parking restrictions
and aesthetic impact distinguish this request from previous circular driveway requests. P&Z members also
discussed sight lines, the street width, and the proposed amount of lot coverage. The Planning and Zoning
Commission voted 7-0 to recommend approval of the request for the Conditional Use for a circular driveway for
the property at 805 E. Prospect Avenue, case no. PZ-06-02.

BACKGROUND AND PROPOSED CONDITIONAL USE
The subject property is an interior lot located across the street from the Union Pacific Rail Road tracks, in a
single-family residence neighborhood. The property owners recently constructed an addition on the .east side of
the house and are in the process of finalizing~that project. As part of the addition project, the petitioners
constructed a new attached, garage (they are required to demolish the existing detached garage) and are seeking
Conditional Use approval to install a circular driveway.
In the attached application, the petitioners state that a circular drive is necessary for aesthetic and safety reasons:
Prospect Avenue is wide and drivers have a tendency to speed on this street. In addition, parking restrictions on
this section of Prospect Avenue make it inconvenient for guest parking (there is no parking on either side of
Prospect Avenue from Mount Prospect Road to Edward Street). While some drivers disregard the parking

restrictions and park on the street, the petitioner states an unsafe situation is created because sight lines are
obstructed.
The petitioners state that vehicles will not be parked on the circular portion of the driveway overnight. In
addition, they propose to construct the circular drive of decorative materials and retain as many of the existing
trees as possible. They state that the decorative materials and landscaping will minimize the impact of the circular
drive on the neighborhood.
To conduct its analysis of the proposed Conditional Use, staff reviewed the petitioners' plat of survey, site plan,
and visited the site.
REQUIRED FINDINGS
Conditional Use Standards
The standards for Conditional Uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance. The section
contains seven specific findings that must be made in order to approve a Conditional Use~ (The circular drive is
listed as a.Conditional Use in the parking section of the Zoning Ordinance (Sec. 14.2215.A. 1). These standards
relate to:
· The Conditional Use will not have a detrimental effect on the public health, safety, morals, comfort or
general welfare;
· The Conditional Use will not be injurious to the use, enjoyment, or value of other properties in the
vicin, ity or impede the orderly development of those properties;
· Adequate provision of utilities and drainage and design of access and egress to minimize cr;ngestion
on Village streets; and
· Compliance of the Conditional Use with the provisions of the Comprehensive Plan, Zoning Code, and
other Village Ordinances.
The subject property for the proposed Conditional Use is an 18,872 square foot parcel. The applicant proposes to
construct a circular driveway in the fi'ont yard. As with other requests for a circular drive, staff evaluated traffic
patterns in the neighborhood. In this ease, the Village restricts parking on the south side of Prospect Avenue from
Maple to Edward Street (two-hour parking) and prohibits parking on the north and south sides of Prospect Avenue
from Edward to Mount Prospect Road.
The petitioners' front yard has 140-linear feet frontage onto Prospect Avenue. The minimum tot width in the RA
zoning district is 50-feet. The petitioners lot is almost three times bigger than the minimal width and the circular
portion of the driveway would cover 15% of the front yard (30'x140'). This amount of front yard lot coverage is
in keeping with the Village's policy of open, 'green'.front-yards.
Prospect Avenue is designated as a collector street from Central Road to Mount Prospect Road and, therefore, is
designed to handle greater traffic than a local road. This, coupled with exist:lng parking restrictions, justifies
granting the Conditional Use request.
The additional driveway and amount of front yard coverage would be in keeping with the Village's policy of
maintaining a "green" front yard. The circular driveway would not have a negative impact on the adjacent area,
utility provision or public streets. The essential character of the neighborhood would not be affected by the
proposed Conditional Use, nor would it have any significant effect on the public welfare.

P,3ECOMMENDATION
The proposed circular driveway meets the Conditional Use standards contained in Section 14.203.F.8 of the
Zoning Ordinance. Based on these findings, Staff recommends that the Planning and Zoning Commission make a
recommendation to the Village Board to approve a Conditional Use for a circular driveway for the residence at
805 E. Prospect Avenue, Case No. PZ-06-02. The Village Board's decision is final for this case.

805 East Prospect is an existing single-family residence on an approximately ½ acre lot.
The original building is a 1929 brick 2-story bungalow. Applicants are in the process of
completing in spring, 2002 an addition and renovation project that will add an attached 2-
car garage and 1200 s.f. of new living space.
Applicants submit for approval a plan to incorporate a new driveway that includes a
circular design with 2 aprons accessing Prospect Avenue.
The attached drawing prepared by Tinaglia Architects details the specific layout and
design.
The subject property is the only residential single-family lot with frontage on Prospect
Avenue for more than ~ mile in either direction. This is one of the original farmsteads of
Mount Prospect. Lot frontage on Prospect Avenue is 140 feet. Applicants desire to
include a circular driveway for both aesthetic and safety reasons.
Prospect Avenue is an unusually wide 2 lane street: traffic volumes are heavier than a
normal Village residential street, and vehicle speeds tend to average above the posted 30
mph speed limit. Any vehicle backing out of the tot at 805 East Prospect is further
hazarded bythe fact that Prospect Avenue is an angle street and sight lines for drivers are
more e~reme than at a 90 degree perpendicular driveway.
Prospect Avenue between Edward and George Streets, immediately west and east of
subject lot, is a posted "No Parking" zone. Visitors to this residence are exposed to the
option of parking illegally, or going around the comer to park on one of the cross streets
- a hazard or inconvenience.
Applicants propose a circular driveway with an apron in front of the 2-car garage.
Applicants and visitors will use the circular driveway-for short-term parking and safe
ingress/egress. No overnight parking on the circular portion of the driveway is
anticipated - vehicles will be kept in the garage or on the apron in front of the garage.
The addition of the cimular driveway will enable the applicants and visitors to use the
original main entrance of the house in the northwest comer of the structure.
Applicants will construct the driveway and walks of decorative course concrete together
with a perimeter of brick pavers. Applicants desire to maintainthe existing mature trees
in the front lot. The only exception is the removal of 2 evergreen trees, which are leaning
due to lopsided priming of main branches. Landscaping wilt be incorporated to maximize
a green and open'space in conformance with Village guidelines.

