Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the .18th day of June , 1986 3405S/60 ORDINANCE NO. 3666 AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS RANDHURST SHOPPING CENTER, 999 ELMHURST ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Rouse/Randhurst Shopping Center has filed a petition for a special use with respect to property commonly known as Randhurst Shopping Center, 999 Elmhurst Road, in the Village of Mount Prospect, Illinois; and WHEREAS, Petitioner is the owner of the Subject Property which is legally described as follows: The West half of the Southeast quarter of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian (except that part thereof falling in a 100.0 foot strip conveyed to the County of Cook by deed recorded May 6, 1941 as Document No. 12674702 and filed May 6, 1941 as Document No. L.R. 895623, the center line of which is described as follows: Beginning at the Northwest corner of the Southeast quarter of Section 27, aforesaid; thence East along the North line of said Southeast quarter, a distance of 550.0 feet to a point of curve; thence in a generally Easterly direction along a curved line tangent to said North line of the Southeast quarter. Convexed Northerly and having a radius of 24,555.35 feet. A distance of 1028.57 feet to a point of tangency; thence in a generally Easterly direction along a straight line. Tangent to the last described curved line. A distance of 165.03 feet to a point of curve; thence in a generally Easterly direction along a curved line tangent to the last described straight line. Convexed Southerly and having a radius of 24,555.35 feet, for a distance of 1028.57 feet.) also The West 460.0 feet as measured along the North line thereof, of the East half of the Southeast quarter of Section 27, Township 42 North. The center line of which is described as follows; Beginning at the Northwest corner of the Southeast quarter of Section 27, aforesaid: thence East along the North line of said Southeast quarter, a distance of 550.0 feet to a point of curve; thence in a generally Easterly direction signs a curved line tangent is said North line of the Southeast quarter, convexed Northerly, and having a radius of 24,555.35 feet. A distance of 1028.57 feet to a point of tangency; thence in a generally Easterly direction along a straight line tangent to the last described curved line, a distance of 165.03 feet to a point of curve; thence in a generally Easterly direction along a curved line tangent to the last described straight line. Convexed Southerly and having a radius of 24,555.35 feet, for a distance of 1028.57 feet and also except the North 70.0 feet of the West 70.0 feet of the South 120.0 feet of said East half of the Southeast quarter of Section 27) all in Cook County, Illinois. WHEREAS, Petitioner seeks a special use for a sign planned unit development to establish a complete sign proposal for the entire shopping center as proposed in exhibits submitted by the Petitioner, in accordance with Section 14.704 of Article VII of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAS, public hearings were held on the proposed special use request (designated as Case No. ZBA-10-SU-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 27th day of March, 1986 and the 24th day of April, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the llth day of March, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and unfavorable recommendation as to the proposed special use to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have given further consider- ation to said requests and have determined that the same meets the standards set forth in Section 14.704 of Article VII pertaining to special uses of said Chapter 14 of the Village Code and have further determined that the granting of the proposed special use would be in the best interest of the public, provided the same are accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a special use to allow thereon the sign proposal for the entire Shopping Center as set forth on Exhibit A, attached hereto and made a part hereof; said special use to be in accordance with the conditions hereinafter provided. SECTION THREE: The subject special use shall be granted upon compliance with the conditions set forth on Exhibit B attached hereto and made a part hereof. SECTION FOUR: With the exception of the special use granted herein, the Subject Property shall comply with all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law. Wall Sign Concept: All wall signs for the mall and freestanding buildings will consist of individual letters applied directly to the exterior surface of the building. Wall signs on the mall building shall be used only ~here an exterior entrance exists. Staff approval will be required of ail new signs to ensure that the proposal will conform to size requirements of the Ordinance and design standards. Freestanding Sign Concept: Signs will be ground-mounted, of common material, letter- style, and letter-color in conformance with the concept attached, marched Exhibit C. Ail ground signs will be landscaped with Village staff approval of the design and material.
