AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
COMMONLY KNOWN AS 905 EAST RAND ROAD, IN THE
VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Sunrise Pancake House has filed a petition for a
variation with respect to property commonly known as 905 East Rand
Road, Mount Prospect, Illinois; and
WHEREAS, the Subject Property is legally described as follows:
Lot One (1) in Big Boy Re-Subdivision of part of Lots 2 and 3 in
Block 2 in Frank Serafine,s Third Addition, a Subdivision in the
Southwest Quarter (1/4) of sec~i6n ~, ~0~nShip 42 North, Range
11, East of the Third Principal Meridian, according to the Plat
of said Big Boy Resubdivision Registered in the Office of the
Registrar of Titles of Cook County, Illinois, on January 9,
1973, as Document Number 2669248.
WHEREAS, Petitioner seeks a variation to reduce the required 20
foot rear yard provided in Section 14.2002.C of Article XX of
Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow
for a rear yard of only 7 feet; and
WHEREAS, two public hearings were held on the proposed variation
request (designated as Case No. ZBA-47-V-86) before the Zoning Board
of Appeals of the Village of Mount Prospect on the 24th day of July,
1986 and the 14th day of August, 1986, pursuant to due and proper
notice thereof published in the Mount Prospect Herald on the 9th day
of July, 1986; and
WHEREAS, the Zoning Board of Appeals has submitted its finding
and recommendation in favor of the variation subject to certain
conditions to the President and Board of Trustees of the Village of
Mount Prospect, and the President and Board of Trustees have given
further consideration to said request and have determined that the
same meets the standards set forth in Section 14.605 of Article VI
regarding variations of said Chapter 14 of the Village Code and have
further determined that the granting of the variation would be in
the best interests of the public, provided the same is accomplished
pursuant to the conditions hereinafter set forth in accordance with
the plans presented and the testimony adduced by the Petitioner at
said hearing.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF'THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
FOLLOWS:

SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a varlati0n
to reduce the required rear yard along the rear property line of the
Subject Property from 20 feet to 7 feet; said variation to be in
accordance with the conditions hereinafter provided.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a variation
to reduce the required rear yard along the rear property line of the
Subject Property from 20 feet to 7 feet; said variation to be in
accordance with.the conditions hereinafter provided and Exhibit A
as attached.
SECTION THREE: The subject variation shall be granted upon the
following conditions:
1. In the event that the Corporate Authorities of the
Village of Mount Prospect shall enact an ordinance to
vacate that portion of Serafine Drive, lying between
the existing property and the property to the west,
presently improved with a ColorTile retail store, at
the request of the village of Mount Prospect and upon

acquisition of title to said vacated property,
Applicant shall use the property for possible
parking, landscaping, building expansion and/or
egress and ingress;
Petitioner shall either install a sprinkler system
or extend an 8" watermain, as well as provide
additional fire hydrants in a manner satisfactory
to the Village of Mount Prospect;
Ail access driveways and all parking aisles shall
be 24 feet in width and said driveways shall be
aligned with the parking aisles;
Curbing shall be installed along all perimeter
parking lot edges;
Perimeter parking stalls shall be constructed of
asphalt and shall be 18 feet in length with a 2
foot overhang, which together shall provide the
required 20 foot parking stall;
Both existing access points to the property
presently 'improved with a Century Tile Supply
retail facility lying to the east of the subject
property shall be closed;
Landscaping shall be included in the parking lot
islands to be 6 feet wide, around the building and
along the rear yard property line, as attached
hereto in Exhibit A;
Locations of signage must comply with the
applicable provisions of the Village Code;
The Serafine driveway off Albert Street shall be
eliminated and thereafter, the rear area of the
property along Albert Street shall be redesigned
to provide landscaped area of 7 feet in width and
to reduce the amount of illumination affecting
adjoining residential property;
Landscaping Plans shall be provided to and approved
by the Department of Planning & Zoning prior to
permits being issued.
SECTION FOUR: With the exception of the variation
granted herein, the Subject Property shall comply with all
other applicable Village of Mount Prospect Ordinances and
Regulations pertaining thereto.
SECTION FIVE: This Ordinance shall be in full force
and effect from and after its passage, approval and
publication in pamphlet form in the manner provided by law.
