AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 310BOBBY LANE
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Terrence J. Winkler has filed an application for
variation with respect to property commonly known as 310 Bobby Lane
in the Village of Mount Prospect, Illinois (the "Subject Property");
and
WHEREAS, the Subject Property is described as follows:
Lot 11 in Gettysburgh Estates being a subdivision of
part of the southwest 1/4 of the northwest 1/4 of
Section 11, Township 42 North, Range 11 East of the
Third Principal Meridian, according to the plat
thereof filed and recorded August 28, 1985 as Document
LR3459249 and Document 85166563 respectively in Cook
County, Illinois.
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of an enclosed swimming pool to
be built on the Subject Property having a floor area ratio of .45
within a zoning district otherwise requiring a floor area ratio of
.35 pursuant to Section 14.1103 of Article XI, Chapter 14 and
thereby reducing the required side yard to 10 feet in lieu of the 25
feet required pursuant to Section 14.1102.C of Article XI of Chapter
14; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-31-V-86) before the Zoning Board of
Appeals in the Village of Mount Prospect on the 5th day of June,
1986, pursuant to due and proper notice thereof published in the
Mount Prospect Herald on the 21st day of May, 1986; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variation, and the
President and Board of Trustees of the Village have given further
consideration to the variation request and have determined that the
same satisfies the standards set forth in Section 14.605 of Article
VI of Chapter 14 of the Village c~e,and this Board further finds
that it would be in the best interest of the Village to grant the
request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
FOLLOWS:

SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject PrOperty the
variations requested with respect to Section 14.1103 of Article XI
of Chapter 14 and to Section 14.1102.C of Article XI of Chapter 14,
respectively, of the Village Code of Mount Prospect, Illinois, to
allow the construction of an enclosed swimming pool on the Subject
Property having a floor area ratio o'f .45 and a side yard of 10
feet and with the conditions that no sheds or other accessory
buildings are to be permitted on the Subject Property, all as shown
on the Design Plans and Site Plan attached hereto and made a part
hereof.
SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