Chairperson Arlene Juracek called the meeting to order at 7:33 p.m. Minutes of the February 28 meeting were
approved, with one minor correction. At 8:15, after the Commission heard two other cases, Ms. Juracek introduced
Case No. PZ-06-02, a request for a Conditional Use to allow construction of a circular driveway. She explained that
this ease would be Village Board final.
Judy Connolly, Senior Planner, introduced the staff memorandum for the case. The subject property is an interior lot
located across the street from the Union Pacific Rall Road tracks, in a single-family residence neighborhood. The
property owners recently constructed an addition on the east side of the house. As part of the addition project, the
petitioners constructed a new attached garage and are seeking Conditional Use approval to install a circular driveway.
Ms. Connolly pointed out that,'in their application, the petitioners state that a circular drive is necessary for several
rcasons, one of which is that Prospect Avenue is 4-1nnes and drivers have a tendency to speed on this street. In
addition, the parking restrictions on this section of Prospect Avenue make it inconvenient for guest parking (there is no
parking on either side of Prospect Avenue from Mount Prospect Road to Edward Street). Some drivers disregard the
parking restrictions and park on the street, which the petitioner states is an unsafe situation because sight lines are
obstructed.
Ms. Connolly reported that the petitioners state that vehicles will not be parked on the circular portion of the driveway
overnight. In addition, they propose to construct the circular drive of decorative materials and retain as many of the
existing trees as possible. They state that the decorative materials and landscaping will minimize the impact of the
circular drive on the neighborhood.
Ms. Connolly said, in order to approve the request, the Board has to find that it meets the standards for a Conditional
Use, which are listed in the Zoning Ordinance. To conduct its analysis of the proposed Conditional Use, Planning staff
reviewed the petitioners' plat of survey, site plan, visited the site, and worked with the Village's Traffic Engineer.
Ms. Connolly described the subject prope~r for the proposed Conditional Use as an 18,872 square foot parcel. The
applicant proposes to construct a circular driveway in the front yard. As with other requests for a circutar drive, staff
evaluated traffic patterns in the neighborhood. In this case, the Village restricts parking on the south side of Prospect
Avenue from Maple to Edward Street (two-hour parking) and prohibits parking on the north and south sides of
Prospect Avenue from Edward to Mount Prospect Road.

Ms. Connolly said the petitioners' front yard has 140-1inear feet frontage onto Prospect Avenue. The minimum lot
width in the RA zoning district is 50-feet. The petitioners lot is almost three times bigger than the minimal width and
the circular portion of the driveway would cover 15% of the front yard (30'x140'). This amount of front yard lot
coverage is in keeping with the Village's policy of open, 'green' front-yards.
Ms. Connolly reported that Prospect Avenue is designated as a collector street from Central Road to Mount Prospect
Road and, therefore, is designed to handle greater traffic than a local road. This, coupled with existing parking
restrictions, justifies granting the Conditional Use request.
Ms. Connolly said the additional driveway and amount of front yard coverage would be in keeping with the Village's
policy of maintaining a "green" front yard. The circular driveway would not have a negative impact on the adjacent
area, utility provision or public streets. The essential character of the neighborhood would not be affected by the
proposed Conditional Use, nor would it have any significant effect on the public welfare.
Based on these findings, Staffreeommends that the Planning and Zoning Commission make a recommendation to the
Village Board to approve a Conditional Use for a circular driveway for the residence at 805 E. Prospect Avenue, Case
No. PZ-06-02. The Village Board's decision is final for this case.
The petitioner, Erie Jakubowski, 805 E. Prospect Ave., was sworn in. He said Ms. Connolly had presented his case
very well and he would be pleased to answer any questions the Commissioners may have.
Richard Rogers asked how large the home was with the recent addition and complimented him on doing a very nice
job on the house. Mr. Jakubowski thanked him and said the house was originally 3,000 s.f. and was now 4,400 s.f. He
said it was originally a farmhouse and he tried to keep the original character of the home. He said the driveway he
wanted to replace was the original rural cinder type. Mr. Rogers advised him on careful excavating in order to retain
the trees.
Leo Floros said he considered this the most unique building project in Mount Prospect in many years. Mr. Jakubowski
said the design of the 1929 home had taken six months. He also pointed out it is the only single family hOme to front
on Prospect Avenue.
Don Bender, 507 South George, was sworn in and said this .project was enhancing the neighborhood. He said he had
talked to the neighbors and they all liked the idea cfa circular drive to prevent parking cars on Prospect Avenue.
Ms. Juracek closed the public hearing at 8:31.
Leo Floros moved to recommend approval of the request for a circular drive for Case No: PZi06-02. Richard Rogers
seconded the motion.

The Planning and Zoning Commission transmits their recommendation to approve Case PZ-07-02, a request for
an itinerant veterinary clinic, as described in detail in the attached staff report. The Planning and Zoning
Commission heard the request at their March 28, 2002 meeting.
The proposed clinic would be located inside the existing Petco Store and operate two Sundays a month, for two
hours each Sunday. Licensed vets employed by Luv My Pet would run the clinic, and they would administer
vaccines and take samples for routine lab tests. The petitioner was granted Conditional Use approval for this
request in 1998, but for a different Petco Store location.
The Planning and Zoning Commission discussed the store conditions and the scope of services offered at the
clinic. They asked the petitioner questions about the previous Mount Prospect clinic operation and clarified that
the petitioner would have to amend the Conditional Use if she wanted to increase the number of days or hours of
operation. The Planning and Zoning Commission voted 7-0 to recommend approval of the request for the
Conditional Use for an itinerant veterinary clinic for the property at 1018 Mount Prospect Plaza, case no. PZ-07-
02 subject to the petitioner complying with the conditions listed in the staffreport.

