HomeMy WebLinkAboutOrd 5430 05/04/2004 ORDINANCE NO. 5430 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY AT 2 EAST RAND ROAD Passed and approved by the President and Board of Trustees the 4th day of May, 2004 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 5th day of May, 2004 VWL 4/29/04 ORDINANCE NO. 5430 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY AT 2 EAST RAND ROAD WHEREAS, William Barlow, agent for Eagle Realty Group, inc., and Oharam Vir, d/b/a T&K Enterprises, Inc. (hereinafter referred to as "Petitioners') have filed a petition for Variations with respect to property located at 2 East Rand Road (hereinafter referred to as the "Subject Property"), and legally described as follows: Lot One in Christiansen's Subdivision of Part of the Northeast Quarter of Section Twenty-four, Township Forty-two North, Range Eleven, East of the Third Principal Meridian, According to the Plat Thereof Recorded November 28,1971 as Document no. 21725881, All in Cook County, Illinois. Property Index Number: 03-34-200-063-0000; and WHEREAS, the Petitioners seek Variations to Section 14.203.C.9 of the Village Code to allow the construction of a 2,700 square-foot Phillips 66 gas station and convenience store, and to locate the new canopy and convenience store within the required setbacks; and WHEREAS, a Public Hearing was held on the requests being the subject of PZ Case No. 14-04 before the Planning and Zoning Commission of the Village of Mount Prospect on the 22nd day of April, 2004, pursuant to proper legal notice having been published in the Mount Prospect .Journal & Topics on the ih day of April, 2004; and WHEREAS, the Planning and Zoning Commission has submitted its findings and positive recommendations on the Variations to the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect would be attained by granting the requests in PZ-14-04. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY. ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Variation to allow the construction of a 2,700 square-foot gas station with convenience store, as provided in Section 14.203.F.7 of the Mount Prospect Village Code. 2 E. Rand Road Page 2/2 SECTION THREE: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Variation to locate a canopy and convenience mart within the required setbacks, as provided in Section 14.203.C.7 of the Village Code. SECTION FOUR: Prior to the issuance of a building permit relative to the Variations granted, the following conditions and/or written documentation shall be fulfilled: A. The site is developed in accordance with the building elevations and plans prepared by Nick Scarlatis & Associates, L TO, dated April 12, 2004, but revised to reflect: 1. The connection of the canopy to the building shall be eliminated, as reflected on the Site Plan (Sheet 1 of 4); 2. Full face brick on the south elevation of the building. B. The Petitioner shall provide a detailed vehicular movement plan that includes turning movement templates for both automobiles and tanker trucks; C, Color renderings of the proposed canopy and mini~mart building shall be provided; D. Detailed information regarding the proposed signage shall be provided to ensure it complies with the Village's Sign Code; E. The proposed improvements shall be constructed according to all applicable Village Codes and regulations; and F. The Petitioner obtains permits from all appropriate agencies, including, but not limited to, lOOT, MWRD, and CCHD. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided bylaw.
