BID RESULTS - HOLIDAY TREE LIGHTING
BACKGROUND
Funding has been included in the 2004 budget for contractual installation, and later removal, of
white lights on selected trees in the downtown. We mailed out 23 sets of bid specifications for
this work, and placed a bid notice in the local paper. The specifications describe a two-year
contract, although we reserved the right not to renew the second year if we are not satisfied
with the work done in year one.

DISCUSSION
The low bidder, Arbor Green Ltd, has performed satisfactorily on a holiday tree lighting
contract for us in 2002 and 2003 (as sub-contractors of Planned Lighting). Additionally, they
have satisfactorily worked on our stump removal contract in 2003 and 2004. On p. 289 of the
2004 Budget, $33,380.00 remains in Account #0016104-540962 for White Light Installation.
Based on past experience, we estimate that approximately 2940 strands will need installation
this year. However, we reserve the right to increase the number of strands used to account for
tree growth. Cost to install and later remove 2940 strands would amount to $24,637.00.

BID RECOMMENDATION
I recommend award of a two-year holiday lighting contract to the low bidder, Arbor Green,
Ltd. Year one (1) would be in an amount not to exceed $33,340.00. Year two (2) would be in
the amount approved by the Village Board for the 2005 Budget.

COMMISSIONERS

Under the authority vested in me by §4.202 of the Village Code, I am submitting for your
consent and approval the retention of John C. Broihier, Esq., to serve as Special
Counsel to the Board of Fire and Police Commissioners in matters that may come
before the BOFPC from time to time. Mr. Broihier has extensive experience in providing
legal counsel to numerous Boards of Fire and Police Commissioners in the area. He
has also served as General Counsel for the Illinois Fire and Police Commissioners
Association for over 25 years.
I am confident the appointment of Mr. Broihier will provide the BOFPC with the best
legal representation available. I have consulted with Board Chairman Robert McKillop
and he concurs with the appointment.

Representation of the Mount Prospect Board of Fire and Police Commissioners
Dear Mike:
I enjoyed my meeting with you and Buzz Hill yesterday and want to thank you for the
opportunity to represent the Mt. Prospect Board of Fire and Police Commissioners. As requested,
I am enclosing a short resume with respect to my experience as an attorney representing fire and
police boards in matters involving the hiring, promotion and discipline of fire and police personnel.
As we discussed, my representation ofthe fire and police commission will be on an as needed
basis. Since the board is a member of the Illinois Fire and Police Commissioner's Association, the
members, you, and the chiefs are entitled to call me with questions related to public employment
personnel matters and, to the extent I can answer those questions while on the phone with the caller,
the time involved is charged against my retainer with the Association. Even if I am not selected as
the attomey to represent the board, the foregoing is always an option. If I am called upon to
represent the board in matters involving hearings or litigation, I would provide assistance on a fees
for services basis at the current rate of $200.00/hour. My fees to meet with the commission or
provide written legal opinions, update its rules and regulations would be provided at a lower
rate-$150.00Ihour.

JOHN C. BROIHIER
John is a fonner partner with the firm ofDiLeonardi & Broihier, Ltd., and joined the law
firm of James, Gustafson and Thompson, Ltd., in January, 1999. He is a general practitioner
with a concentration in the area of public employment--particularly the selection, promotion and
discipline of law enforcement and fire service personnel. He has acted as the general counsel for
the Illinois Fire and Police Commissioners Association for more than twenty-seven years and has
represented numerous board of fire and police commissioners, merit commissions, civil service
commissions and several police and fire pension boards in the metropolitan Chicago area and
throughout the State of Illinois. He is the author of the "Commissioner's Manual" distributed by
the Illinois Fire and Police Commissioners Association to its members, has drafted legislation
amending the Board of Fire and Police Commissioners Act and frequently lectures on subjects
related to the selection, promotion and discipline of fire and police personnel.
He also has expertise in the field of corporate law and in both commercial and residential
real estate transactions.
John obtained an undergraduate degree in business administration from 81. Norbert
College, holds a masters degree in business administration from Northern Illinois University and
received his law degree from DePaul University. Prior to becoming a lawyer, John worked as a
systems analyst with the BIS department for the Illinois Bell Telephone Company. He also
served in the U.S. Army from 1968-1971 attaining the rank of Captain. Mr. Broihier served with
distinction in Germany and South Vietnam. He and his wife, Madonna, have four children. John
is an avid reader and likes to golf.