The subject property is a shopping center located in the B3 Community Shopping zoning district. The shopping
center has undergone significant remodeling and the former banquet hall was converted to a Petco Store. The
petitioner, who represents, Luv My Pet, is seeking Conditional Use approval to operate an itinerant veterinary
clinic inside the Petco Store.
The petitioner, Lynda Ernst, appeared before the Zoning Board in 1998 with the same request, but for a Petco
Store located at Golf and Route 83 (that store has since closed). Similar '~o the 1998 ease, the proposed vet clinic
would operate on alternating Sunday aiternoons for two hours each Sunday. In the attached application, the
petitioner states that the scope of services would be limited to vaccinations for dogs, cats, and ferrets and taking
samples for routine lab tests, i.e. blood samples. The work would be done by licensed vets, who work for Luv My
Pet and would recommend any appropriate full vet services as indicated necessary by their exam.
The attached Petco Store floor plan shows the location of the vet clinic. A total of four 2'x4' tables would be
used: one table for the Customer Service Representative, one for a cashier, and two tables placed together to
create a 2'x8' exam table. The locations of the tables comply with ADA requirements for accessibility (36' aisle
clearance).

To conduct its analysis of the proposed Conditional Use, staff reviewed the petitioner's application, previous
zoning case file, and visited the Petco Store.
REQUIRED FINDINGS
Conditional Use Standards
The standards for Conditional Uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance. The section
contains seven specific findings that must be made in order to approve a Conditional Use. (The circular
drive is listed as a Conditional Use in the parking section of the Zoning Ordinance (Sec. 14.2215.A.1).
These standards relate to:
· The Conditional Use will not have a detrimental effect on the public health, safety, morals, comfort or
general welfare;
· The Conditional Use will not be injurious to the use, enjoyment, or value of other properties in the
vicinity or impede the orderly development of those properties;
· Adequate provision of utilities and drainage and design of access and egress to minimize congestion
on Village streets; and
· Compliance of the Conditional Use with the provisions of the Comprehensive Plan, Zoning Code, and
other Village Ordinances.
Approval Process
The subject site is zoned B3 Community Shopping. "Animal Hospitals" are listed as Conditional Uses in the B3
district. The proposed Luv My Pet facility falls under the definition of Animal Hospital given in the Zoning
Ordinance. Therefore, the proposal requires approval of a Conditional Use by the Village Board, following a
public hearing and recommendation by the Planning and Zoning Commission.

use will not significantly impact the intensity of the center with respect to traffic volume or noise since the vet
clinic's oustomer base would most likely shop at the Petco Store in the first place and get the vaccinations as they
do their shopping. Therefore, the proposed Conditional Use is appropriate for the site.
RECOMMENDATION
The proposed veterinary clinic is located in an existing shopping center and operates on a limited sehedule~ The
use will have limited impact on the adjacent neighborhoods or other tenants in the shopping center. The site will
comply with the Conditional Use standards contained in Section 14.203.F.8 of the Zoning Ordinance. Based on
these findings, Staff recommends that the Planning and Zoning Commission make a recommendation to the

Ms. Connolly summarized the case and.stated that the veterinary clinic is located in an existing shopping center and
operates on a limited schedule. The use will have limited impact on the adjacent neighborhoods or other tenants in the
shopping center. The site will comply with the Conditional Use standards contained in the Zoning Ordinance. Based
on these findings, Staffrecommends that the Planning and Zoning Commission make a recommendation to the Village
Board to approve a Conditional Use to operate a veterinary clinic at the Petco Store in the Mount Prospect Plaza, Case
No. PZ~07-02, with the following conditions:
1. The scope of services will be limited to administering vaccinations and taking samples (blood, etc.) for routine
tests only;
2. Animals will not be boarded on-site;
3. Veterinary services will be provided no more than two (2) days per month, up to two hours;
4. All activity will be conducted inside the store;
5. Treatment tables and cashier tables will be situated to maintain a minimum 36" wide passage in all aisles, as
required by the American with Disabilities Act.
Arlene Juracek asked if the vet clinic would be limited to two weekends per month regardless of the calendar. Ms.
Connolly said yes.
Lynda Ernst was sworn in and testified that this Pete0 Store is much larger than the previous Mount Prospect Peteo
store they had been located in. Ms. Juracek asked how many clients they served at the old location. Ms. Ernst said 15,
every other weekend. Ms. Ernst pointed out that the other store was never able to build up their business because the
Rte. 83 construction began as soon as they opened in May of 1998. She said that they are located in 25 stores in
Illinois and Indiana and many stores handle 80 pets every two weeks. She also said they do not take appointments.
Ms. Jurg. cek reminded the petitioner that if they deCided t° be at the location more than two days or mOre than 2 hours
per day they would need to come before the Board again. The petitioner said that she understood this requirement.
Ms. Juracek closed the public hearing at 8:42.
Richard Rogers moved to recommend approval of the request for a Conditional Use to operate an itinerant veterinary
clinic for Case No. PZ-07-02. Leo Floros seconded the motion.

The Planning and Zoning Commission transmits their recommendation to approve Case PZ-08-02, a request to
amend Ordinance 5153 that granted Conditional Use approval for an auto repair shop in the B5 zoning district.
The petitioner would like to amend that ordinance to include the sale of up to four vehicles, as described in detail
in the attached staff report. The Planning and Zoning Commission heard the request at their March 28, 2002
meeting.
The subject property is located at the comer of Northwest Highway and William Street. The existing auto repair
business and property would not be modified to accommodate the petitioner's request for limited auto sales~
The Planning and Zoning Commission discussed the petitioner's request and noted that the maximum number of
vehicles the petitioner would sell at one time would be limited to four vehicles. The petitioner stated that selling
more than four vehicles would detract from the repair business and agreed to limited advertising as noted in the
staff report. The P&Z discussed the fact that the petitioner has improved the property and that installing
landscaping would minimize the impact of auto sales as an accessory use. The Planning and Zoning Commission
voted 7-0 to recommend approval of the request to amend Ordinance 5153 to include limited auto sales as part of
the Conditional Use for the property at 620 E. Northwest Highway, case no. PZ-08-02.
Please forward this memorandum and attachments to the Village Board for their review and consideration at their
April 16, 2002 meeting. Staff will be present to answer any questions related to this matter.

