ORDINANCE NO. 5442
AN ORDINANCE VACATING CERTAIN PROPERTY (PUBLIC RIGHT OF WAY)
OWNED BY THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Village of Mount Prospect is an Illinois Home Rule Municipality; and
WHEREAS, the corporate authorities of the Village of Mount Prospect have determined
that the best interests of the Village of Mount Prospect would be served by vacating that
portion of unimproved right of way, legally described as follows:
That part of a public street, known as S. Kenilworth Avenue, lying South
of the North line of lots 15 and 16 extended and lying North of the South
line of Lots 15 and 16 extended in Northwest Hills Country Club, a
Subdivsion of parts of the Southwest % of Section 11, Township 41
North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois
generally located at Kenilworth Avenue, Mount Prospect, Illinois; and
WHEREAS, the public right of way being the subject of this Ordinance shall benefit
adjacent property owners; and
WHEREAS, the Village of Mount Prospect shall benefit by receiving fair market value
for the right of way; and
WHEREAS, the corporate authorities of the Village of Mount Prospect have determined
that the Village of Mount Prospect has no need for that portion of right of way being the
subject of this Resolution, and that the best interests of the Village will be served by
selling the vacated right of way to the owner of Lot 1 in the Viken's Subdivision.
NOW, THEREFORE, BE IT ORDAINED, BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
ACTING IN THE EXERCISE OF THEIR HOME RULE POWER:
SECTION ONE: The corporate authorities of the Village of Mount Prospect have
determined that the best interests of the Village would be served by vacating the public
right of way legally described above and it is hereby vacated.

SECTION TWO: Upon passage and approval of this Ordinance by the appropriate vote
of the corporate authorities, the Village Clerk is hereby authorized and directed to file a
certified copy of this Ordinance, together with a copy of the Viken Plat of Resubdivision
indicating the vacation parcel being the subject of this Ordinance, with the Cook County
Recorder of Deeds.
SECTION THREE: The selling price of $285,000 is at least the equivalent of the fair
market value of the portion of the right of way being vacated.
SECTION FOUR:
This Ordinance is subject to the following condition:
1.
The subject property and adjoining land included in the Viken Plat of
Resubdivision shall maintain a minimum forty-foot front yard setback.
SECTION FIVE: That this Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphlet form in the manner provided by law
and at such time as the purchaser has paid $285,000 to the Village of Mount Prospect.
