HomeMy WebLinkAboutRes 32-86 09/16/1986 RESOLUTION NO. 32-86 A RESOLUTION AUTHORIZING THE EXECUTION OF A GRANT OF EASEMENT AGREEMENT BETWEEN JOHN R. FOSDICK AND THE VILLAGE OF MOUNT PROSPECT (ST. JOHN'S SEWER MAIN) WHEREAS, John R. Fosdick (hereinafter referred to as "Grantor") is the owner of property commonly known as 1026 Linnemann Road, Mount Prospect, Illinois and as owner of the subject property, has agreed to grant an easement to the Village of Mount Prospect (hereinafter referred to as "Grantee"); and WHEREAS, Grantor hereby grants an easement to Grantee for the purpose of the installation, operation, maintenance, relocation, renewal or removal of underground sewer and its appurtenances; and WHEREAS, the property being the subject of this Grant of Easement is legally described on the Plat of Easement, being Exhibit "An to the Grant of Easement, attached hereto and hereby made a part hereof. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Mayor is hereby authorized to sign and the Clerk directed to attest her signature on the Grant of Easement between John F. Fosdick attached hereto and hereby made a part hereof. SECTION TWO: That a certified copy of this Resolution and Grant of Easement shall be recorded in the Office of the Recorder of Deeds or registered with the Registrar of Titles, whichever is applicable. SECTION THREE: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Prospect: Parcell: The East 172.23 feet of the West 788.95 feet of the North 126.46 feet of the South 393.68 feet of the Northeast quarter of Section 14, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. Parcel 2: The Westerly half more or less of Linneman Road as occupied adjacent to Parcel 1. -. Grantor hereby grants an easement to the Village of Mt. Prospect, Illinois, a municipality, its successors and assigns, over, under, across and upon the above described property as shown on the Plat of Easement attached hereto as Exhibit "A" and incorporated herein. The purpose of said easement shall be only for a storm sewer easement for the installation, operation, maintenance, relocation, renewal or removal of underground storm sewer and its appurtenances. No buildings or other structures shall be constructed over the easement area without the written consent of the Grantee. The grade of the easement area shall not be altered in any manner to interfere with the operation and maintenance of the storm sewer. Grantee agrees that, after any maintenance work is performed on any part of the storm sewer lying within the above described parcel, Grantee will restore the surface of the property affected by such work to its previous condition.
