The Planning & Zoning Commission transmits their recommendation to approve case PZ-36-02, a request for the
following: 1) Map Amendment for 531 S. Douglas Avenue (the "Subject Property"), rezoning the property from
RX Single-Family Residence to RI Single-Family Residence; and 2) the Gettysburg-McKone Subdivision
(creating three lots of record from the single existing lot). The Planning & Zoning Commission heard the request
at their August 26, 2004 meeting.
The Petitioner proposes to rezone the Subject Property from RX Single-Family Residence to RI Single-Family
Residence. The proposed rezoning to the RI District will require smaller lot sizes, thus allowing the petitioner to
subdivide the existing lot into three new lots. The existing residence would be demolished and three new homes
would be constructed. The Petitioner is not seeking relief from the Village Code and the proposed improvements
would comply with all Village regulations.
The Planning & Zoning Commission discussed the request briefly. The P&Z noted that a cul-de-sac would be
built according to Village code, that Lawrence would not be extended, and that the Petitioner was developing the
properties across the street (in Arlington Heights). The Planning & Zoning Commission members voted 6-1 to
recommend that the Village Board approve the request to rezone the Subject Property from RX to Rl and
approve the Gettysburg-McKone Subdivision, Cas~ No. PZ-36-02, subject to the following conditions:
I. The plans be revised to include a 100' pavement diameter; and
2. The proposed development shall provide a total minimum easement width of IS' to accommodate the
installation and maintenance of a water main along the south property line of Lot 3.
Please forward this memorandum and attachments to the Village Board for their review and consideration at their
September 7, 2004 meeting. Staff will be present to answer any questions related to this matter.

Chairperson Arlene Juracek called the meeting to order at 7:30 p.m. Joe Donnelly made a motion to approve the
minutes of the June 24, seconded by Rich Rogers. The minutes were approved 6-0 with Matt Sledz abstaining from
voting. Joe Donnelly made a motion to approve the minutes of the July 15, 2004 meetings with minor corrections,
seconded by Keith Youngquist. The minutes were approved 5-0 with Matt Sledz and Chairperson Juracek abstaining
from voting. At 7:31, Ms. Jura'cek introduced Case No. PZ-36-02, a request for: 1) Map Amendment; and 2) Plat of
Subdivision. She noted that the request would be Village Board final.
Judy Connolly, Senior Planner, presented the case. She said that the Subject Property is located on the east side of
Douglas Avenue, between Haven Street and Golf Road, and that it contains a single-family residence with related
improvements. The Subject Property is zoned RX Single Family Residence and is bordered by the R I district to the
east and single family residential to the north and west (Arlington Heights) and a multifamily development to the
south (Arlington Heights).
Ms. Connolly said that the Petitioner proposes to rezone the Subject Property from RX to R 1. The RX District
requires a minimum lot size of 17,500 square feet while the Rl District requires 8,125 square feet. The Petitioner
would like to demolish the existing residence and resubdivide the Subject Property into three lots. The proposed lots
would exceed the RI District's minimum lot size requirements, and the homes would meet the applicable zoning
regulations. She clarified that there was a typo in the Staff Report and reported that the minimum lot width for the RX
district is 75' and 65' for the RI district. Also, the minimum lot depth for both districts is 125'.
Ms. Connolly reported that the Village's Comprehensive Plan and Land Use Map designate the Subject Property as
Single-Family Residence. She said that the Petitioner's proposed Map Amendment and Resubdivision are in keeping
with the Village's Comprehensive Plan and Land Use Map. In addition, the Petitioner is in the process of
redeveloping the property on the west side of Douglas A venue, which is located within Arlington Heights. This
development recently completed the Arlington Heights Subdivision process and one of the homes is under
construction.
Other Departments reviewed the case and the Fire Department noted that the proposed homes and site would have to
be constructed according to the Village's regulations, which include but are not limited to the installation of fire