BACKGROUND
The subject property is at the northeast comer of Northwest Highway and William SWeet, adjacent to single
family residential, commercial, and across the slxeet fxom the UPRR tracks. The Village granted a Conditional
Use permit for an auto repair shop in November 2000. The petitioner would like to modify the Conditional Use to
include auto sales as an accessory use as required by the Zoning Ordinance. The site and building would not be
modified to accommodate the proposed auto sales.
To conduct its analysis of the proposed modification of the Conditional Use, staff reviewed the petitioner's plat of
survey, the site plan, parking requirements, and visited the site.

Approval Process
The subject site is in the B5 Central Commercial District. "Accessory uses and buildings, incidental to and on the
same zoning lot as the conditional use" is listed as a Conditional Use in the B5 district. The proposed auto sales
will require modifying the existing Conditional Use approval granted in November 2000 by the Village Board.
This requires a public heating and recommendation by the Planning & Zoning Commission and Village Board
approval of the request.
Comprehensive Plan Designation
The Village's Comprehensive Plan designates the subject property for general commercial and office uses. The
petitioner would continue to operate the auto repair shop as the primary use and the vehicle sales, which would be
limited to four vehicles, would lie an accessory use. The site was a used ear dealership previous to its current use.
Structure and Elevations
The petitioner does not plan to modify the existing structure. The vehicle sales would be displayed in the parking
lot.
Landscape Plan
As part of the previous Conditional Use approval, the applicant was required to install foundation landscaping and
additional perimeter landscaping. The petitioner is in the process of implementing this requirement and
anticipates completing all work this spring.
Parking and Stacking
Section 14.2224.1 lists parldng requirements for the B5 Central Commercial District. Per these requirements, the auto
repair use is ~lulred to have seven parking spaces. The petitioner states in the attached apphcation that the maximum
number of vehicles that would be sold at one lime would be four. Therefore, the site requires 11 parking spaces.
Currently, there are 13 standard parking spaces and one bandicap parking space on-site. The amount of parking
provided exceeds code requirements. As noted in the.previous Conditional Use request, customer and employee parking
would be limited to the subject property only.
REQUIRED -FINDINGS
Conditional Use Standards
The standards for Conditional Uses are listed in Section 14.203.F.8 of thc Village Zon'mg Ordinance. The section
contains seven specific fmdings that must be made in order to approve a Conditional Use. These standards relate
to:
· The Conditional Use will not have a detrimental effect on the public health, safety, morals, comfort
or general welfare;
· The Conditional Use will not be injurious to the use, enjoyment, or value other properties in the
vicinity or impede the orderly development of those properties;
· Adequate provision of utilities and drainage and design of access and egress to minimize
congestion on Village streets; and
· Compliance of the Conditional Usc with the provisions of the Comprehensive Plan, Zoning Code,
and other Village Ordinances.
The subject parcel for the proposed Conditional Use is an auto repair shop along a commercial corridor. Prior to
becoming an auto repair shop, the site was a used ear lot. The proposal is ora similar intensity to the surrounding
commercial area. Installing the landscaping to provide an enhanced buffer for the residences should allow little or
no negative impact on the adjacent area, utility provision or public streets in the area. The proposed modification

to the Conditional Use will__comply with the Comprehensive Plan and the Zoning Ordinance requirements.
Therefore, the request would not have any significant effect on the public welfare.
RECOMMENDATION
The proposed modification to the existing Conditional Use will meet the required standards listed in the Z°nifig
Ordinance, when the conditions of approval, listed below, have been met. Based on these findings, Staff
recommends that the Planning and Zoning Commission recommend approval of the proposed Conditional Use to
include auto sales at 620 E. Northwest Highway, Case No. PZ-08-02. The Village Board's decision is final for
this case. The conditions of approval are:

petitioner shall establish an escrow account equal to the amount of the required work to ensure the work
is done;

approved, with one minor correction. At 8:43, after the Commission heard four other cases, Ms. Juracek introduced
Case No. PZ-08-02, a request for a Conditional Use to allow auto sales at an auto repair shop. She explained that this
case would be Village Board final.

Richard Rogers commented that he had been observing the business since their last case and said it was well
maintained and did not use flags or excess signs, and had a neat appearance.
Joseph Dounelly asked about the storage of the cars at night. Ms. Cormolly said they would be in a parking stall
outside overnight.
Merrill Cotten asked about the stacking of the vehicles and if thc inventory would go beyond four vehicles. Charles
Randolph, the petitioner, was sworn in. He said that he lives in Des Plaines, rents the auto repair property, and owns
the business. He said that there would not be more than four cars for sale at one time and there would be no signs,
flags, or ramps.
Keith Youngquist also commented on the improvement oftbe appearance of the business in comparison to the former
business at that location. Mr. Randolph said he appreciated that comment and said that he also had heard the previous
business, which had been only auto sales, had not been well maintained. He said that he only sells cars that he
purchases and repairs from customers who do not want to invest in repairs to the auto. He said that he requested the
amendment to the Conditional Use became he was approached by the Secretary of State Police regarding the
occasional sales and he wanted to be sure the sale of automobiles was legal.
Ms. Juracek closed the public hearing at 8:54.
Richard Rogers moved to recommend that Ordinance 5153 be amended to allow auto sales as an accessory use for
Case No, PZ-08-02 with the conditions listed in'the §~aff report. Joseph Dormelly seconded the motion.

Attached to this memorandum is a request from Dennis Miller requesting a 1-year extension of Conditional Use
Ordinance No. 5037. The Conditional Use Ordinance granted the right to construct a 5-unit townhome
development at the SE coruer of Emerson Street and Prospect Avenue.
The petitioner has indicated that he has had difficulty finalizing the infrastructure design related to the project and
therefore needs additional time to complete the project. The outstanding engineering and surveying issues
delaying the project are nearly resolved and therefore the project should move forward in the near furore. Staff
does not object to the extension, however we recommend that it be limited to 6 months, thereby requiring that the

was for the existing facility and was unfortunately turned down by the Cook Count Assessor's office because it
did not meet the 2-year vacancy requirement. The current request is for support for their Class 6 Abatement
application for a proposed $3.5 million investment that they are planning for the facility.
I have attached a cover letter and information about Albany for the Village Board's review and consideration.
Staff and Albany Molecular representatives will be present at the April 16th meeting to further discuss this matter.

