RESOLUTION NO.
33-86
A RESOLUTION SUPPORTING THE NORTHWEST MUNICIPAL CONFERENCE
RELATIVE TO NEGOTIATING A FRANCHISE AGREEMENT WITH
ILLINOIS BELL TELEPHONE
WHEREAS, the Northwest Municipal Conference is a corporate
organization representative of municipalities and townships
chartered within the State of Illinois and the County of Cook¡
and
WHEREAS, Article III, Section 20, of the Constitution of the
State of Illinois, and Chapter 127, paragraphs 741 through 748 of
the Illinois Revised Statutes, authorize and encourage
intergovernmental association and cooperation; and
WHEREAS, the public officials of the Northwest Municipal
Conference represent thirty-six (36) local governmental bodies
and a population of over 950,000 Illinois residents¡ and
WHEREAS, in 1984, the Illinois Bell Telephone Company entered
into three (3) year interim franchise agreements expiring
January 1, 1987, with the member municipalities of the NWMC; and
WHEREAS, it is in the mutual interest of both the Illinois Bell
Telephone Company and municipalities to continue to enter into
franchise agreements; and
WHEREAS, it is economically beneficial for the Illinois Bell
Telephone Company to continue to explore new uses for phone
lines, including: fiber optics, computers, video transmissions,
cellular, interactive, and bypass networks, such that a general
communication franchise needs to be developed; and
WHEREAS, the Illinois Municipal League as the statewide
representative of municipalities will assume the leadership role
in negotiating the terms of a new franchise agreement; and
WHEREAS, the Northwest Municipal Conference supports the Illinois
Municipal League in resolving the issues and disputes which will
arise during the negotiating process.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That as a member of the Northwest Municipal
Conference, the Village of Mount Prospect does support the NWMC
request to the Illinois Municipal League to establish an advisory
group composed of representatives from area councils of
government and downstate municipalities to provide input to the
negotiators.
SECTION TWO:
That during the negotiation proceedings the

following issues be addressed:
That the concept of percentage of gross revenue be
considered in establishing anew franchise fee.
That the franchise agreement should address the cost for
burial of overhead lines in a coordinated approach with
other utilities.
That in the terms of the franchise agreement a mechanism be
provided which would allow for construction of alteration of
the agreement in order that changes in technology can be
reviewed and incorporated as appropriate.
SECTION THREE: That a certified copy of this Resolution be
forwarded to the Northwest Municipal Conference for distribution
to the appropriate agencies.
SECTION FOUR: That this Resolution shall be in full force and
effect from and after its passage and approval in the manner
provided by law.
