AN ORDINANCE GRANTING A VARIATION FOR THE
PROPERTY COMMONLY KNOWN AS 101 MEMORY LANE,
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, CHRISTOPHER MARTIN has filed a petition for a variation
with respect to the property commonly known as 101 Memory Lane, in
the Village of Mount Prospect, Illinois; and
WHEREAS, the Subject Property is legally described as follows:
Lot 49 in H. Roy Berry Company's first addition
to Castle Heights, being a subdivision of the
South 1/2 of the Southeast 1/4 of the Northwest
1/4 and the North 95.02 feet of the East 1/2 of
the Southwest 1/4 all in Section 34, Township 42
North, Range 11 East of the Third Principal
Meridian.
WHEREAS, Petitioner seeks the following variation from the
provisions of Section 14.1102.C of Article 11 of Chapter 14 of the
Village Code of Mount Prospect, Illinois, to reduce the required 25
foot rear yard to allow for a rear yard of only 17 feet, in order to
allow a wood deck to be constructed on the Subject Property; and
WHEREAS, a public hearing was held on the variation requests
(designated as Case No. ZBA-51-V-86) before the Zoning Board of
Appeals in the Village of Mount Prospect on the 25th day of
September, 1986, pursuant to due and proper notice thereof published
in the Mount Prospect Herald on the 10th day of September, 1986; and
WHEREAS, the Zoning Board of Appeals has submitted its finding
and recommendation in favor of the proposed variation subject to
certain conditions to the President and Board of Trustees of the
Village of Mount Prospect, and the President and Board of Trustees
have given further consideration to the variation request and have
determined that the same meets the standards set forth in Section
14.605 of Article VI regarding the Variation of said chapter 14 of
the Village Code, this Board further finds that it would be in the
best interests of the Village to grant the requested variation,
provided the same is accomplished pursuant to the conditions
hereinafter set forth.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
FOLLOWS:

SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President
of Trustees of the Village of Mount Prospect.

SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to ~he Subject Property the variation
request with respect to Section 14.1102.C of Article II of Chapter
14 of the Village Code of Mount Prospect, Illinois to allow a 17
foot rear yard instead of the normally permitted 25 foot rear yard.
SECTION THREE: The subject variation shall be granted upon the
following conditions:
(1) that the fence shall be installed adjacent to the deck
on the Subject Property, and
2)
that the deck not extend beyond the front line of
the garage along Memory Lane.
SECTION FOUR: With the exception of the Variation granted
herein, all other applicable Village of Mount Prospect Ordinances
and Regulations pertaining thereto shall remain in full force and
effect a~ to the Subject Property.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
