ORDINANCE NO. 3718 AN ORDINANCE MODIFYING SECTIONS OF CHAPTER 16 ENTITLED "DEVELOPMENT CODE" OF THE VILLAGE CODE OF MOUNT PROSPECT WHEREAS, the Plan Commission of the Village of Mount Prospect, Cook County, Illinois, has reviewed the proposed modifications to Chapter 16, Development Code, of the Village Code of Mount Prospect for property commonly known as The Simonsen's Nursery, more fully described in Exhibit A attached hereto; and WHEREAS, the Plan Commission has forwarded its recommendations relative to modifications to Chapter 16, Development Code, to the President and Board of Trustees, which recommendations have been considered at a regular meeting of the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined the best interests of the Village of Mount Prospect will be attained by the adoption of the recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That modifications from Chapter 16 entitled "Development Code" of the Village Code of Mount Prospect are hereby granted, for the property being the subject of this Ordinance, as follows: That Section 16.403 (A) (5) (c) requiring the pavement bulb of a cul de sac to be one hundred foot (100') in diameter is hereby modified to permit the bulb of the de sacs to be ninety six feet (96') and the right-of-way diameter to be one hundred twenty feet (120') where one hundred feet (100') will be permitted. Ee That Section 16.403 (A) (9) requiring sidewalks on the bulb of any cut de sac is hereby waived. That Section 16.403.A.5 providing for a maximum length of a cul de sac of five hundred feet (500') is hereby modified to permit the a maximum of five hundred thirty five feet (535'). That Section 16.403.A.2 requiring the pavement width of a minor residential cul de sac of twenty-eight feet (28') and a right-of-way width of sixty-six feet (66') is hereby modified to permit a pavement width of twenty-six feet (26') and right-of-way width of fifty-six feet (56'). That Section 16.403.A.8.f is hereby modified to allow for a fifty foot (50') distance between reverse curves instead of the one hundred foot (100') distance required. That Section 16.403.C.l.a is hereby modified to allow a block length of three thousand feet (3,000') instead of the one thousand five hundred feet (1,500') required. That Section 16.403.C.2.a is hereby modified to a six foot (6') high board on board fence to be installed on lots abutting arterial instead of the required planting screens. allow hapter Page 2 o~ That Section 16.403.C.2.e.(1) is hereby modified to allow for one hundred fifteen feet (115') deep lots instead of one hundred twenty feet (120') required, and one hundred forty feet (140') adjacent to arterial, rights-of-way and shopping centers. That Section 16.403.C.2.g is hereby modified to allow lots on a cul de sac to have lot lines that are not radial to the bulb. That Section 16.403.A.5 is hereby modified to allow six (6) lots on the bulb of a cul de sac instead of the five (5) permitted. That Section 16.403.A.3.a which requires a tangent of one hundred feet (100') at intersections shall be reduced to fifty feet (50') for the local street intersections with Kensington and Wolf Roads. SECTION TWO: That this Ordinance effect from and after its passage, pamphlet form as provided by law. shall be in full force and approval and publication in AYES: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg NAYS: None ABSENT: None PASSED and APPROVED this l~th day of November , 1986.