hydrants and fire sprinklers. The Engineering Division had no objections to the rezoning, but noted that the plat
needed minor revisions before it could be signed
Ms. Connolly summarized the standards for Map Amendments, which are listed in the Zoning Ordinance. She said
that the Subject Property is adjacent to existing single-family residences and north of a multi-family development
located in Arlington Heights. The proposed rezoning will be in keeping with the surrounding area. The proposal
meets the standards for a Map Amendment because it is compatible with existing properties within the general area of
the Subject Property. The proposal is consistent with the general development trend and meets the Village's
Comprehensive Plan requirements.
Ms. Connolly reviewed the second part of the case and said that the Petitioner seeks to create three lots of record by
subdividing the Subject Property. The proposed plat is part of PZ-36-02, a Map Amendment request. The plat was
prepared in accordance with the Development Code requirements, but required minor modifications before it could be
signed. She said that the Petitioner made the required changes and that the plat complied with Village Code
requirements subject to the plans showing a 100' pavement diameter and that the Petitioner provide a total minimum
easement width of 15' to accommodate the installation and maintenance of the water main along the south property
line of Lot 3.
Based on these findings, Staff recommends that the Planning & Zoning Commission make a recommendation to the
Village Board to approve a Map Amendment and Plat of Resubdivision for the property located at 531 S. Douglas
Avenue, Case No. PZ-36-02. She said that the Village Board's decision is final for this case.
The Planning & Zoning Commission asked Ms. Connolly general questions regarding the project and then asked the
Petitioner to present the request.
Larry McKone, 18 W. Mundhank Road, South Barrington, IL, was sworn in. He reported that he is in the process of
obtaining a 10' easement on the adjacent property, which belongs to the Arlington Heights Park District. However, if
they could not reach an agreement, he would prepare a plat of correction that would reflect the required IS' easement
entirely on Lot 3. He noted that the cul-de-sac would include a 100' pavement diameter as required by the Village
Code. There was minimal discussion regarding the location of the property and the development of the surrounding
properties.
Ms. Juracek asked if anyone in the audience had questions and as there were none, she closed the hearing at 7:42 pm.
Richard Rogers made a motion that the Village Board approve the proposed Map Amendment and Plat of Subdivision
subject to the cul-de-sac including a 100' pavement diameter and Lot 3 include a 15' (total) easement. Merrill Cotten
seconded the motion.

BACKGROUND
A public hearing has been scheduled for the August 26, 2004 Planning & Zoning Commission meeting to review
the application by Gettysburg Development (the "Petitioner") regarding the property located at 531 S. Douglas
A venue (the "Subject Property"). The Petitioner has requested approval of: I) a Map Amendment to rezone the
Subject Property from RX Single-Family to RI Single-Family; and 2) Resubdivision of the existing lot into 3-lots.
The P&Z hearing was properly noticed in the August II, 2004 edition of the Journal Topics Newspaper. In
addition, Staff has completed the required written notice to property owners within 250-feet and posted a Public
Hearing sign on the Subject Property.
PROPERTY DESCRIPTION
The Subject Property is located on the east side of Douglas Avenue, between Haven Street and Golf Road, and
contains a single-family residence with related improvements. The Subject Property is zoned RX Single Family
Residence and is bordered by the RI district to the east and single family residential to the north and west
(Arlington Heights) and a multifamily development to the south (Arlington Heights).
SUMMARY OF PROPOSAL
The Petitioner proposes to rezone the Subject Property from RX to Rl. The RX District requires a minimum lot
size of 17,500 square feet while the RI District requires 8,125 square feet. The Petitioner would like to demolish
the existing residence and resubdividc the Subject Property into three lots. The proposed lots would exceed the
RI District's minimum lot size requirements, and the homes would meet the applicable zoning regulations.
GENERAL ZONING COMPLIANCE
As previously noted, the proposed lots would exceed the Rl District's minimum lot size requirement and the
houses would comply with the Rl District's bulk regulations. The table on the next page compares the RX and
Rl Districts.