Due to the recent increase in large-scale critical incidents across the country, the
Association of Police Social Workers (APSVV) developed the Critical Incident
Management Subcommittee. The Village's Bilingual. Social Worker, Nina Persino, is a
member of this Subcommittee. The purpose of the subcommittee was to examine how
APSW can assist member communities in the delivery of social work/mental health
services during a large-scale, Police;managed critical incident. The Intergovernmental
Police Mental Health Assistance Agreement was developed to provide this coordinated
service. This Agreement is the legal document designed to provide mutual aid within
the police social work network similar to other police major crime mutual aid 'agreements
such as NORTAF and MCAT.
Enclosed is a copy of the Agreement for your review and approval. As you can see, the
Agreement needs to be signed by the Village President, Chief of Police, Village
Manager and Village Clerk. I believe this is an appropriate Agreement for the Village of
Mount Prospect to enter, and I would encourage us to sign the Agreement. If you have

INTERGOVERNMENTAL POLICE MENTAL
HEALTH ASSISTANCE AGREEMENT
The undersigned municipality, Mount Prospect County of Cook ,
pursuant to Article VII, Section 10 of the Illinois Constitution of 1970, the Intergovernmental
Cooperation Act (5 ILCS 220/1 et seq.), and Sections 1-4-6 and 11-1-2.1 of the Illinois
Municipal Code (65 ILCS 5/1-4-6 and 5/11-1-2.1), agrees as follows:
SECTION 1: Purpose of Agreement
This Agreement is made in recognition of the fact that the capabilities of mental health personnel
in local law enforcement organizations are enhanced by having access to regionalized programs
and the assistance of other departments. It is the purpose of this Agreement to enhance access to
mental health assistance in police-managed critical incidence through the imergovernmental
cooperation of the Participating Municipalities.
SECTION 2: Definitions
For purposes of this Agreement, the following terms shall be defined as set forth in this section
as follows:
A. Agreement This Intergovernmental Police Mental Health Assistance Agreement.
B. Participating Municipality Any one or more municipalities that have duly adopted a
resolution authorizing the execution of this Agreement.
C. Police Mental Health Assistance Assistance provided by any Participating Municipality to
any other Participating Municipality, which shall include, but not be limited to, the assignment of
mental health personnel and their designees.
D. Requesting Municipality A Participating Municipality that requests police mental health
assistance pursuant to this Agreement.
E. Aiding Municipality A Participating Municipality that provides police mental health
assistance pursuant to this Agreement.
SECTION 3: Rights of Participating Municipalities
The rights of each Participating Municipality shall be as set forth in this Section and shall be
exercised by and through the actions of the Chief of Police of each respective Participating
Municipality or his/her designee,
A. Any participating Municipality may request police mental health assistance from any one or
more Participating Municipalities when, in the judgment of the Chief of Police or his/her
designee, of the Requesting Municipality such assistance is necessary.
B. Any Participating Municipality may render aid to any one or more Participating
Municipalities to the extent that the mental health professional of the Aiding Municipality is not
required for the delivery of Services within his/her own police jurisdiction. The Chief of Police
of the Aiding Municipality, or his/her designee, will determine the number of personnel available
to the Requesting Municipality.
C. The Aiding Municipality's time commitment shall not exceed 5 days without the approval of
the Chief of Police of that municipality, or his designee.
D. The Chief of Police of the Requesting Municipality, or his/her designee, shall be entitled t°
direct the actions of uny mental health personnel of uny Aiding Municipality providing police
mental health assistance pursuant to this Agreement.
SECTION 4: Authority of Police Mental Health personnel
Any mental health personnel providing police mental health services to a Requesting
Municipality under this agreement shall have the authority to perform the mental health duties as
assigned by the Requesting Municipality and are subject to the direction of the Chief of Police or
his/her designee, of the Requesting Municipality.
SECTION 5: Responsibilities of Participating Municipaiities
The responsibilities of each Participating Municipality shall be as set forth in this Section.
A. Responsibility for Employees Each Participating Municipality shall assume the
responsibility for the actions of its mental health personnel pursuunt to this Agreement, both as to
indemnification of its personnel and to the payment of benefits to such personnel, to the same
extent as such personnel are protected, insured, indemnified and otherwise provided for when
acting within the Participating Municipalities' respective corporate limits.
B. Compensation of Employees. Each Participating Municipality shall be responsible for the
payment of all benefits to all of its mental health personnel acting pursuunt to this Agreement,
including, but not limited to, the payment of wages, salaries, disability payments, pension
benefits, workers compensation claims, and claims for damage to or destruction of equipment
und clothing, und claims for medical expenses.
C. The Illinois Mental Health and Development Disabilities Code and the Illinois Mental Health
Confidentiality Act will be followed. For limited purposes of sharing information und follow-up
services, the Aiding Municipality's mental health personnel will be treated as agents of the
Requesting Municipality for reasons of confidentiality and case coordination.
SECTION 6: General Provisions
A. This Agreement shall be in full force m~d effect and legally binding upon each Participating
Municipality at such time as it is signed and certified by that Participating Municipality.
B. This Agreement may be amended from time to time by resolution of the corporate authorities
of each Participating Municipality. Any amendment not adopted und approved by all
Participating Municipalities shall not be effective. The effective date of any amendment shall be
the date as of which all Participating Municipalities have approved the amendment.
C. This Agreement shall remain in full force and effect and shall bind the Participating
Municipality executing this Agreement until such time as the corporate authorities of said
Participating Municipality adopts a resolution terminating the agreement. Certified copies of
such resolution shall be filed with the clerk of all other Participating Municipalities within thirty
(30) days of its passage.
SECTION 7: Adoption
This mutual aide agreement shall be in full force and in effect with the passage and approval of a
companion ordinance by all participating municipalities, in the manner provided by law, and in
the signing of this agreement by the Village President, City Mayor or Trustees of a municipality.

