PZ-O8-04 Hearing Date: April 22, 2004 PROPERTY ADDRESS: 747 Meier Road PETITIONER: Philip Semar PIN#: 08-10-402-044 REQUEST: Plat of Resubdivision - create a two-lot subdivision MEMBERS PRESENT: Arlene Juracek, Chair Merrill Cotten Leo Floros Richard Rogers Matthew Sledz Keith Youngquist MEMBERS ABSENT: Joseph Donnelly ST AFF MEMBERS PRESENT: Michael Jacobs, AlCP, Deputy Director of Community Development Judy Connolly, AlCP, Senior Planner INTERESTED PARTIES: George& Debbie McKanen Philip Semar Chairperson Arlene Juracek called the meeting to order at 7:30 p.m. Richard Rogers made a motion to approve the minutes of March 25, 2004 and Keith Youngquist seconded the motion. The minutes were approved 5-0 with one abstention by Merrill Cotten. At 8: 10, Ms. Juracek introduced Case No. PZ-08-04, a request to create a two-lot subdivision at 747 Meier Road, Semar's Meier Meadows Resubdivision. Judy Connolly, Senior Planner, presented the case. She said that the Petitioner is seeking to subdivide the site and create a two-lot subdivision. The plat request was properly noticed by posting Public Hearing signs on the Subject Property. In addition, Staff mailed a courtesy notice to neighbors within 250-feet of the Subject Property. The notice included a brief explanation of the request and a sketch of the proposed subdivision. The Subject Property is located at the northeast corner of Meier Road and Lonnquist Boulevard, and currently contains a single~family residence with related improvements. The Subject Property is zoned RI Single Family Residence and is bordered on all sides by the Rl District. The Zoning Ordinance pemÜts one residence per lot of record and requires each new structure to meet applicable setback regulations. The Petitioner's plans indicate that the proposed improvements would consist of two new single-family residences. Therefore, the Petitioner is resubdividing the Subject Property to create two new lots of record. The proposed lots of record would each measure approximately 90.5' x 151' (13,666 sq. ft.). The Petitioner does not have specific plans for the proposed new residences and has indicated that the new homes will meet the Village regulations and be built according to code. The proposed Lot 1 is typical of most corner lots and will allow the future home to be accessed from either Lonnquist Boulevard or Meier Road. The proposed Lot 2 is a through lot with access from both Meier Road and Chris Lane. To ensure the development is in keeping with adjacent properties, Staff recommends that the house be developed so the driveway and front entrance are accessed from Chris Lane, but maintain a 30-foot setback along the west lot line to be consistent with the required setbacks for the proposed Lot 1. The Village Attorney recommends that the plat include text that states this requirement. The plat and new lots comply with the Village's Development Code requirements and the Petitioner is not seeking relief from the Development Code or Zoning Ordinance. Other Departments have reviewed the plat and found that it was prepared in accordance with all applicable Village Codes. Based on these findings, Staff recommends that the Planning & Zoning Commission recommend the Village Board approve the Semar's Meier Meadows Resubdivision, Case No. PZ-08-04 subject to the plat including text requiring the front entrance and driveway for the house on Lot 2 be oriented towards Chris Lane. The Village Board's decision is final for this case. Ms. Juracek had questions regarding the effect new fence regulations would have on the new comer lot. Mike Jacobs said Lot 2 would be able to fence their rear yard the same as the lot to the north can. Commission members felt it would be important to stipulate that Meier Road could not be the entry to this site. Phil Semar was sworn in. He said they had sent letters to 20 neighbors and asked if they wanted the house to face Chris Lane or Meier Road and 14 neighbors responded. The majority wanted the house to face Chris Lane. Ms. Juracek asked Mr. Semar to describe what he planned to build on these lots. Mr. Sernar said that they had no specific plans at this time for Lot 2. Mr. Semar noted that they had a potential customer for Lot 1 which would contain an approximately 3,600 sq.ft. home with a 3-car garage and ftont on Lonnquist Boulevard. Debbie McKanen, 719 Chris Lane, was sworn in and reinforced the Commission's recommendation to build the house on Lot 2 to face Chris Lane. She said they have one concern and that is that the existing large old Oak tree located near the northeast corner of the property be preserved when the new home is built. Ms. Juracek said they could recommend that the builder attempt to preserve the tree but could not guarantee it. There were no more comments from the audience. Ms. Juracek closed the hearing at 8:25. Richard Rogers made a motion to recommend that the Village Board approve the request for Resubdivision to allow the creation of a two-lot subdivision at 747 Meier Road, Semar's Meier Meadow Subdivision with the written stipulation that the house and driveway for Lot 2 face Chris Lane and that every attempt be made to save the Oak tree on Lot 2. Leo Floros seconded the motion. UPON ROLL CALL: AYES: Cotten, Floras, Rogers, Sledz, Youngquist and Juracek NAYS: None Motion was approved 6-0.