Comprehensive Plan Designation and Zoning
The Village's Comprehensive Plan and Land Use Map designate the Subject Property as Single-Family
Residence. The Petitioner's proposed Map Amendment and Resubdivision are in keeping with the Village's
Comprehensive PIan and Land Use Map, which designate the Subject Property as Single-Family Residence. In
addition, the Petitioner is in the process of redeveloping the property on the west side of Douglas Avenue, which
is located within Arlington Heights. This development recently completed the Arlington Heights Subdivision
process and one of the homes is under construction.
Other Department Comments
The Fire Department noted that the proposed homes and site would have to be constructed according to the
Village's regulations, which include but are not limited to the installation of fire hydrants and fire sprinklers. The
Engineering Division had no objections to the rezoning, but noted that the plat needed minor revisions before it
could be signed.
MAP AMENDMENT STANDARDS
The standards for Map Amendments are listed in Section 14.203.D.8.a of the Village Zoning Ordinance. When a
Map Amendment is proposed, the Planning and Zoning Commission shall make findings based upon the evidence
presented to it in each specific case with respect to, but not limited to, the following matters:
.
Compatibility with existing uses and zoning classifications of property within the general area of
the property in question;
.
The compatibility of the surrounding property with the pennitted uses listed in the proposed
zoning classification;
.
The suitability of the property in question to the uses pennitted under the existing and proposed
zoning classifications;
.
Consistency with the trend of development in the general area of the property in question, and the
objectives of the current Comprehensive Plan for the Village.

The Subject Property is adjacent to existing single-family residences and north of a multi-family development
located in Arlington Heights. The proposed rezoning will be in keeping with the surrounding area. The proposal
meets the standards for a Map Amendment because it is compatible with existing properties within the general
area of the Subject Property. The proposal is consistent with the general development trend and meets the
Village's Comprehensive Plan requirements.
PLA T OF RESUBDIVISION
The Petitioner seeks to create three lots of record by subdividing the Subject Property. The proposed plat is part
of PZ-36-02, a Map Amendment request. The plat was prepared in accordance with the Development Code
requirements, but requires minor modifications before it may be signed. Staff notified the Petitioner of the
required modifications and the Petitioner agreed to make the changes and submit a revised plat prior to the August
P&Z meeting.
RECOMMENDA TION
The proposed Map Amendment and Plat of Resubdivision meet the standards listed in the Zoning Ordinance and
the Development Code subject to the following revisions:
.
Show a 100' pavement diameter;
Label the easements as being for utilities and drainage;
The signature block for the Plan Commission certificate should be noted as for the Planning and
Zoning Commission; and

Provide a total minimum easement width of 15' to accommodate the installation and maintenance of
the water main along the south property line of Lot 3.
Based on these findings, Staff recommends that the Planning & Zoning Commission make a recommendation to
the Village Board to approve a Map Amendment and Plat of Resubdivision for the property located at 531 S.
Douglas Avenue, Case No. PZ-36-02. The Village Board's decision is final for this case.

AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP
OF THE VILLAGE OF MOUNT PROSPECT
FOR PROPERTY LOCATED AT 531 SOUTH DOUGLAS AVENUE
WHEREAS, the Larry McKone (hereinafter referred to as "Petitioner), has filed an
application to rezone certain property located at 531 South Douglas Avenue (hereinafter
referred to as "Subject Property'), and legally described as follows:
Property Index Number: 08-10-301-019-0000
Gettysburg-McKone Subdivision of part of the East % of the Southwest % of Sec.
10, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook
County, Illinois;
and
WHEREAS, the Petitioner has requested the Subject Property be rezoned from R-X
(Single Family Residence-large lots) to R-1 (Single Family Residence-standard lots); and
WHEREAS, a Public Hearing was held on the request for rezoning being the subject of PZ-
36-02, before the Planning and Zoning Commission of the Village of Mount Prospect on

considered the request being the subject of PZ-36-02 and have determined that the best
interests of the Village of Mount Prospect would be served by granting said request.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF

