INVOCATION INVOCATION Trustee Juracek gave the Invocation. MINUTES APPROVAL OF MINUTES Trustee Polit, seconded by Trustee Juracek, moved to defer approval of the September 6, 2011 regular Village Board meeting minutes until the October 4, 2011 Village Board meeting. Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit Nays: None Motion carried. FINANCIAL REPORT FINANCIAL REPORT AND APPROVE BILLS AND APPROVE Mayor Wilks stated the next item on the agenda, "FINANCIAL REPORT AND APPROVE BILLS BILLS" was noted by an asterisk, and unless there was a request to remove an item(s), all items further listed in that manner would be considered with one (1) vote, as business item "IX. Proclamation: "BREAST CANCER AWARENESS MONTH," OCTOBER 2011 BREAST CANCER Mayor Wilks presented the proclamation to the following individuals who have contributed AWARENESS significantly to local efforts to generate public awareness and funding for this cause. MONTH Ms. Cathy Bratu — Police Department Coordinates the "Save Lids,To Save Lives, Yoplait "pink" lid collection for all Village departments and the community. Collection locations — Public Safety Building and Village Hall. Ms. Tarina Wimmer — Special Events Commission Ms. Wimmer coordinated the Village's Adopt A Block program in support of the Susan G. Komen walk. The participants walk through Mount Prospect and are so appreciative of the support demonstrated by the entire community; residents, Police, Fire and Village Administration. The following employees are celebrating quinquennial anniversaries with the Village this year. Mayor Wilks and Public Works Director Sean Dorsey recognized those in attendance and presented each with a plaque or certificate. Village Manager Michael Janonis and Mayor Wilks also recognized Public Works Director Sean Dorsey for his twenty (20) years of service. Amend Chapter 13; Little America Restaurant, d /b /a Little America Restaurant Mayor Wilks presented for a first (1 reading an ordinance amending Chapter 13 (Alcoholic 13 (ALCOHOLIC Liquors) of the Mount Prospect Village Code. LIQUORS) This ordinance amends the Village Code by decreasing the number of Class "F -1" liquor licenses by one (1) issued to Little America Restaurant, 299 West Central Road. APPOINTMENTS APPOINTMENTS None. CITIZENS TO BE COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD HEARD Mount Prospect Firefighter Mike Ghawaly presented a $1,000 donation to Human Services Deputy Director Jan Abernethy and Social Worker Nina Persino to assist residents who are struggling financially. The money was donated by Mount Prospect Firefighters Union Local 4119; the local union host fundraisers for various causes. Ms. Abernethy thanked the Firefighters Union and said the money would be used for the Village's Circuit Breaker program. State cutbacks have left a number of people without money to pay for medication and premiums; the money will be used to help residents pay for medication and premiums. Mount Prospect Firefighter Kevin Swat reported on the August 19 Fill the Boot for Muscular Dystrophy fundraiser. Twenty -five (25) members of the Mount Prospect Firefighters Union participated in the event; $4,000 was collected. The money collected helped twenty -five (25) Mount Prospect families in need of assistance. A total of $880,000 was collected by firefighters in Illinois and $28 million nationwide. Mr. Swat thanked the Village Board and Police Chief John Malcolm for their support of the program. Mr. Bob Tomasello Mount Prospect Jaycees Minutes of the Regular Meeting Page 2 of 6 September 20, 2011 of the Mayor and Board of Trustees of the Village of Mount Prospect Mr. Tomasello requested Village Board approval to waive the Village fees /permits for the Jaycees Halloween fundraiser; a family friendly Halloween Pumpkin Patch and maze. The event will be held in the vacant lot across from Village Hall from October 10 — October 31 maze will only be open on weekends. Mr. Tomasello stated the organization has received permission from the property owner and is working with the appropriate Village staff to ensure compliance with Village codes. Mr. Tomasello stated like all Jaycee fundraising projects the money is used to support local programs and projects. As part of the Halloween fundraiser, the Jaycees will be collecting non - perishable food for the Village's food pantry. Village Manager Janonis stated the Village had worked with the Jaycees in trying to find an alternative site after losing their long- standing location for their annual Memorial Day carnival. Regrettably no site was found for the 2011 carnival; Norwood agreed to provide the venue for the organization to conduct their Halloween fundraiser. Trustee Hoefert, seconded by Trustee Juracek, moved for approval to waive required fees and permits for the Jaycee Halloween project. CONSENT AGENDA CONSENT AGENDA Trustee Hoefert, seconded by Trustee Polit, moved to approve the following business items: MONTHLY REPORT 1. Monthly Financial Report — August 2011 & APPROVE BILLS 2. Bills dated September 1 to September 14, 2011 3. Request Village Board approval to accept bid for HVAC Maintenance Contract in an VBA 37 -11 amount not to exceed $43,700. 