AN ORDINANCE GRANTING VARIATIONS FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 207 CATINO COURT
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, James and Janet Evens have filed an application for
variations with respect to property commonly known as 207 Catino
Court, in the Village of Mount Prospect, Illinois (the "Subject
Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 6 in Westgate Gardens subdivision, being a
subdivision of part of the Northeast 1/4 of the
Southwest 1/4 of Section 35, Township 42 North,
Range 11 East of the Third Principal Meridian in
Cook County, Illinois.
WHEREAS, Petitioner seeks a variation from the following
provisions of Chapter 14 of the Village Code of Mount Prospect,
Illinois, to allow the construction of a garage being 735 square
feet in size instead of the 600 square feet permitted pursuant to
Section 14.102.B.4 of Article I, of Chapter 14, be built on the
Subject Property; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-26-V-86) before the Zoning Board of
Appeals of the village of Mount Prospect on the 15th day of May,
1986, pursuant to due and proper notice thereof published in the
Mount Prospect Herald, on the 29th day of April, 1986; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations to the President and Board of Trustees of the
Village of Mount Prospect to allow the requested variations, and the
President and Board of Trustees of the Village have given further
consideration to the variation requests and have determined that the
same satisfy the standards set forth in Section 14.605 of Article VI
of Chapter 14 of the Village Code, and this Board further finds that
it would be in the best interest of the Village to grant the request
for variations.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees of
the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property tke variation
requested with respect to allowing the construction of a garage 735
square feet in size instead of the 600 square feet permitted pursuant
to Section 14.102.B.4 of Article I, Chapter 14 and with the further
conditions that said driveway width to be tapered to 18 feet at the
sifewalk and 21 feet at the curb and that no sheds or other accessory
buildings are to be permitted on the Subject Property all as shown on
the Site Plan attach hereto.
SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publiCation in pamphlet
form in the manner provided by law.
