Chairperson Arlene Juracek called the meeting to order at 7:30 p.m. Richard Rogers made a motion to approve
the minutes of the March 25 meeting and Keith Youngquist seconded the motion. The minutes were approved
5-0 with one abstention by Merrill Cotten. At 7:31, Ms. Juracek introduced Case No. PZ-15-04, a request for a
Conditional Use to erect a porch. She noted that the request would be Planning & Zoning Commission final.
Judy Connolly, Senior Planner, presented the case. She said that the Subject Property is located at 208 N. Maple
Street. The Petitioner has requested Conditional Use approval to allow the construction of an unenclosed porch
in the front yard. The P&Z hearing was properly noticed in the April 7, 2004 edition of the Journal Topics
Newspaper. In addition, Staff has completed the required written notice to property owners within 250-feet and
posted a Public Hearing sign on the Subject Property.
The Subject Property is located on the west side of Maple Street, between Isabella and Thayer Streets, and
contains a single-family residence with related improvements. The Subject Property is zoned RA Single Family
Residence and is bordered on all sides by the RA District.
The Petitioners would like to construct an unenclosed porch in the front yard. The proposed porch will extend 6'
from the house and extend along the entire front elevation of the home. The porch consists of wood base, rails
and columns. Their plans indicate that it would be constructed according to Village Codes and the Petitioner's
architect noted that lattice will be installed around the entire base to deter animals from burrowing under the
porch. The proposed unenclosed porch would encroach into the required front yard and create a 25.62' setback,
which requires Conditional Use approval,
The existing home complies with zoning regulations, but the garage encroaches into the required side yard
setback. The garage is allowed to remain in its current location and is a legal non-conformity. However, the
proposed porch would encroach into the required front yard.
The standards for Conditional Uses are listed in the Village Zoning Ordinance. Ms. Connolly summarized the
standards and said that the proposal would not adversely affect the character of the surrounding neighborhood,
utility provision or public streets and the proposed Conditional Use will be in compliance with the Village's
Comprehensive Plan and Zoning Ordinance.

Based on these findings, Staff recommends that the Planning & Zoning Commission approve a Conditional Use
for an unenclosed porch to encroach into the required front yard, creating a front setback no less than 25' for the
residence at 208 N. Maple Street, Case No. PZ~15-04. The Planning & Zoning Commission's decision is final
for this case.
Scott Wagner, 208 N. Maple St., was sworn in. He summarized his request, adding that the porch would be
built with cedar wood and give the home a western ranch appearance. The base will be entirely enclosed, but
easily accessed if animals get underneath.
Mr. Rogers asked Mr. Wagner if he understood that if he were granted the conditional use he could never
enclose the porch. Mr. Wagner said he understood the conditions of approval.
Ms. Juracek noted that this was a straightforward case and thanked him for his presentation. She asked if there
were comments from the audience; being none, she closed the hearing at 7:35.
Richard Rogers made a motion to approve a request for a Conditional Use to construct an unenclosed porch in
the front yard at 208 N. Maple St., Case No. PZ-15-04. Leo Floras seconded the motion.