A RESOLUTION APPROVING A FINAL PLAT OF RESUBDIVISION
FOR PROPERTY LOCATED AT 531 SOUTH DOUGLAS AVENUE
WHEREAS, the Petitioner, Larry McKone, has requested approval of a Final Plat of Resubdivision
for the purpose of creating three lots of record by subdividing one existing lot;
WHEREAS, the Planning and Zoning Commission has recommended approval of the subdivision.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

CHAPTER 18
OF THE VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: A new Section 18.1320, entitled "Municipal Parking Garage Restrictions,"
shall be inserted into Chapter 18 of the Mount Prospect Village Code, to be and read as follows,
with the remaining Sections of Chapter 18 to be renumbered consecutively:
18.1320: MUNICIPAL PARKING GARAGE RESTRICTIONS:
'It shall be unlawful to park any motor vehicle in the Municipal Parking Garage in
violation of the restrictions designated in any area set aside by the village manager,
signposted and included on the schedules listed below:
A. Four Hour Parking: Between the hours of 6:00 a.m. and 6:00 p.m., no motor
vehicle shall be parked more than four (4) hours on any day in any area so posted.
B.
Permit Parking:
i. The Village Manager, or his designee, shall establish and maintain a
permit parking system to authorize parking within certain areas of the Municipal
Parking Garage, subject to such time or other appropriate restrictions as he
determines to be necessary. Individuals eligible to receive such permits may
include, but are not limited to, employees of, and persons providing services to,
the Village of Mount Prospect or the Mount Prospect Municipal Library, as well
as individuals, who work primarily in the downtown area and whose parking in
the garage will reduce downtown parking congestion.
ii. No motor vehicle shall be parked within a posted permit parking area
without displaying a valid permit or otherwise complying with the restrictions
imposed by said permit.
c.
No parking shall be permitted within the Municipal Parking Garage between the
hours of2:00 a.m. and 6:00 a.m. on any day.
D.
No person shall remain within or outside a parked motor vehicle within the
Municipal Parking Garage, except for the time necessary to park or remove the
vehicle, unless in the public interest and specifically approved by the Village
Manager, or designee. Loitering shall not be permitted.
SECTION 2: This Ordinance shall be in full force and effect from and after its passage,

VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: A new subsection E shall be inserted into Section 23.302, entitled "Specifically
Enumerated Trespasses," of Article III, Chapter 23 of the Mount Prospect Village Code, to be
and read as follows, with the remaining subsections to be relettered consecutively:
E. The use of skateboards, roller blades, roller skates, and bicycles in the Municipal Parking
Garage, and any other use thereat not consistent with the parking of a registered motor
vehicle, but excluding the use of devices necessary for disabled person, such as wheel chairs,
or the use of bicycles or other uses in any area specifically designated for such use. The
ramps, drives, and parking areas located within the Municipal Parking Garage are for
Authorized Use Only, which authorized use is the parking of motor vehicles evidencing a
valid registration from the State of Illinois or any other state or country.
SECTION 2: This Ordinance shall be in full force and effect from and after its passage,

NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS)
SUBJECT:
On February 28, 2004 President Bush signed Executive Order HSPD-5 that directs the
Department of Homeland Security to develop a National Incident Management System
(NIMS) that will serve as the nation's policy for how federal, state, and local governments
interact in the event of a national emergency. This Executive Order requires local
government to pass a resolution indicating that they intend to work towards becoming
NIMS compliant. We urge Village Board support and passage of this resolution. Failure to
pass this resolution will greatly impact our ability to receive homeland security grants. Both
police and fire departments have been successful in receiving grant money and have plans
for future grant opportunities.
More About NIMS
NIMS establishes standardized incident management processes, protocols, and
procedures that all responders -- Federal, state, tribal, and local -- will use to coordinate
and conduct response actions. Responders using the same standardized procedures will
all share a common focus, and will be able to place full emphasis on incident management
when a homeland security incident occurs whether terrorism or natural disaster. In addition,
national preparedness and readiness in responding to and recovering from an incident is
enhanced since all of the Nation's emergency teams and authorities are using a common
language and set of procedures. .