IN THE
INTERGOVERNMENTAL PERSONNEL BENEFIT COOPERATIVE (IPBC)
Please find attached the proposed resolUtion requesting the extenSiOn of partiCiPation
within the Intergovernmental Personnel Benefit Cooperative (IPBC) for the next three (3)
years, commencing July 1, 2002.
The IPBC is an intergovernmental entity, made-up of twenty-two (22)local municipalities
that purchases health, dental, and life insurance benefits as a cooperative for almost 2,000
employees. One of the advantages of being part of the larger I PBC pool is that the group is
able to negotiate better insurance rates versus a smaller stand-alone employer.
Another advantage of the pooling system is that employers that experience extremely high
claims one year, will benefit from the other employers within the pool, having lower or
moderate claims for that particular year. Essentially there is a sharing of risk, which
theoretically, creates a more'stable insurance environment, hence reducing the possibility
of receiving premium increases of 30% to 50% due to a bad year.
Historically, the insurance rates that the Village of Mount Prospect has experienced over
the last three (3) years have, by and large, followed national insurance trends.
The upcoming 2002/2003 benefit year, will see a 21% increase in our PPO insurance and
a 12% increase for our HMO insurance.
The table below will illustrate the 2002 national insurance tread for both PPO and HMO.

Although the insurance increase the Village will receive for the upcoming 2002/2003
benefit year is slightly higher than the national trend increase for PPO insurance, I believe
we should continue our participation in the IPBC for the next three (3) years. With the
uncertainty and volatility within the health insurance market, participation in the IPBC pool
will help stabilize rate fluctuations and increases.
As published, future health insurance rates are predicted to experience double-digit
increases over the next couple of years, therefore, strategies such as health insurance
pools are important in alleviating the impacts of the national health care market. As we
approach the midpoint of the three (3) year contact in 2004/2005, we will conduct a
complete evaluation of the insurance market and determine the pros and cons of leaving
the IPBC. At that time, we may experience a less volatile health care insurance market.
I recommend the proposed resolution for Village Board approval at the April 16, 2002
meeting.

RESOLUTION NO.
A RESOLUTION EXTENDING THE PERIOD OF PARTICIPATION
IN THE INTERGOVERNMENTAL PERSONNEL BENEFIT COOPERATIVE
FOR A PERIOD OF THREE ADDITIONAL YEARS
WHEREAS, the Village of Mount Prospect, a municipal corporation, is a member of the
Intergovernmental Personnel Benefit Cooperative ("IPBC"), which is an
intergovernmental entity providing employee benefits to the officers and employees of
this municipality; and
WHEREAS, through its' membership in the IPBC, this municipality gains the ability to
achieve economies of scale in the administration of the benefit claims of its employees
and the other benefits of membership provided for in the Contract and By-Laws of the
IPBC; and
WHEREAS, the Contract and by-Laws of the IPBC provide that the IPBC shall operate
in three (3) year terms, with the governing board of each member, including the
governing board of this municipality, being required to pass an ordinance or resolution
agreeing to continue as a member for each new term; and
WHEREAS, failure to approve a timely ordinance or resolution at least sixty (60) days
before the commencement date of a new term shall constitute a withdrawal from the
IPBC; and
WHEREAS, the next three (3) year term of the IPBC commences on July 1,2002; and
WHEREAS, the Village of Mount Prospect desires to express, through the passage of
this Resolution, its intent to continue as a member of the IPBC for the three-year term
commencing on July 1, 2002, provided that an adequate number of other members of
the cooperative, as set forth within the Contract and By-Laws document, also agree to
continue as members for the next term.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, iLLINOIS:
SECTION ONE: The Village of Mount Prospect shall continue as a member of the
Intergovernmental Personnel Benefit Cooperative for a three-year term commencing on
July 1, 2002, in accordance with the Contract and By-Laws of that entity as .they
currently exist or as they may be validly amended in the future.

SECTION TWO: The obligation of this municipality to be a member of the
Intergovernmental Personnel Benefit Cooperative shall obligate this Village to make
financial contributions to the Intergovernmental Personnel Benefit Cooperative only to

SECTION THREE: This Resolution shall be in full force and effect uPon its passage

LIBRARY FINANCING
PURPOSE:
To present for the Village Board's consideration a request to proceed with the issuance of $20.5
million general obligation bonds for the benefit of the Mount Prospect Public Library, and to
authorize the Mayor to execute an intergovernmental agreement between the Village and the
Library providing for the issuance of the bonds and the repayment of principal and interest.
BACKGROUND:
The Village Board passed Ordinance No. 5222 on December 18, 2001, establishing an advisory
referendum for the submission of a public question on the ballot for the March 19, 2002primary
election.
An official canvass of the election results on March 25, 2002 found that the advisory referendum
question passed with 5,831 Yes votes and 3,820 No votes.
Resolution No. 19-02, passed on April 2, 2002, declared the results of the ~i-imary election, and
officially declared the referendum question as passed.
DISCUSSION:
The Library Board is asking the Village to issue $20.5 million of general obligation bonds on
behalf of the Library to allow a major expansion/improvement project to proceed.
Attached hereto is an intergovernmental agreement that would obligate the Village to issue the
bonds and obligate the Library to provide the necessary funds to the Village to cover semi-
annual debt service payments. The primary goal of the agreement from the Village's standpoint
was to ensure that the annual debt service tax levy associated with these bonds could be abated
by the Village using funds provided by the Library. Simply put, we wanted the Library's tax levy
and tax rate, not the Village's, to reflect the repayment of the bond principal and interest.

Annual debt service is estimated at $1,677,184 per year for twenty years. This is a 38%
increase over the $4,417,240 levied for the Library in 2001. I am being told by the Library's
financial consultant that the Library intends on using a portion of the 24% increase in the 2001
Library Operations levy to cover a portion of the tax increase associated with the bond issue.