4. Request Village Board approval to accept 2011/2012 State of Illinois Joint VBA 38 -11 Purchasing Program results for road salt at a unit cost not to exceed $60.41 per ton. PZ- 20 -11, 999 North Elmhurst Road, Casto Lifestyle Properties An ordinance granting a Variation to increase illumination levels for an electronic message center. Mayor Wilks presented for a second (2 reading an ordinance granting a Variation to increase illumination levels for an electronic message center for property located at 999 North Elmhurst Road. This ordinance grants a Variation to increase illumination levels for an electronic message center from 5,000 nits to 10,000 during daylight hours. The Planning and Zoning Commission recommended denial of the Variation by a vote of 4 -2; this ordinance requires a super majority vote for approval. Community Development Director William Cooney provided an overview of the Petitioner's request and discussion at the September 6, 2011 Village Board meeting regarding illumination levels. Mr. Cooney stated the Petitioner brought a portable display board to the September 10 Coffee with Council meeting to demonstrate how 10,000 nits during daylight hours would appear. Minutes of the Regular Meeting Page 3 of 6 September 20, 2011 of the Mayor and Board of Trustees of the Village of Mount Prospect With the sign's ability to adjust to weather factors he noted the use of 10,000 nits would be rare. He stated visualization of the proposed lighting level was beneficial for consideration of the Petitioner's request. Mayor Wilks stated having the demonstration at Coffee with Council allowed residents as well as members of the Village Board in attendance to see the proposed lighting level during daylight hours. Trustee Juracek stated having the demonstration on a sunny day was especially beneficial. Sign was very readable; not obtrusive. She noted the Planning and Zoning Commission did not have the benefit of seeing the sign demonstration before making their recommendation. New technology of signs suggests a review of the current sign regulations should be conducted. Trustee Polit stated he too found the lighting level acceptable; not blinding. He also recommended the Village Code be reviewed and amended; raise the level of nits and also look at modifying low end regulations. Trustee Juracek, seconded by Trustee Polit, moved for approval of Ordinance No. 5876: AN ORDINANCE GRANTING A VARIATION (INCREASE ILLUMINATION LEVELS ORD 5876 FOR THE ELECTRONIC MESSAGE CENTER) FOR PROPERTY LOCATED AT 999 NORTH ELMHURST ROAD Upon roll call: Ayes: Hoefert, Juracek, Korn, Matuszak, Polit Nays: None Motion carried. An ordinance amending Chapter 4 (Appointive Village Officers) Appendix A- Division II, (Fees, Rates and Taxes) and Chapter 22 (Flood Plain Regulations) of the Village Code AMEND CHAPTER 4 (APPOINTIVE Mayor Wilks presented for a first (1 reading an ordinance amending Chapter 4 (Appointive VILLAGE Village Officers) Appendix A- Division II, (Fees, Rates and Taxes) and Chapter 22 (Flood OFFICERS,) AND Plain Regulations) of the Village Code. APPENCIX A — DIVISION II (FEES, Village Manager Janonis stated the ordinance will update the Village Code to accurately RATES AND TAXES) reflect the Village's Fire Department operations, by replacing the Department of Emergency AND CHAPTER 22 Services and Disaster with the current Emergency Management Agency. PERSONAL PROPERTY OWNED Mayor Wilks presented for a first (1 reading an ordinance authorizing the sale of certain BY THE VILLAGE personal property owned by the Village of Mount Prospect. This ordinance allows the Village OF MOUNT to sell its surplus items using one (1) of two (2) options; live public auction or GovDeals PROSPECT internet auction. Village Manager Janonis stated this ordinance is straightforward; authorizes the sale of property determined to be surplus. Trustee Polit stated Village officials and employees are not allowed to participate in the auction or internet sale of surplus items. MANAGER'S VILLAGE MANAGER'S REPORT REPORT Items A. and B. under the Manager's report were approved under the Consent Agenda. Mayor Wilks • Recognized the Lions Club for their hard work and willingness to always help no matter what the event or task. • Mount Prospect Sister Cities Commission was awarded Sister City of the Year Award at the 2011 IML Conference. Minutes of the Regular Meeting Page 5 of 6 September 20, 2011 of the Mayor and Board of Trustees of the Village of Mount Prospect Mayor Wilks stated the reason the Mount Prospect organization is able to remain solvent is because all members pay their own costs for related trips and activities. Thanked Village Manager Janonis, Fire Chief Malcolm and all staff for organization of the 911 Ceremony. Mayor Wilks stated at the event, ten (10) year old Sarah Predovitch presented the Mayor with the poem she had written in honor of the 911 tragedy. She requested Chief Malcolm invite Miss Predovitch to the Village Board meeting when the Fire Department will be recognized (November 1 to read her poem. CLOSED SESSION CLOSED SESSION Mayor Wilks asked for a motion to enter Closed to discuss: PERSONNEL 5 ILCS 120/2 (c) (1) -The appointment, employment, compensation, discipline performance, or dismissal of specific employees of the public body, including hearing testimony on a complaint lodged against an employee to determine its validity. Trustee Hoefert, seconded by Trustee Juracek, moved to meet in Closed Session to discuss PERSONNEL 51LCS 120/2 (c) (1), PERSONNEL 5 ILCS 120/2 (c) (2) and REVIEW OF CLOSED MINUTES 5 ILCS 120/2.06 (c) (21).