Local Adoption of National Incident Management System (NIMS)
The Emergency Preparedness Task Force of the Metropolitan Mayors Caucus met with
representatives of the Illinois Terrorism TaskForce on Monday, August 9. Many issues were
discussed, but there was one in particular that we wanted to make you aware of so you do not
jeopardize your community's future ability to secure homeland security grants from the
federal government in the future.
President Bush signed an Executive Order in February that directed the Department of Homeland
Security to develop a National Incident Management System (NIMS) that will serve as the nation's
policy for how federal, state and local governments interact in the event of a national emergency or
an attack. The Executive Order states that all state and local governments must pass a resolution
by October 1, 2004 indicating that they intend to work toward becoming NIMS compliant.
The Emergency Preparedness Task Force was informed that the Executive Order authorizes all federal
departments and agencies to make adoption of this resolution a requirement, to the extent permitted by
law, for providing federal preparedness assistance. In other words, if states, counties and municipalities
do not pass a resolution stating that they intend to become NIMS certified, they will be precluded from
getting federal homeland security assistance of any kind after October 1, 2004.
Many of the members of our Task Force were unaware of this Executive Order and its ramifications.
Fortunately, the Illinois Law Enforcement Alarm System (ILEAS) has drafted a model resolution that
addresses this requirement. A copy of it accompanies this memo. The Task Force recommends that
you adopt this resolution at your September Board or Council meetings in order to protect your
community's ability to secure federal homeland security funding in the future.
Please note that your community is not required to have a plan by October 1, 2004 that is NIMS
compliant. You must merely state your intentions to become compliant in the resolution. The Task
Force further suggests that you consult with your public safety staff on how it can become NIMS
certified.

OF THE NATIONAL INCIDENT MANAGEMENT SYSTEM
WHEREAS, emergency response to critical incidents, whether natural or manmade, requires
integrated professional management; and
WHEREAS, unified command of such incidents is recognized as the management model to
maximize the public safety response; and
WHEREAS, the National Incident Management System, (hereinafter referred to as "NIMS') , has
been identified by the federal government as being the requisite emergency management system
for all political subdivisions; and
WHEREAS, failure to adopt NIMS as the requisite emergency management system may preclude
reimbursement to the political subdivision for costs expended during and after a declared
emergency or disaster and for training and preparation for such disasters or emergencies.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Board of Trustees of the Village of Mount Prospect do hereby adopt

As you are aware, each year the Northwest Municipal Conference hosts two vehicle auctions in
the fall. This year the Village of Mount Prospect will be hosting the first auction on October 9,
2004, at the Public Works Facility. Hosting this auction proves to be a great benefit to the
Village and we have hosted the auction for several years. There is a 5% administration fee
charged to the member communities, but the host community is only charged a 2.5%
administration fee,
The Village will have ten (10) cars, six (6) trucks, two (2) vans and two (2) pieces of
miscellaneous equipment that have been replaced and are available for the above-mentioned
auction.
Attached is an ordinance declaring the eighteen retired vehicles and two pieces of equipment
surplus, With your concurrence, I would like to present this ordinance to the Mayor and Board of
Trustees for their consideration at the September 7, 2004 Village Board Meeting.

PROPERTY OWNED BY THE VILLAGE OF MOUNT PROSPECT
WHEREAS, in the opinion of at least three-fourths of the corporate authorities of the
Village of Mount Prospect, Cook County, Illinois, it has been determined that it is no
longer necessary, useful, or in the best interest of the Village of Mount Prospect to
retain the personal property specified herein; and
WHEREAS, it has been determined by the President and Board of Trustees of the
Village of Mount Prospect that the best interests of the Village would be served by
the sale of the personal property at a public auction conducted by the Northwest
Municipal Conference, which auction will be held on Saturday, October 9, 2004
at 11 :00 AM. at the Mount Prospect Public Works Facility, 1700 W. Central Road,
Mount Prospect, Illinois.