RECOMMENDATION:

INTERGOVERNMENTAL AGREEMENT
THIS INTERGOVERNMENTAL AGREEMENT is entered into this ~day of
, 2002, by and between the VILLAGE OF MOUNT PROSPECT, ILLINOIS
(hereinafter "the VILLAGE"), an Illinois home rule municipal corporation, and the
MOUNT PROSPECT PUBLIC LIBRARY (hereinafter"the LIBRARY"), an Illinois Village
Public Library.
WHEREAS, Article VII, Section 10, of the Illinois Constitution provides that
units of local government may contract among themselves, to obtain or share
services, to exercise, combine or transfer any power or function in any manner not
prohibited by law or ordinance, and may use their revenues to pay costs related to
intergovernmental activities, and the Illinois Intergovernmental Cooperation Act, and
that one or more public agencies may contract with any one or more other public
agencies to perform any governmental service, activity or undertaking which any of
the public agencies entering into the contract is authorized by law to perform; and
WHEREAS, the LIBRARY, not having the legal authority te directly cause
municipal bonds to be issued, desires the VILLAGE to cause general obligation
bonds to be issued in the amount of $20,500,000 to fund the expansion of and
improvement to the existing public library (the "Project"); and
WHEREAS, the VILLAGE has approved the plan of the LIBRARY for the
construction of the Project; and
WHEREAS, the VILLAGE has agreed to provide for the issuance of general
obligation bonds in the amount of $20,500,000(the "Bonds") to pay the costs of the
Project pursuant to 75 ILCS 5/5-2; and
WHEREAS, the VILLAGE, in return for issuing the Bonds, desires the
LIBRARY, pursuant to 75 ILCS 5~4-7, to assume full responsibility for the repayment
of the bonds, inclusive of principal and interest, and all costs associated with the
bond issue as well as for the construction of the Project; and
WHEREAS, the VILLAGE and the LIBRARY desire a third party trustee to retain
control of the proceeds of the Bonds (the "Bond Proceeds") and that the VILLAGE
shall retain control of the proceeds of the taxes collected for payment of principal
and interest thereon in order to ensure that all federal, state and local laws and
regulations regarding use and distribution of the Bond Proceeds are met; and
WHEREAS, the VILLAGE and the LIBRARY have subsequently entered into
negotiations and, as a result of these negotiations, the VILLAGE and the LIBRARY
have each determined that it is advisable and in their best interests to enter into an
agreement.
NOW, THEREFORE, based on the mutual promises and consideration set forth
herein, the terms and conditions hereof, and other good and valuable consideration,
the receipt and sufficiency of which is hereby acknowledged, the parties hereto
agree as follows:
Section 1. Incorporation of Recitals
The foregoing recitals shall be and are hereby incorporated into and made part
of this Agreement as though they were fully set forth in this Section 1.
Section 2. Issuance of the Bonds
The VILLAGE shall issue its Bonds pursuant to an ordinance (the "Bond
Ordinance"). The proceeds of the Bonds shall be retained in the care and custody of
its Treasurer/Finance Director, who shall pay the legal, fiscal and administrative
costs of issuance and thereafter remit the remainder to the financial institution
provided for in Section 3 of this Agreement and shall do so pursuant to all applicable
federal, state and local laws and regulations. The VILLAGE shall have the right to
select both bond legal counsel and an appropriate financial advisor for the Bond
Issue.
Section 3. Trustee Administrator of Bond Proceeds
The VILLAGE and the LIBRARY shall select an independent financial
institution(the "DEPOSITORY") to retain custody of and administer the Bond
Proceeds during the period that this Agreement remains in force.
Section 4. Payments from Bond Proceeds
The VILLAGE's and the LIBRARY's agreement with the DEPOSITORY shall
provide that the DEPOSITORY shall receive warrants issued by the Treasurer of the
Board of Library Trustees.
The warrants shall be supported by certificates, as required by the Contract
between the LIBRARY and its architect, and shall list items for payments and
payees. The DEPOSITORY shall then distribute to the listed payees the amounts so
listed and certified, in accordance with the terms of the Contract between the
LIBRARY and its Contractor. In addition, the DEPOSITORY shall, upon receipt of the
warrants issued by the Treasurer of the Board of Library Trustees, distribute to the
listed payees the amounts requested as required by the Local Government Prompt
Payment Act, 50 ILCS 505/1, et seq. The warrants shall list for payment any other
items related to the Project as are allowed to be paid from the Bond Proceeds bythe
provision of the Bond Ordinance and the payees. During the period when there are
funds remaining in the Project Fund, the Trustees shall also be required to contract for the
arbitrage rebate calculation each year as required by the United States Internal Revenue
Service. The Treasurer of the Board of Library DEPOSlTORYs shall issue such
warrants in a timely fashion. The VILLAGE does not make any warranty, either
express or implied, that the moneys on deposit in the Project Fund will be sufficient
to pay all costs incurred in connection with the Project. - ~'
Section 5. Investment of Bond Proceeds
The VILLAGE's and the LIBRARY's agreement with the DEPOSITORY shall
provide that the DEPOSITORY shall invest the Bond Proceeds as provided by law
and as directed by the VILLAGE and shall report monthly to the VILLAGE and the
LIBRARY, pursuant to Section 6 of the Intergovernmental Agreement, interest

earnings and expenses pertaining to such investment as such expenses are charged
by any third parties.
Section 6. Custody of Taxes Collected for Debt Service
The LIBRARY shall approve and certify budgets and levy tax extension
determinations in amounts sufficient to cover the repayment of all Principal and
interest on the Bonds issued by the VILLAGE, as well as all costs incurred by the
VILLAGE under Section 8 and Section 9 of this Agreement. The LIBRARY shall hold
monies received from such determinations as they are received from the Cook
County Treasurer and remit the monies to the VILLAGE on a semiannual basis. The
payments shall be due on May 1, and November t, of each year. The VILLAGE shall
also keep in the care and custody of its Treasurer/Finance Director the property
taxes remitted to it which have been collected pursuant to statute for payment of the
principal and interest on the Bonds.
Section 7. Reports
The VILLAGE and the LIBRARY's agreement with the DEPOSITORY shall
provide that the DEPOSITORY shall provide the VILLAGE and the .LIBRARY with
monthly reports containing an accounting of all activity pertaining to the Bond
Proceeds and the Taxes and interest earned thereon which the DEPOSITORY holds
in his or her care and custody pursuant to this Agreement. The DEPOSITORY shall
also be required to report the results of the annual arbitrage rebate calculation as
provided in Section 4 of this Agreement to the VILLAGE and the LIBRARY. Such

reports shall be made and presented in accordance with generally accepted
accounting principles.
Section 8. Surety
The VILLAGE's and the LIBRARY's agreement with the DEPOSITORY shall
provide that the DEPOSITORY shall supply a surety bond to secure the true and
faithful performance of the fiduciary duties pursuant to the terms of this Agreement
in the amount of not less than one hundred percent (100%) of the funds received, as
required by Section 5/4-9 of the Local LibraryAct. Such bond shall be provided by a
surety approved by both the VILLAGE and the LIBRARY, which approval shall not be
unreasonably withheld, and the cost of such surety bond shall be borne by the
LIBRARY.
Section 9. Costs of Bond Issuance and Administration
The LIBRARY shall pay the costs of the Bond Issuance and administrative
costs due to third parties, including but not limited to, attorney's fees, including fees
for bond counsel and fees for the Village Attorney associated with the Bond
Issuance and/or administration, and for underwriter, financial consultant, investment
and arbitrage services where such services are reasonably necessary and
appropriate and the services of the DEPOSITORY. Should arbitrage laws make
rebates necessary and amounts required to be rebated are not available from Bond
Proceeds, the LIBRARY shall provide all additional amounts necessary to meet the
requirements of the law.
Section 10. Termination
This Agreement shall terminate upon the final payment of principal and
interest on the Bonds. The agreement with the DEPOSITORY shall cease upon the
final disposition of moneys in the Project Fund.
Section 11. Complete Understandin.q.
This Agreement sets forth all of the promises, agreements, conditions and
understandings between the parties regarding the subject matter of this Agreement,
and there are no promises, agreements, conditions and understandings, either oral
or written, other than the contents of this Agreement.
Section 12. Bindin.q Effect.
This Agreement shall be binding upon and inure to the benefit of the VILLAGE,
and the LIBRARY, and their respective legal representatives and successors.
Section 13. Partial Invalidity.
The clauses, provisions and sections of this Agreement are deemed by the
parties to be separable and the invalidity of any portion of this Agreement shall not
effect the validity of the remainder. ~ _
Section '14. Notices.
All notices and demands required hereunder shall be in writing and shall be
deemed to have been given or made when delivered personally or when mailed by
registered or certified mail, postage prepaid, addressed as follows:

THE MOUNT PROSPECT LIBRARY FOR THE ISSUANCE
OF GENERAL OBLIGATION BONDS
WHEREAS, a Pdmary Election was held in and for the Village of Mount Prospect
on March 19, 2002; and
WHEREAS, a referendum question was presented to the electors of the Village of
Mount Prospect in said Primary Election, at which time the referendum question
received a greater number of affirmative votes, determining that the Village should
issue general obligation bonds for the renovation and expansion of the Library;
and
WHEREAS, said general obligation bonds shall be issued in an amount not to
exceed $20,500,000, bearing interest at a rate not to exceed six-percent (6%)
per annum; and
WHEREAS, the Village and the Library have negotiated an Intergovemmental
Agreement setting forth the Village's and Library's rights and obligations in
connection with said issue of general obligation bonds, maintenance and

SECTION ONE: That the Board of Trustees of the Village of Mount Prospect do
hereby authorize the Mayor to sign and the Clerk to attest his signature on the
Intergovemmental Agreement between the Village of Mount Prospect and the
Mount Prospect Public Library for the issuance of $20,500,000 in general
obligation bonds as provided for in the Intergovernmental Agreement, attached
hereto and hereby made a part hereof as Exhibit "A".

2002 BUDGET AMENDMENT NO. 1
PURPOSE:
To present a recommendation the annual budget for the fiscal year beginning January 1, 2002 and
ending December 31, 2002 be amended.
BACKGROUND:
Ordinance 5227, adopted December 18, 2001, established the annual budget br the year ending
December 31, 2002.
DISCUSSION:
Governments often find themselves in a position of having to amend their current ~ear's budget to
reflect material variations in revenues and expenditures. Typically, these variations are the result of
timing differences in either the completion of major capital projects or the receipt and disbursement of
certain revenues or expenses.
A proposed ordinance amending the 2002 Annual Budget is attached for the Board's consideration.
This document includes the budget changes ~ou have reviewed and recommended be brought to the
Board.
In total, we are increasing our revenue projections by $77,453 and increasing the budget for
expenditures by $3,269,335. All but a few of the increases to the expenditure budget reflect carry-
overs from the 2001 Budget. Several projects and purchases were not initiated and/or not completed
by year-end as originally expected.
RECOMMENDATION:
It is recommended the Village Board adopt the proposed ordinance amending the 2002 Annual

AN ORDINANCE MAKING CERTAIN AMENDMENTS TO THE ANNUAL
BUDGET ADOPTED FOR THE FISCAL YEAR COMMENCING JANUARY 1, 2002
AND ENDING DECEMBER 31, 2002
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have passed and approved
Ordinance No. 2342 which sets the finances of the Village under the "Budget Officer System"; and
WHEREAS, pursuant to the aforesaid Ordinance and the Statutes of the State of Illinois an annual budget for
the fiscal year commencing January 1, 2002 and ending December 31, 2002 was adopted through the passage
of Ordinance No. 5227 approved by the Corporate Authorities of the Village of Mount Prospect on
December 18, 2001; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have further reviewed
certain additions and changes to the aforesaid budget for the fiscal year beginning January 1, 2002 and
ending December 31, 2002; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect believe the changes, as
specified on the attached January 1, 2002 through December 31, 2002 Budget Amendment No. 1 to be in the
best interest of the Village of Mount Prospect; and
WHEREAS, the Village has now revised the revenue projections or has reserves in each of the Funds in
which the budget is being increased adequate in amount to cover the budget changes reflected in Budget
Amendment No. 1, attached bereto2
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the fiscal year budget for January 1, 2002 through December 31, 2002 for the Village
of Mount Prospect is hereby amended, as detailed on Budget Amendment No. 1 attached hereto.
SECTION TWO: That this ordinance shall be in full fome and effect from and after its passage, approval
and publication in pamphlet form as provided by law.
